APPELLANT RAMBUS INC.S UNOPPOSED MOTION FOR A 14-DAY EXTENSION OF TIME TO FILE ITS OPENING BRIEF Pursuant to Federal Rule of Appellate Procedure 26(b) and this Courts Local Rule 26(b), Appellant Rambus Inc. respectfully moves for a 14-day extension of time to file its opening brief. The opening brief is currently due on August 24, 2012. If this motion is granted, the opening brief will be due on Friday, September 7. Appellant Rambus has not previously sought an extension. Undersigned counsel has informed the Appellees of the extension request. Appellees have indicated that they do not oppose the motion. The

The case involves an appeal from the U.S. Patent and Trademark Office, Board of Patent Appeals and Interferences (the Board), upholding the Examiners rejection on reexamination of all 25 claims of U.S. Patent No. 7,287,109, which is titled Method of Controlling a Memory Device Having a Memory Core and describes a type of memory device known as a DRAM. The appeal involves complex technological and legal issues, and the underlying patent reexamination record is over 16,900 pages. Counsel of record in this Court was not retained to represent Appellant Rambus until after the reexamination was complete and the Board had issued its final Decision on Rehearing. The additional time is necessary for counsel of record to further familiarize himself with the legal and factual issues raised by this case, and because counsel has been heavily engaged with the press of other matters. Accordingly, Appellant Rambus respectfully requests a 14-day extension of time to file its opening brief, to and including Friday, September 7, 2012.
