The individual (clone signer, or robo-signer) in my case, Laura HESCOTT, was even named in other cases as being a person whose averments and/or signatures were so suspect they should be accorded no respect whatsoever. I provided the court numerous other documents, both assignments of mortgage and affidavits of merit, Ms. HESCOTT had provided or executed in numerous other cases. I provided the court her real employer, Fidelity National Information Services (since spun off into Lender Processing Services), its address in Mendota Heights, Minnesota, as well as the telephone number and her extension. I also pointed out the discrepencies in the signature of the notary, Matthew Allan BANASZEWSKI, of which I also had numerous examples. The signatures looked neither similar nor alike. The same is true of other notary signatures being used by Fidelity, LPS, and the most recent player DOCX. I was among a small number of borrower/defendants that were presenting this information back in 2008. It does seem to have hit the big time recently, but I have seen nothing to indicate any courts are concerned, or are ruling in accordance with the facts, the evidence or the law. It brings up the term court of competent jurisdiction and causes me to wonder if we have any of those anymore. Still the court ruled against me. Two years on and the number of foreclosures, AND foreclosures involving fraudulent, fabricated and forged documents that do not memorialize any transaction that ever actually took place, continues to increase. Beyond my own potential losses (though the court ruled granting summary judgment to Plaintiff in 2008, I have filed a very strong Appeal, and also have a post judgment motion in the circuit court presently) I truly fear for our country. The impact of this massive fraud (there are many more layers to it than illegal and unlawful foreclosures) will be felt for decades to come.
