Cn c vo hi n php n c C ng ho x h i ch ngha Vi t Nam nm 1992 c s a i, b sung theo Ngh quy t s 51/2001/QH 10 ngy 25 thng 12 nm 2001 c a qu c i kho X, k h p th 10; Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under resolution No.51/2001/QH of December 25, 2001 of the 10th session of the 10th National Assembly; Lu t ny quy nh v b o hi m x h i. This Law provides for social insurance. CHNG I CHAPTER I NH NG QUY NH CHUNG GENERAL PROVISIONS

i u 1. Ph m vi i u ch nh Article 1. Regulation scope 1. Lu t ny quy nh v ch , chnh sch b o hi m x h i; quy n v trch nhi m c a ng i lao ng, t ch c, c nhn tham gia b o hi m x h i; t ch c b o hi m x h i; qu b o hi m x h i; th t c th c hi n b o hi m x h i v qu n l nh n c v b o hi m x h i. 1. This Law provides for social insurance regimes and policies; rights and obligations of employees, organizations, individuals; social insurance organizations; social insurance funds; procedures for implementing social insurance and state management of social insurance. 2. Thia Law does not apply to social health insurance, credit insurance and types of business insurance. i u 2. i t ng p d ng Article 2. Subjects of application 1. Employees entitled to participate in compulsory social insurance are Vietnamese citizens, including: a) Ng i lm vi c theo h p ng lao ng khng xc nh th i h n, h p ng lao ng c th i h n t 3 thng tr ln; a) Employees working under contracts of indefinite term or contracts of a term of three months and/or over; b) Cn b , cng ch c, vin ch c; b) Cadres, public servants;

Ng i s d ng lao ng tham gia b o hi m x h i b t bu c bao g m c quan nh n c, n v s nghi p, n v v trang nhn dn; t ch c chnh tr , t ch c chnh tr - x h i, t ch c chnh tr x h i - ngh nghi p, t ch c x h i - ngh nghi p, t ch c x h i khc; c quan, t ch c n c ngoi, t ch c qu c t ho t ng trn lnh th Vi t Nam; doanh nghi p, h p tc x, h kinh doanh c th , t h p tc, t ch c khc v c nhn c thu m n, s d ng v tr cng cho ng i lao ng. 2. Employers participating in compulsory social insurance include state bodies, state units, securitiy services; political organizations, social-political organizations, social-political-professional organizations, social-professional organizations, other social organizations; foreign agencies and organizations, international organizations operating in the Vietnamese land; entrepreneurs, cooperatives, business individuals, cooperative groups, other organizations and individuals hiring, employing and paying wages to employees. 3. Employees participating in Unemployment insurance are Vietnamese citizens working under labour contracts or working contracts of indefinite term or a term of between full twelve months and thirty six months for employers specified at Clause 4 of this Article. 4. Employers participating in Unemployment insurance are employers specified at Clause 2 of this Article who employ ten and over employees.

