Jerusalem, July 31 - Joseph Zernik, PhD, of Human Rights Alert (NGO), has filed a request with State Comptroller and Ombudsman Justice Micha Lindenstrauss and Attorney General Yehudah Weinstein for criminal investigation of Supreme Court Justice Yoram Danziger and Clerk Guy Shani, relative to their conduct in the appeal of Moshe Katzav v State of Israel. Alleged Perversion/Obstruction of Justice through the online publication of a simulated order to postpone the prison sentence of Moshe Katzav

The request pertains to conduct of Justice Yoram Danziger and Clerk Guy Shani in the Appeal of Moshe Katzav v State of Israel and the online publication of an alleged simulated order to postpone the prison sentence of the former president. [2] The request followed the publication of news of pending decision by office of the Attorney General relative to interrogation of Justice Danziger under caution in an unrelated matter. [3]
State Ombudsman was previously asked to audit the same matter

On July 27, 2011, Dr Zernik requested an audit by the State Ombudsman relative to the legality of the postponement of the execution of the prison sentence, as part of the Appeal in Moshe Katzav v State of Israel, [4] where: a) The Supreme Court denies access to valid records of decisions of the Court, and b) The Ministry of Justice has failed so far to produce copies of relevant Court decisions, as served on the Prosecution, which were requested pursuant to the Freedom of Information Act. The concerns, as stated in the request, pertaining in this matter are that: a) While an unsigned order was published online by the Supreme Court, there is no

direct evidence that a valid, signed and certified order in this matter has been entered and served by the Court, and
b) The Ministry of Justice has failed to execute the sentence of the Tel Aviv District Court with no valid legal authority. The office of the State Comptroller and the Attorney General have been asked to consider the requests as part of the dialogue with authorities of the State of Israel, which is required as part of the protocol of the Universal Periodic Review (UPR) of Human Rights in Israel by the Human Rights Council of the United Nations. The next UPR of Human Rights in Israel is scheduled for 2012. Both offices have also been asked to provide a response within 30 days.
The matter to be presented in the 16th World Criminology Congress in Kobe, Japan

The conduct of the Supreme Court of the State of Israel in the matter of Moshe Katzav v State of Israel is also part of the presentation of Dr Zernik in the 16th World Criminology Congress, opening next week in Kobe, Japan. [5] Dr Zernik claims that conditions, which have emerged in the courts of the State of Israel, following implementation of invalid electronic record systems in the courts pose a serious risk to both Human Rights and Banking Regulation. _______
