INTRODUCTION 4. Short title and commencement. (1) These rules may be cited as the Punjab Develpment Authorities Land Use (Classification, Reclasifeation and Redevelopment) Rules, 2008, (2) These’ shail come into force at once (nese rls sal be applicable Ino ct area nolifled by a Development Autos, in 3 City District 2. Definitions — In these rules unless there is anything repugnant in the subject or context,— (i) ‘agriculturat area” means land outside the per-urbian area which is predominantiy used for the cultivation of crops and includes cropiand, pastureland, orchards, nurseries and dairy farms; (i) “approved scheme’ means a scheme approved by the Government, an Authoriy, a tocal government or any other public authority : (ii) “Authority” means ‘a development authority established under Section 4 of the Punjab Development of Cities Act 1976 (XIX of 1976); : (iv) “betterment fee” means the fee levied by an Authority under Section 22 of the Punjab Development of Cities Act 1976 (XIX of 1976); PART-1 w wi wid wily (oo 9 a oa xi xi) (xiv) : ow) (xi) (xv 7 vv) xix) rc) (xx) xxi) wai) (oo) (oovi) (oxvi) cexvi) xxix) (0009) THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 ‘ouilding fine” means the line beyond which the outer face of a building may not be projected in the direction of an existing or proposed road except the compound wall “building regulations” mean the building and zoning regulations of an Authority as notified from time to time: ‘ity arca” means the area nbtfied under section 3 of the Punjab Development of Cities Act. 1976 (XIX of 1976); commercial area" means an area which is designated for commercial use as per approved scheme or master plan, or is being used, as such in the established built up area: “commercial use” means land use which is predominantly connected with sale and distribution of goods and services: ‘competent authority” means an Authority competent to approve and classification, reclassification or redevelopment: ‘commercial corridor’ means a road or a segment of a road. with not less than sixty feet right of way and specified depth of area, which has been designated as commercial by'a competent authorty: “District Planning and Oesign Committee” means a District Planning and Design Comittee constituted by the Government under rule 52: “educational institution’ includes a school, college, university, research or training center, library or a madrassah: “established built up area” riteans built up area other than the built up area in an’ approved scheme: “environmentally sensitive area” means an area that has been designated’as such Under Regulation 22 of the Pakistan Environmental Protection Agency ( Review of intial Environmental Examination and Environmental Impact Assessment) Regulations 2000, “Government” means the Governmient of the Punjab housed in the Housing, Urban Development and Public Health Engineering Department: ° healthcare ‘institution’: includes" a” hospital, health centre, dispensary, clinic Polyclinic, clinical laboratory, medical training center, nursing home, dental centre, homeopathic or acupuncture center, recognized as such by any law for the time being in force: “histarically significant area’ means an area designated under any law for the time being in force as historically, architecturally or archeologically significant area; - “industrial area” means an area which is" designated for industrial use as per approved scheme or master plan, oris being used as such in the established built vp area: “industrial Area Scrutiny Committee’ means the Industrial Area Scrutiny ‘Committee constituted by the Government under rule 53; “industrial -use" means land use which is predominantly connected with manufacturing, assembling, processing or storage of goods; “industrial corridor’ means a road or a segment of a road, with not less than sixty feet right of way and-has been reclassified as such by a competent authority; “industrial plot” means an industrial plot in an industrial estate, approved scheme ‘or master plan: ‘nstitulional use" means land use which is redominantty connected with ‘education, health, public or private office, hotel, thez:re or auditorium; intercity service area’ means an area designated by the competent authority as service area along the intercity road outside the peg-urban area, ‘katchi abadi’ means an area declared by the Govérnment as, katchi abadi under the Punjab Katchi Abadis Act 1992 (Vil! of 1892); ‘and use. plan’ means a plan approved by a’ competent authority for reclassification, development or redevelopment of an area; ‘master plan” means a land use plan of an area and includes a structure plan, an ‘outiine development plan, a spatial plan,, periurban structure plan and a metropolitan plan “non-conforming use” means the land use that