In primul rind, cind o companie aeriana iti anuleaza sau decaleaza zborul (care e in EU sau din/spre UE), se aplica

legea (EC) No 261/2004, aveti linkul mai jos: http://eur-lex.europa.eu/LexUriServ/...4R0261:EN:HTML Va selectez un articol foarte important, studiati-l cu atentie, si fiti constienti de drepturile voastre: Article 5 Cancellation 1. In case of cancellation of a flight, the passengers concerned shall: (a) be offered assistance by the operating air carrier in accordance with Article 8; and (b) be offered assistance by the operating air carrier in accordance with Article 9(1)(a) and 9(2), as well as, in event of re-routing when the reasonably expected time of departure of the new flight is at least the day after the departure as it was planned for the cancelled flight, the assistance specified in Article 9(1)(b) and 9(1)(c); and (c) have the right to compensation by the operating air carrier in accordance with Article 7, unless: (i) they are informed of the cancellation at least two weeks before the scheduled time of departure; or (ii) they are informed of the cancellation between two weeks and seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than two hours before the scheduled time of departure and to reach their final destination less than four hours after the scheduled time of arrival; or (iii) they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival. 2. When passengers are informed of the cancellation, an explanation shall be given concerning possible alternative transport. 3. An operating air carrier shall not be obliged to pay compensation in accordance with Article 7, if it can prove that the cancellation is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken. 4. The burden of proof concerning the questions as to whether and when the passenger has been informed of the cancellation of the flight shall rest with the operating air carrier. In cazul meu, prima anulare a zborului a fost anuntata cam cu o luna inainte, prin email. Se mentiona ca zborul era anulat, fara a da detalii privind cauza anularii (eu suspectez ca era

datorita numarului mic de pasageri), si ca mi s-a rezervat un alt zbor cu doua zile in avans, in email avind un link prin care puteam accepta schimbarea online. Nefiind de acord cu anticiparea zborului, ei mi-au oferit sa transforme suma de bani pe care am platit-o pentru bilet intr-un credit la ei (mai putin 5 euro taxa de administrare), pe care sa il pot folosi pina pe 1 Octombrie, altfel pierdeam banii. Atunci nu stiam de legea de mai sus, si am acceptat deschiderea creditului asta, ca fiind singura solutie. Al doilea bilet anulat a fost anuntat cu mai putin de o saptamana inainte de zbor, si mi-au propus sa ma schimbe intr-un alt zbor cu o zi dupa data initiala, la aceleasi ore. Spre norocul meu, tot in acelasi email, cu litere mici, eram anuntata si de legea de mai sus, si de posibilitatea de a le face reclamatie la Italian Civil Aviation Authority http://www.enacitalia.it/ (formularul de reclamatiei pentru nerespectarii legii 261/2004 e la http://195.103.234.163/applicazioni/...modulo_261.asp). Bineinteles in emailul lor imi propuneau ori sa accept aschimbarea zborului, ori sa imi transforme banii in credit (la fel, fara 5 euro). Ca un rezumat al situatiei, eu am platit un bilet dus-intors. Myair mi-a anulat ambele zboruri, si imi imi propuneau sa transforme banii respectivi, mai putin 10 euro, intr-un credit pe care puteam sa il folosesc intr-o perioada limitata. Cum situatia mi se parea total anormala, m-am apucat sa studiez legea, am descoperit ca ei nu ma informasera de toate drepturile mele, si leam cerut sa imi dea banii inapoi, conform articolului 8 (si art 5, 1a). Dupa nenumarate emailuri, amenintari ca ii reclam, in final mi-au scris ca imi tranfera banii pe ambele bilete (deocamdata nu s-a intimplat asta, dar mai astept vre-o saptamana). Citeva dintre reguli sint mentionate si pe situl lor: http://www.myair.com/docs/cust/en/avvisoCE-en.pdf O alta chestie interesanta in legea de mai sus e articolul 5 1.c. dreptul la compensatie de 250-600 euro (in functie de distanta zborului). Acesta se aplica in conditiile in care compania te anunta de anularea zborului cu mai putin de una-doua saptamana inainte, sau iti ofera o alta varianta de a zbura cu decolarea mai mult de doua ore inainte, sau aterizarea la destinatie cu mai mult de doua ore dupa ora prevazuta initial (cititi cu atentie Art 5 1.c i, ii, iii). Bineinteles ca am cerut companiei Myair sa imi dea bani pentru compensatie (email: customercare@myair.com), deocamdata nu am primit nici un raspuns de la ei, dar trebuie sa astept 6 saptamani sa primesc un raspuns oficial la cererea mea. Daca nu primesc nici un raspuns sau mi se da un raspuns nesatisfacator, am dreptul sa ii reclam la enac (linkul e mai sus). Sper sa aveti zboruri placute, fara anulari sau intirzieri. Dar daca vi se intimpla sa aveti neplaceri in legatura cu asta, sinteti indreptatiti sa va cereti drepturile. Toate cele bune!
