*The right to excises your rights is very important

*You need to know that if you want to change something


you need to speak up.

*Whether you speak up in writing , with your voice, or


physically protesting you are making a change

The 4th amandment :
-Protects individuals against unreasonable searches, seizure,
and arrest.

-Its general purpose is to deny the government an authority to


make general searches.
Searched and seizure
separate:
Examples:
-Person seized and searched: car pulled over, driver frisked

-Person seized but not searched: traffic citation

-Person searched but not seized: thermal scans, x-rays etc


(airports)
Reason for search warrant:
-Causes: reasonable belief that a person has committed a
crime.

- Affidavit: a formal legal document containing written


statements of legal significance that are being sworn to under
oath by the author of the document.
Consent searches:
-Permission given to police:

-police asks you to search your car and you say yes out of fear or
naivety

-parents give police permission to search your room

-court warrant

-Police cannot get permission from:

-roommate to search your room

-landlord
Warrant specifics:

-Place to be search

- person or persons in questions

- item or items to be taken

- time frame

- Judge’s signature
No warrant?
- EXCLUSIONARY RULE; evidence that is illegally obtained
cannot be used in court against the defendant

- weapons used in crime

- drugs

- documents
Search made in connection
with an arrest:
- After a legal arrest, police may search immediate areas
under suspect’s control purse/bags.

- If a legal arrest occurs in bathroom, police can search only


the bathroom legally.
Car search and their occupants;
-Cars may be searched without a warrant whenever the car
has been validly stopped and police have suspected that the
car contains contraband or evidence.

- The police also can ”frisk” that occupants for weapon so


long as they have a “reasonable suspicion” that the occupants
are involved in criminal activity beyond the traffic violation
and are reasonably concerned for their safety.
Why are bags/purses
searched in school dances?
- At the risk of stating the obvious, bags and purses are
checked at school dances for the safety and security of those
who attend them. Not everyone who goes to a school dance
may have the best of intentions.
Can the school check
students lockers?
-As far as the lockers are concerned, they are not your
property and therefore do not provide you any right to
privacy.

- but only if an administrator believes a locker contains


contraband.