does not conform to the permitted cof permissible land use butis existing at site; ‘notified area” means an area in which special restrictions regarding its development or redevelopment have been imposed under any law for the time being in force: 405 406 THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 ‘boxi) ‘other restricted area’ means an area in'which the Federal Government, the Government, a locai government or any other public body has imposed certain building or area development restrictions; (xxi) “perturbain area” means an area that spans the landscape between contiguous turban development and rural countryside with low population density and is, predominantly being used for agricultural activity and is likely to be urbanized in the next twenty years; (xxl) ‘project afea” means an area selected by the Authority to prepare a land use reclassification scheme; (xxiv) ‘public sector institutional area” means an area reserved for the Federal Government, the Government, an Authorty. a local government or any other public body. (ev), “redevelopment” means renewal,.reconstruction or up gradation of infrastructure and buldings in-an area (exxvi) “residential area means an area which is designated for residential .use in accordance with an approved scheme or master plan, or is being used as such in an established built up area, (oxi) “residential use” means land use which is predominantly connected with housing (vexxvi) “right of way" means the width of road or street between two opposite properties, “Table” means a table appended to the rules valuation table" means a Valuation table notified under the Stamp Act 1899 (II of 1898); and (xii) ‘Zila Couincit” means the Zila Council of the concemed City District 3. Terms not defined.— A word or term used in these rules but not defined sttall have the same meaning as in the Punjab Development of Cities Act 1976 (XIX of 1976). CHAPTER I LAND USE CLASSIFICATION 4, Land use classes - (1) An’Authorty shall classify land in the city area inte the following land use classes (a) residentia. (b) commercial (including institutional. {) industrial (a) periurban; {@) ageicutural, and (notified area ‘An Authority shall'sub-classify the land use classes according to the characteristics as din the Table A, 5. Residential area — An Authority shall sub-classify a residential area as follows: (a) approved scheme: () RAL: means a residential area with size of plots being more than two kanal and right of way of roads ranging from fy feet to two hundred and twenty feet and 2 typical right of way of sixty feet, (i) RAZ: means a residential area with size of plots being one kanal to two kanal and right of way of roads rangihg from thirly feet to one hundred and eighty feet and a typioal right of way of thirty feet . (ii)’ RAS: means'a residential area with size of plots being ten marta to one kanal and fight of way of roads ranging from thirty feet to one hundred and twenty feet and ‘atypical right of way of thirty feet; and (iv): RA4: means @ residential area with size of piots being less than ten maria and right of way of roads ranging from twenty feet to eighty feet and a typical right of way of thirty feet (b) established built up area: (i) REt: means a residential area with size of plots being more than one kanal and fight of way of roads ranging from forty feet to two hundred and twenty feet and a typical right of way of forty feet; (i) RE2: means a residential area with size of plots being ten marta to one kanal and right of way of roads canging from thirty feet to one hundred and twenty feet and a typical right of way of thirty feet; PART-I PART-1 THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 407 a lit) RE3. means a residential area with size of plots being five marla to ten maria and right of way of roads ranging from twenty feet to sixty feet and a typical right of way of thirty feet; and (wv) RE4: means a residential area with size of plots being less than five maria and right of way of roads up to forty feet and a typical right of way of twenty feet Land use of residential area~ An Authority shall ensure that the following land: use ‘ovisions under permitted. permissible and prohibited uses are strictly followed in a fesidental om (@) permitted uses ‘an Authority shail permit following uses in a residential area: () detached house: (ii) semi- detached house. (ii), town house; {iv} “residential apartment (W)_ neighborhood level park and playground; (8) place of worship or prayer: (it) place of burial or cremation; and (i) Rorticuttural nursery (b} permissible uses subject {0 rule 18, 2 competent authority may grant permission for any of the following uses: : (i) daycare centre or preschoo! (i). primary schoo! (i) secondary school (iv) dispensary with no bed and laboratory facilites: (¥) tibrary (wi) guest house having not more than ten rooms; small size comer shop at the ground floor. and office of a professional not exceeding twenty five percent of the floor area. as office associated with resident professional; this facility shall be available toa resident holding both a professional degree, diploma -or ‘certificate and a registration with a statutory body established under a law for the time being in force 7 (©) prohibited uses: ‘an Authority shall not allow a person to use a property in a residential area for a Purpose which is neither permitted nor permissible 7. Commercial area.