The report revealed corral runoff was pumped into an irrigation lateral on the north side of the field. (Exhibit 1). Mr. Godfrey also completed a Dairy Farm Waste Discharge Inspection Report. The report revealed corral runoff was collected in the east collection pit and pumped into the irrigation lateral then flowed into the S-39 Canal. The report also depicted a hand drawing of the path of the discha (Exhibit 2). Mr. Godfrey took 13 photos of the discharge at South View Dairy and downloaded two Goo ™ maps. (Exhibits 2 & 3), and collected four waste water samples and labeled them: [sample-1] “Canal 39 upstream”, [sample 2] “Down stream S-39”, [sample 3] “Collection pond Southview Flemming heifer’ [sample 4] “Out of buried irrigation pipe in canal $-39”, and delivered the samples to Magic Valley Labs (Exhibits 2 and 4). Reporting Investigator(s) on October 15, and October 19, 2009: On October 15, and October 19, 2009, the Dairy Bureau received the samples taken by Lynn Godfrey on October 9, 2009, at South View Dairy. Opportunity to Respond: You may respond to this Notice of Intended Penalty in one of two ways: 1. You have the right to a formal administrative hearing, held in accordance with the Idaho Administrative Procedure Act, Title 67, Chapter 52, Idaho Code. 2. You may informally meet with ISDA to discuss the intended action. The ISDA Rules of Practice and Procedure encourage the use of informal proceedings, also known as a settlement meeting, to settle contested cases. Settlement meetings can be scheduled at the ISDA, 2270 Old Penitentiary Road, Boise, Idaho 83712. The following representatives from the ISDA may be in attendance at the settlement meeting: Administrator, Bureau Chief, Program Manager, and/or Investigator, and Deputy Attorney General. You may wish to be represented by legal counsel; however, you are not required to have an attorney present. At the settlement meeting, the ISDA will review the facts of your case, including any information you may wish to provide.