Agencies, organizations and individuals related to Social insurance. Employees participating in compulsory social insurance, employees participating in Unemployment insurance and persons participating in voluntary social insurance are hereinafter referred to as employees. i u 3. Gi i thch t ng Article 3. Difinitions Trong Lu t ny, cc t ng d i y c hi u nh sau: In this Law, the following terms shall be construed as follows: 1. Social insurance means the guarantee to fully or partially offset a employees income that is lost or reduced due to his/her sickness, maternity, work-injured, occupational disease, unemployment, retirement or death, on his/her contributions to the social insurance fund. 2. Compulsory social insurance means a form of social insurance in which employees and employers must participate. 3. Voluntary social insurance means a form of social insurance in which employees voluntarily participate, may select contribution rates and modes of payment suitable to his/her income in order to enjoy social insurance benefits. 4. Unemployed person means a person who had paid unemployment insurance premiums then has lost his/her job or terminated his/her labour/working contract and has not yet found a job. 5. Duration of social insurance cotribution means a duration counting from the time a employee starts paying social insurance premiums to the time he/she stops the payment thereof. When an employee pays social insurance premiums in discontinuity durations, the duration of social insurance cotribution is the total time paying social insurance premium. 6. Relative means an insured's child, wife or husband, native parents, parents-inlaw or whom the insured is obliged to nurture. i u 4. Cc ch b o hi m x h i Article 4. Social insurance benefits 1. Compulsory social insurance scheme covers the following benefits: a) m au; a) Sickness benefit; b) Thai s n; b) Maternity benefit; c) Tai n n lao ng, b nh ngh nghi p; c) Work-injured benefit, Occupational disease benefit; d) Hu tr; d) Old-age benefit; ) T tu t. ) Survivor benefit. 2. b) Aid for apprenticeship; c) H tr tm vi c lm. c) Aid for job seeking. i u 5. Nguyn t c b o hi m x h i Article 5. Social insurance principles 1. M c h ng b o hi m x h i c tnh trn c s m c ng, th i gian ng b o hi m x h i v c chia s gi a nh ng ng i tham gia b o hi m x h i. 1. Social insurance benefits shall be calculated on the contribution, the duration of social insurance contribution and the sharing among the insureds. 2. M c ng b o hi m x h i b t bu c, b o hi m th t nghi p c tnh trn c s ti n lng, ti n cng c a ng i lao ng. M c ng b o hi m x h i t nguy n c tnh trn c s m c thu nh p do ng i lao ng l a ch n nhng m c thu nh p ny khng th p hn m c lng t i thi u chung. 2. The contribution of compulsory social insurance or unemployment insurance shall be calculated on the employees salary or remuneration. The contribution of voluntary social insurance shall be calculated on selected contribution by employees, which, must be at least equivalent to the common minimum salary. 3. Employees paying both compulsory and voluntary social insurance premiums are entitled to the old-age benefit and survivor benefit on his/her duration of contribution. 4. The social insurance fund shall be managed in a uniform, democratic, open and transparent manner, be used for proper purposes and be independently accounted according to the component funds of compulsory social insurance, voluntary social insurance and unemployment insurance. 5. Social insurance shall be implemented in a simple, easy and convenient manner, promptly and adequately ensuring the benefits of the insureds. i u 6. The State shall encourage and create conditions for agencies, organizations and individuals to participate in Social insurance.

The State shall adopt preferential policies of investment in the social insurance fund and other necessary measures to preserve and develop the fund. To promulgate, organize the implementation of legal documents on Social insurance. 3. Tuyn truy n, ph bi n ch , chnh sch, php lu t v b o hi m x h i. 3. To propagate and disseminate Social insurance benefits, policies and law. 4. Th c hi n cng tc th ng k, thng tin v b o hi m x h i. 4. To perform statistical and information work on Social insurance. 5. T ch c b my th c hi n b o hi m x h i; o t o, b i d ng ngu n nhn l c lm cng tc b o hi m x h i. 5. To organize the social insurance-implementing apparatus; to train human resources for social insurance work. 6. Thanh tra, ki m tra vi c ch p hnh php lu t v b o hi m x h i; gi i quy t khi u n i, t co v x l vi ph m php lu t v b o hi m x h i. 6. To inspect and check the observance of law on social insurance; to settle complaints and denunciations about, and handle violations of the law on, social insurance. 7. State management agencies in charge of social insurance 1. Chnh ph th ng nh t qu n l nh n c v b o hi m x h i. 1. The Government shall perform the uniform state management of social insurance. 2. 2. The Ministry of Labor, Invalids and Social Affairs shall take responsibility before the Government for performing the state management of social insurance. 3. Ministries, ministerial-level agencies shall, within the ambit of their respective tasks and powers, perform the state management of social insurance. 4. People's Committees at all levels shall perform the state management of social insurance within their respective localities under the Government's decentralization. i u 9. Hi n i ho qu n l b o hi m x h i Article 9. Modernization of social insurance management 1. The State shall encourage investment in development of technologies and advanced technical equipment in order to ensure the application of modern social insurance management methods. 2. Thanh tra b o hi m x h i Article 10. Social insurance inspectorate 1.Thanh tra lao ng - thng binh v x h i th c hi n ch c nng thanh tra chuyn ngnh v b o hi m x h i. 1. The labor, invalid and social affairs inspectorate shall perform the functions of specialized inspection in social insurance. 2.T ch c, nhi m v , quy n h n c a thanh tra chuyn ngnh v b o hi m x h i c th c hi n theo quy nh c a php lu t v thanh tra. 2. The organization, duties and powers of the specialized social insurance inspectorate shall comply with the provisions of law on inspection. i u 11. Quy n v trch nhi m c a t ch c cng on Article 11. Trade union organizations have the following rights: a) B o v quy n v l i ch h p php c a ng i lao ng tham gia b o hi m x h i; a) To protect the legitimate rights and interests of employees participating in social insurance;