— An Authority shall sub-classify a commercial area as follows: : (@) approved scheme: {) CAt: means commercial area with size of plots being more thah two kanal and Fight of way of road ranging from fity feet to two hundred and.twenty feet and a typical nght of way of sixty feet: (il) CA2: means commercial area with size of plots being one kanal to two kanal and right of way of road ranging from thirty feet to one hundred ahd eighly feet and a typical ight of way of thirty feet: « (ii) CAS: means commercial area with size of plots being ten maria to one kanal and fight of way of road ranging from thirty feet to one hungred and twenty feet and a typical right of way of thity feet: and 408 THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 RT- (iv). CA4: means commercial area with size of plots being legs than ten marla and * ‘ight of way of road ranging from twenty feet to eighty feet and a typical right of way of thirty feet: 7 7 (b) established built up area 7 (i) CEL means commercial area with size of plats being more than one kanal and right of way of road ranging from forty feet to two hundred and twenty feet and a typical right of way of forty feet: . (i), CE2: means commertial area with size of plots being ten maria to one kanal and Tight of way of road ranging from thirty feet to one hundred and twenty feet and a typical right of way of thirty feet; (iii) CE3: means commercial area with size of plots being five maria to ten maria and right of way of road ranging from twenty feet to sixty feet, and a typical right of way of thirty feet, and z (iv) CE4: means commercial area with size of plots being less than five maria and Tight of way of road ranging upto forty feel and a typical right of way of twenty feet: {c) commercial corridors: (i), CC1; means commercial corridor with size of plots being more than six kanal and ‘ight ofway of roads more than one hundred and twenty feet (i) CC2: means commercial corridor with size of plots being four kanal to six kanal ‘and right of way of roads ranging from one hundred feet to one hundred and | twenty feet: (ii) CC3: means commercial corridor with size of plots being two kanal to less than four kanal and right of way of roads ranging from eighty feet to ane hundred feet; and (iv) CC4: means commercial corridor with size of plots being one kanal to less than two kanal and right of way of rads ranging from sixty feet to eighty feet. 8. Land use of commercial ‘area An Authority shall ensure that the following land use provisions under permitted, permissible and prohibited uses are strictly followed in a commercial area (a) permitted uses: ‘an Authority shall permit foliowing uses in a cprnmercial area: () muti storey building: (il), apartment, 7 (iu) plaza; (iv) residential fat on upper for: . (id) research institution with a minimum plot size of four kanal (i) marraige or banquet hall with a minimum plot size of four kanal, fiv) cinema; (eater, sori, concert ha oF ein all wih a sinkeum plo i of for canal: (vi) seasonal commercial fare site: (wii: stadium or play land; (wit petrol pump or gas station, (0) bus or truck terminal: (®), loading and unloading requirements of all uses; (xi). weighbridge: (xi) prvate hospital (x1). hotel four star or above; (xv) television or other studio; (ex) auto workshop, (wv) whole sale storage place: (xvi). printing press: (xvi) athletic club, gymnasium, fitness centre or indoor spor facility; and (xix) base trans receiver station or communication tower: (©) prohibited uses: an Authority shall notallow a person to use land or building in a commercial area for ‘any purpose which is neither permitted nor permissible, 8. Industrial area.