Judge Theodor Meron I was informed, as legal adviser to Professor Vojislav [e{elj in cases no. IT03-67 and no. IT-03-67-R77.3, of a (repeated) violation of the human and procedural rights of Professor Vojislav [e{elj. Although Professor Vojislav [e{elj has the right to receive visits by his legal advisers Dejan Mirovi} and Boris Aleksi}, as well as his case manager Nemanja [arovi}, it has been clear following a letter/report by Jamie Campbell of the ICTY Registry that even this is being thrown into doubt. That is, the visit to Professor Vojislav [e{elj already arranged for 16 and 17 February 2012 has been thrown into doubt. More precisely, the Registry of the ICTY has informed Professor Vojislav [e{elj that it will not cover travel and accommodation expenses, especially for case manager Nemanja [arovi}. That is, it will not enable the visit of the legal team consisting of Mirovi}, Aleksi} and [arovi} to take place as normal. I would like to remind you, Mr President of the Court, of the following facts: 1. The closing arguments in case no. IT-03-67 are due to be heard on 5 March 2012. 2. Appeal proceedings are in progress in case no. IT-03-67-R77.3. As legal adviser to Professor Vojislav [e{elj in cases no. IT-03-67 and no. IT03-67-R77.3, I hereby inform you that it is impossible to work normally on these cases if case manager Nemanja [arovi} is excluded by the Registry of the ICTY. Cases no. IT-03-67 and no. IT-03-67-R77.3 are closely linked, and you, as a lawyer and a judge with many years of experience at the ICTY, are certainly aware of this (a glance at the designations of these two cases is sufficient). I therefore request that you exercise your authority and the powers vested in you by the Rules of Procedure and Evidence of the ICTY, and allow Professor Vojislav [e{eljs defence case to be prepared as normal, in cases no. IT-03-67 and no. IT-0367-R77.3.
