We refer to our earlier letter requesting the release of the deposit and to your subsequent advices to us, that you took it upon yourselves to raise the matter of releasing the deposit with the purchasers representative and as a result of representations made by the purchaser to you over the telephone, you will now not release the deposit unless authorised by the purchaser to do so. We refer you to Section 27 (6) and (7) of the Sale of Land Act which state: Where the purchaser is not satisfied with the particulars he shall within 28 days of receiving them give notice in writing stating that he is not satisfied with the particulars and giving the reasons why he is not satisfied. Where the purchaser fails to give a notice under either sub-section (4) or (6) within the time limited by the sub-section he shall: be deemed to be satisfied with the particulars provided; and be deemed to have given authorisation required by sub-section (1).

We, within the 28 days, received no notice in writing whatsoever regarding the matter from the purchasers representative and understand that you also did not. Therefore, subsection (7) of the Act applies and we look to you to release the deposit without delay as provided for in the Act. Our client instructs that the money is required for other purposes and has asked us to give advice as to what remedies and rights our client may have in so far as loss and damages are concerned for failure to release the deposit.