— An Authority shall sub-classify an industrial area as follows (a) approved scheme ()) IAT means induStriat area with size of plots being five acre and above and right of way of road ranging from eighty feet to two hundred feet: (i) 1A2: means industrial area with size of plots being one acre to less than five acre ‘and right of way of road ranging from sixty feet to one hundred forty feet; (i) 1A3_means industrial area with size of plots being four kanal to less than one acre and right of way of road ranging from fity feet to one hundred and twenty feet and : iv) Ad medhs industrial area with size of piots being less than four kanal and right : of way of road up to eighty feet: - (b) established built up area: (0 1E1: means industrial area with size of plots being above four kanal and right of way of road ranging from forty feet to eighty feet with a typical right of way of forty . feet 410 THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 (i) 1E2: means industrial area with size of plots being two kanal to four kanal and right of.way of road ranging from thirty feet to sixty feet with a typical right of way of thirty feet tii) 1E3. means industrial area with size of plots being one kanal to less than two kanal and right of way of road ranging from twenty feet to sixty feet with a typical right of way of thity feet; and (iv) IE4. means industrial area with size of plots, being iess than oné kanal and right of way of road up to forty feet with a typical right of way of twenty feet (c) industrial corridor, () IC1: means industrial corridor with size of plots being more than two kanal located along the provincial high ways outside the per-urban areas: and (i) 1C2: means industrial corridor with size of plots being one kanal to one acre focated along the intercity road inside the peri-urban area 10.Land use of industrial area ~An Authority shall ensure that the following land use provisions under permitied, permissible and prohibited uses are strictly followed in an industrial areat (1) approved industrial area: the permitted, permissible and prapibited land uses shail be in accordance with the ‘approved scheme of an industrial area: 6 (2) established built-up area and industrial corridor (iC2). (a) permitted uses: an Authority shall permit following uses in a established built up area and IC2 area 7 (®) cottage or light industry: (i) construction equipment; (ii) warehouse, storage or distribution centre; (jv) building material store; (v) fire station; and (vi) loading and unloading place (b) permissible uses: : subject to rule 18, a competent authority may grant permission for any of the : following uses, (0) medium industry: (i) petrol pump or gas station; {ily essential residential, commercial or, educational facility for laborers or employees; and (iv)_ police station. post office: (©) prohibited uses ‘an Authority shall ot allow a person fo use a property in an industrial area for a purpose which is neither permitted nor permissible Notwithstncing the provisions ‘under (a) &(0) above, folowing acts shall also not be permitted in an established builtup area and IC2 (storing. packing, pursing, cleaning, preparing, and manufacturing of blasting powder, ammunition, fire works, gun powder. sulphur, mercury, gases, nitro- ‘compounds, phosphorous, dynamite: (iy storing explosives, petrol, oil, lubricants, and other inflammabie materials including coal, chemicals, liquids or otherwise cleaning dying, preparing and ‘manufacturing of cloth or yam in indigo or other colour, PART-I PART-L THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 (ii). storing, processing. cleaning, crushing, melting, preparing or manufacturing and dealing in bombs. tallow, offal, fat blood, soap, raw or dry hide or skin. washing or dying woo! or hair. and Ww casting of heavy metals, electro piating, welding, marble cutting and polishing, manufacturing of cement or pipes. burning or grinding of lime stone; metal or use of any othér obnoxious or hazardous material (3) industrial corridor (IC1) (a) permitted uses: . an Auithonty shall Berm following uses in an industrial corridor: : () light, medium or heavy industry including manufacturing, production. processing. cleaning, servicing and repair of materials, goods or products. . (i) ancillary office or place for industry: (ii) petrol pump or gas station (iv) essential residential, commercial or educational facilty for employees; (W) police station, post office or fire station, (ui), loading and unloading place: (vi) construction equipments (wi) warehouse, storage or distribution center: and {ix}, building materiai store (o} permissible use. subject to rule 18, 2 competent authority'may grant permission for any of the following uses: : {i)_ storing. packing, pursing, cleaning, preparing, and manufacturing of blasting powder ‘ammunition, fire works, gun powder. sulphur, mercury, gases, nitro- compounds, phosphorous dynamite lip. storing explosives. petrot, oll, lubricants, and other inflammable materials including coal, chemicals, liquids or otherwise cleaning dying, preparing and ‘manufacturing of cloth or yarn in indigo or other colour; {iy storing, processing, cleaning, crushing, melting, preparing or manufacturing and dealing in bombs, tallow, offal fat blood, soap. raw or dry hide or skin. ~ washing or dying wool or hair, and {iv)_ casting of heavy metals, electro plating, welding, marble cutting and polishing, : manufacturing of cement or pipes, burning or grinding of ime stone, metal or ‘ < ute of any other obnoxious or hazardous material (c) prohibited use ‘an Authority shall'not allow a person to use a property in a industrial area for a purpose which is neither permitted nor permissible, 41. Peri -urban area.