The Court has just filed a memorandum opinion and order dismissing without prejudice the
indictment in this case. The motions hearing scheduled for March 25, 2011 at 10:00 a.m. will
be held as scheduled, and the parties should be prepared to argue the following motions at
Friday’s hearing:

x United States’ Motion in Limine and Notice of Potential Evidential Issues


(ECF No. 76)
x United States’ Supplemental Motion in Limine (ECF No. 78)
x United States’ Notice of Filing of Documents for Court’s in camera Review
(ECF No. 125)

In addition, the Government should be prepared to discuss whether it intends to appeal


pursuant to 18 U.S.C. § 3731 or seek another indictment, and, if so, the anticipated length of time it
will take for the Government to secure that indictment. The parties should also be prepared to
discuss whether the trial can proceed consistent with the present schedule. It is important that the
parties explore the potential for proceeding with this trial in April, because failure to do so will
likely result in this trial being scheduled for 2012. Finally, the parties should be prepared to
address at the hearing whether each remaining filing that is currently sealed can be unsealed.

Despite the informal nature of this ruling, it shall constitute an Order of the Court, and the
Clerk is directed to docket it accordingly.