Trade union organizations have the following responsibilities: a) Tuyn truy n, ph bi n ch , chnh sch, php lu t v b o hi m x h i i v i ng i lao ng; a) To propagate and disseminate social insurance benefits, policies and law to employees; b) Ki n ngh , tham gia xy d ng, s a i, b sung ch , chnh sch, php lu t v b o hi m x h i; b) To propose, participate in the elaboration, amendment and supplementation of social insurance benefits, policies and law; c) Tham gia ki m tra, gim st vi c thi hnh php lu t v b o hi m x h i. c) To participate in inspecting and supervising the implementation of the law on social insurance. i u 12. b) To propose, participate in the elaboration, amendment and/or supplementation of social insurance benefits, policies and law; c) Tham gia ki m tra, gim st vi c thi hnh php lu t v b o hi m x h i. c) To participate in inspecting and supervising the implementation of the law on social insurance. i u 13. Ch bo co, ki m ton Article 13. Reporting and auditing regimes 1. H ng nm Chnh ph bo co Qu c h i v qu n l v s d ng qu b o hi m x h i. 1. Periodic of three years, the State audit office shall audit the Social insurance fund and report on the results to the National Assembly. In case of necessity, at the request of, the National Assembly, the National Assembly Standing Committee or the Government, the Social insurance fund shall be audited unexpectedly. i u 14. Using the social insurance fund for improper purposes. 4. Gy phi n h, tr ng i, lm thi t h i n quy n v l i ch h p php c a ng i lao ng, ng i s d ng lao ng. 4. Causing troubles or obstacles to employees or employers, harming their legitimate rights and interests. 5. Bo co sai s th t, cung c p sai l ch thng tin, s li u v b o hi m x h i. 5. Making false reports, supplying false information, data on social insurance. CHNG II CHAPTER II i u 15. QUY N, TRCH NHI M C A NG I LAO NG, NG I S D NG LAO NG, T CH C B O HI M X H I RIGHTS AND RESPONSIBILITIES OF EMPLOYEES, EMPLOYERS, SOCIAL INSURANCE ORGANIZATIONS ng

Article 15. Rights of employees Ng i lao ng c cc quy n sau y: Employees have the following rights: 1. c c p s b o hi m x h i; 1. To be granted Social insurance books; 2. Nh n s b o hi m x h i khi khng cn lm vi c; 2. To receive Social insurance books when leave from work; 3. Nh n lng hu v tr c p b o hi m x h i y , k p th i; 3. To receive old-age pensions and social insurance allowances fully and in time; 4. H ng b o hi m y t trong cc tr ng h p sau y: 4. To enjoy Social health insurance benefit in the following cases: a) ang h ng lng hu; a) Enjoying old-age pensions; b) Ngh vi c h ng tr c p tai n n lao ng, b nh ngh nghi p h ng thng; b/ Being on leave and enjoying work-injured or occupational disease pension; c) ang h ng tr c p th t nghi p; c/ Enjoying unemployment allowance; 5. U quy n cho ng i khc nh n lng hu, tr c p b o hi m x h i; 5. To authorize other persons to receive their old-age pension or social insurance allowance. 6. Yu c u ng i s d ng lao ng cung c p thng tin quy nh t i i m h kho n 1 i u 18; yu c u t ch c b o hi m x h i cung c p thng tin quy nh t i kho n 11 i u 20 c a Lu t ny; 6. To request employers supplying information specified at Point h, Clause 1, Article 18; to request social insurance organizations supplying information specified at Clause 11, Article 20 of this Law; 7. Khi u n i, t co v b o hi m x h i; 7. To lodge complaints or denunciations about social insurance; 8. Cc quy n khc theo quy nh c a php lu t. 8. Other rights provided for by law. i u 16. Employees have the following responsibilities: a) ng b o hi m x h i theo quy nh c a Lu t ny; a) To pay social insurance premiums according to the provisions of this Law; b) Th c hi n quy nh v vi c l p h s b o hi m x h i; b) To implement regulations on compilation of social insurance dossiers; c) B o qu n s b o hi m x h i theo ng quy nh; c) To preserve Social insurance books according to regulations;

