Petitioner has filed B.A No. 93/2011 seeking admission to bail pending investigation in FIR No. 19/2011 registered at Police Station, Women Cell, Canal Road, Jammu under sections 498-A, 406, 420, , 120-B/ 109 RPC. The criminal litigation between the petitioner and the complainant having arisen out of their matrimonial dispute, Sh, V.R. Wazir, a senior Advocate of this Court was, therefore, requested by the Court to explore the possibility of amicable settlement the petitioner and the complainant. During the pendency of the Petition, the Police has filed the Final Police Report in the Court of Judicial Magistrate 1st Class (Forest Cases), Jammu. The Petitioner is stated in custody for the last 42 days. Keeping in view the nature of allegations appearing against the petitioner in the Final Report and taking note or the fast that criminal proceedings have emanated out of the matrimonial dispute between the parties, it is considered appropriate to admit the petitioner, who is a B Grade Surgeon Specialist posted in Sub District Hospital, Darhal, to interim Bail, till next date, so that negotiation for settlement of the dispute was attempted in a free and congenial atmosphere. According, allowing Cr. M.P. No. 30/2011, the petitioner is admitted to interim bail, till next date and ordered to be released from custody on his furnishing personal recognizance and recognizance of a surety in the amount of Rs. 20, 000/- to satisfaction of Registrar Judicial of the Court. The petitioner to appear in the Court when the petition comes up next for further consideration. List on November 01- 2011.