-An Authority shall ensure that the area that spans the landscape between contiguous urban development and rural countryside with fow population density and is predominantly being used for agricultural activity and is likely to be urbanized in the next twenty years is notified as peri-urban area. ; 42.Land use in peri-urban area~ Ax Authority shall ensure that land use provisions under permitted, permissible and prohibited uses prescrived for residential, commercial institutional. (1) istoricaly significant area : (a) permitted use : PART-I THE PUNJAB WEEKLY GAZETTE OCTOBER 14, 2009 413 3) “ an Authority shall ensure that land use permitted in a historically significant area is in accordance with any special or general law and the conditions provided in the otiication governing the historically signficant area (b) permissible use: an Authority. subject to rule 18, may grant’ any of the permissible uses in a fstoricaly significant area which 1s in accordance with any special or general law and the conditions provided in the notification governing the historically significant area (€) prohibited use: an Authority shall not allow a persen to use 2 property in a historically significant ares for 2 purpose which is neither permitted nor permissibie eouironmentally sensitive area (a) permitted use ‘an Authority shall ensure that permitted land use in an environmentally sensitive area is in accordance with special or general law and any special conditions applicable in the environmentally sensitive area, (©) permissible use. ‘an Authority may. subject to rule 18, grant any of the permissible use in an environmentally sensitive area subject to any special or general law, (6) prohibited use an Authority shal ensure that no person is allowed to use @ property in an enwronmentally sensitive area for a purpose which is neither permitted nor permissible. . pubic sector institutional area: (@) permitted use 2 competent authonty’ shall ensure that permitted land use in a puble sector tnsttvional area isin accordance with any special or genera aw (bi permssibie use : subject to rule 18 a competent authority may grant permission for" any of the folowing uses (i) pubic office including a Federal Govemmient. (a) marking ‘the plot which has’ been converted from residential land use without + approval of the competent authority and declaring it as non-conforming use: and _ (e} marking the plot which has been temporarily converted to commercial use with the approval of competent authorty and declaring it as non-conforming use. (2) The Director Town Planning shall forward the other copies of the holed land use classification map to the Government and the City District Government Lahore. (3) _ An Authorty shall publish the nolifed land use classtfcation map on its website {4) A person may, subject to payment of fee, obtain a certifi! copy of the notified land use classification map from an Authority. 25.Peri-urban structure plan.- An Authority shall, within nine months from the notification of these rules, prepare a structure plan for the peri-urban area : 26.Preparation of the peri-urban structure plan — (1) An Authority shall prepare a peri-urban ‘structure plan by: (a) using the satelite imagery, () conducting field survey; and (c) marking boundaries of the established buill up area and approved housing schemes ‘on the base map. (2) An Authority shall mark external boundary of the peri-urban area on the basis of (a) direction and trend of the urban sprawl. (>) population growth rate; and {c) requirements of urban development forthe next twenty years. (3) The periurban structure plan shall include: {2} proposed road networks, {b) division of area into. blocks;and {c) the proposed land uses for various blocks. 27.Public consultation ~ (1) An Authority shall 7 {a) invite objections or suggestion by giving’ public notice indicating salient features of the draft periurban structure plan on its website and in at least two leading national and one local news papers. (b) arrange public hearing on a specified date, time and place; and maintain record of the proceedings for a minimum period of five years after the approval of perr-urban structure pla. : (2) The Director Town Planning shall sign and stamp the draft periurban structure plan prepared after takingrin to.considerations the public objections and suggestions,