Apart from the responsibilities specified at Clause 1 of this Article, employees covering by unemployment insurance also have the following responsibilities: a) ng k th t nghi p v i t ch c b o hi m x h i; a) To register their unemployment with the Social insurance organization; b) Thng bo h ng thng v i t ch c b o hi m x h i v vi c tm ki m vi c lm trong th i gian h ng tr c p th t nghi p; b) To inform the job seeking situation monthly to Social insurance organization during the period of enjoying unemployment allowance; c) Nh n vi c lm ho c tham gia kho h c ngh ph h p khi t ch c b o hi m x h i gi i thi u. c) To accept jobs or participate in appropriate job-training courses recommended by the social insurance organization. i u 17. The period for enjoying the benefit in a year upon taking care of sick child shall be calculated according to the maximum number of days and be twenty working days if the sick child is under three years old, or fifteen working days if the sick child is between full three years old and under seven years old. 2. Employees suffering from a work-injured or occupational disease which damages the function of body shall be provided for a daily-life aid equipment and/or orthopedic devices, depending on the status of their injury or sickness. i u 46. The old-age pension for employees specified at Article 50 of this Law is equivalent to 45% of the average monthly contribution specified at Articles 58, 59, 60 of this Law, corresponding to fifteen years of social insurance contribution, then added by 2% for men or 3% for women for each additional year of the contribution; the maximum rate is equivalent to 75%. 2. The old-age pension is equivalent to 45% of the average monthly contribution specified at Article 76 of this Law corresponding to fifteen years of contribution, then added by 2% for men or 3% for women for each additional year of contribution; the maximum rate is equivalent to 75%. 2. When employers meet with difficulties and have to halt the production, business or meet with difficulties due to natural disasters, crop failure, which lead employees and employers to incapable contribution into the Old-age and survivor fund, have the halting of contribution with no more than twelve months. 2. Employees who are subjected to salary regime set by the State, the social insurance contribution shall be based on their rank, grade salaries, or military rank salaries and position allowances, extra-seniority allowances or professional seniority allowances (if any). Employees, Old-age pensioners or Social insurance pensioners, insureds who are reserving their duration of social insurance contribution and other persons are entitled to complain about employers or social insurance organizations decisions or acts when having grounds to believe that the social insurance law, their respective legitimate rights and interests have been contravened by such decisions or acts. 2. Employers violations specified at Article 134 of this Law with thirty days or more must, apart from paying the amounts not yet paid or paid late and being handled in accordance with law, so pay interests on the amounts not yet paid or paid late at the interest rate of the investment from the social insurance funds in the year. When an employer fails to comply with the provisions of this Clause, at the request of competent persons to impose administrative sanctions, the bank, credit institutions or state treasury shall deduct money from the deposit account of the employer to pay the amount not yet paid or paid late and the interest on such amount. Old-age pensioners, Work-capacity loss beneficiaries, Work-injured pensioners, Occupational disease pensioners, Survivor pensioners and Pensioners social insurance benefits are suspended due to their violations against legislation before this Law takes effect shall still comply with the previous regulations and are entitled to the adjustment of the enjoyment levels in accordance with law. 3. Old-age pensioners, Work-capacity loss beneficiaries, Work-injured pensioners, Occupational disease pensioners, before this Law takes effect shall, upon their death, enjoy the survivors benefits specified at this Law. 4. Annually, the State shall transfer an amount from the budget into the compulsory social insurance fund to ensure full payment of Old-age pension and Social insurance allowances to Old-age pensioners and Social insurance beneficiaries before January 1, 1995; and payment of social insurance premiums for the working duration before January 1, 1995, for those specified in Clause 4 of this Article. 6. The Government shall provide in detail and guidlines the implementation of this Law Lu t ny c Qu c h i n c Cng ho x h i ch ngha Vi t Nam kho XI, k h p th 9 thng qua ngy 29 thng 6 nm 2006. This Law was passed on June 29, 2006, by the 9th meeting of XIth National Assembly of the Socialist Republic of Vietnam.
