THE INDIAN CONTRACT ACT,1872.

NOTES: SECTION 37:OBLIGATION TO CONRACTS :Parties to contract must perform their respective promise unless excused by the indian contract act or any such law. Sec 38: EFFECT OF REFUSAL TO ACCEPT OFFER OF PERFORMANCE: When promisor has made an offer to the promisee for any kind of a contact ,and when the promiseshas not accepted the offer then the promisee is not bound by that offer.,hence he is not responsible for non performance,nor does he lose his rights under this contract. Any such offer must fulfil the following conditions: 1)it must be unconditional. 2)must be made at aproper time and placeso that the promisee has reasonable oppurtunity to check that the promisor is acapable to deliver his promise. 3)promisee is given reasonable time to check the goods.
