5. ‘The grant of financial upgradation to the officers mentioned above are in terms of
DOPE&T O.M.No. 35034/3/2008-Estt(D), dated 19.05.2009 is subject to inter-alia, the
following conditions :_
5.1 ‘The financial upgradation will not result in change in the designation,
classification or higher status. However, financial and certain other benefits which are
inked to the pay drawn by an employee such as HBA, allotment of Government
accommodation shall be permitted
‘The financial upgradation under the MACP Scheme shail be purely personal to
incumbents (officers) and shall not amount to actual functional promotions of the
olticers concerned. Further, it shall have no relevance to their inter-se-seniority
position , and as such, there shall be no additional financial upgradation for the senior
officers on the ground that the junior officers have got higher pay scale(s) under the
MACP Scheme, ‘The concept of “Senior ~ Junior” is quite alien to the idea behind the
MACP Scheme.
5.3 Ifa regular promotion has been offered but was refused by the officer before
becoming entitled to a financial up-gradation , no financial upgradation shall be allowed
as such an employee has not been stagnated due fo lack of opportunities. If, however,
linancial upgradaton has been allowed due to stagnation and the employees
subsequently reuse the promotion, it shall not be a ground to withelraw the financial
upgradation, He shall, however, not be eligible to be considered for further financial
upgradation till he agrees to be considered for promotion again and the second the next
financial upgradation shall also be deferred to the extent of period of debarment due to
the refusal
54 Benefit of pay fixation available at the time of regular promotion shall also be
allowed at the time of financial up-gradation under the Scheme. ‘Therefore, the pay shall
be raised by 3% of the total pay in the pay band and the grade pay drawn before such
upgradation. There shall, however be no further fixation of pay at the time of regular
promotion if itis in the same grade pay as granted under MACPS. However, at the time
of actual promotion if it happens to be in a post carrying higher grade pay then what is
available under MACPS, no pay fixation would be available and only difference of
race pay would be made available,
5.5 Fixation of pay on grant of financial upgradation under MACP Scheme an oflicer
has an option under FR 22 (1) (a) (1) to get the pay fixed in the higher post / grade pay
cither {rom the date of his promotion / upgradation or from thé date of their next
increment viz.1 of July of the year, The pay and the date of increment would be fixed
in accordance with clarification No. 2 of Department of Expenditure’s O.M.
NO.1/1/2008-IC, dated 13.09.2008,
5.6 No past cases would be re-opened. Further, while implementing, the MACP
ae ee eee6 The Commissionerate shown against the names of the officers are as per the”
reports received. They may be instances where officers, on the date of issue of this order
are transferred to other Commissionerate. In such cases, the grant of the financial
upgradation should not be disallowed as the officers have been found eligible for MACP
benefits as per the dates shown against their names
7. All the controlling officers may obtain the latest vigilance clearance before fixation
of pay
This issues with the approval of Commissioner of Customs, Central
Service Tax, Hyderabad Il Commissionerate, Hyderabad.
