These applications vary in length between about 1,300 pages to over 2,000 pages and contain thorough descriptions of the technical and financial information for construction of Vogtle Units 3 & 4. Unfortunately, nearly all of this pertinent information is withheld in a series of sweeping redactions. In some places, these long stretches of redactions span 200 pages. DOE claims FOIAs trade secrets and deliberative process exemptions to justify these redactions, though it does not indicate which particular exemption applies to each redaction. Also among the Application Documents is a thirty-page Environmental Critique. DOE performed this assessment in accordance with NEPA procedures, citing 10 C.F.R. 1021.216(g), to support the selection process for the loan guarantee program. The final document included in the Application Documents is the Nuclear Application Criteria, a document that defines the three major criteria for loan guarantee approval (creditworthiness; construction and start up factors; and legal, regulatory, and permitting factors) in terms of measurable attributes. Neither the Environmental Critique nor Nuclear Application Criteria contain many redactions.
