Principles of natural justice

In a legal system, in order to ensure a fair valid and true decision


fundamental principles are followed:-
 The right to a fair hearing; and

 The rule against bias.


The other principles which have been stated to constitute elements
of Natural Justice are:-
 i. The parties to a proceedings must have due notice of when the

Court / Tribunal will proceed.


 ii. The Court / Tribunal must act honestly and impartially and not

under the dictation of other persons to whom authority is not


given by Law
INTRODUCTION

Meaning of Standing orders:


According to INDUSTRIAL EMPLOYMENT(STANDING
ORDERS) ACT,1946
Standing Orders means rules relating to matters set out in
the schedule of the sec 2(g) of the act.

Object of the Act:-


The object of the act is to require employers in industrial
establishments to define with sufficient precision the
conditions of employment under them and to make the said
conditions known to workmen employed by them.
It consists of two main things namely:

 Conditions of employment and standing


orders.

 Formal declaration of terms and conditions


of employment.
Salient features of the act:

 To frame, draft standing orders and submit to the certifying officer.

 The definition of workman under this act includes a supervisory


technical personnel under certain conditions.

 The certifying officer has the power to add or modify the standing
orders.

 Similar industrial establishments can submit joint standing orders.


Salient features of the act:
 The government may set out a model standing order
for the purpose of this act.

 The act applies to every industrial establishment


wherein 100 or more workmen are employed.

 The certifying officer shall have all the powers of a


civil court in respect of certain matters provided in
sec 9.
Salient features of the act:
 The employer can be penalised for not submitting the
draft standing order for certification or contravention of
any provision.

 The government may by a gazette notification exempt


any establishment from the provisions of the act.

 The government by notification in the official gazette


make rules to carry out the purpose of the act.
