Maiocco called the Twenty-Ninth Regular Meeting of the Medford City Council to order at 7:00 P.M at the Howard F. Alden Memorial Auditorium, Medford City Hall.

MOTIONS, ORDERS AND RESOLUTIONS 12-598-Offered by Councillor Penta Be it Resolved since the City Council has approved over 10 million dollars for the long over due and much needed improvements at Medford High for which the City Administration had let fall into a state of neglect for many years, the council be apprised to the higher issue of public safety as to police radios, fire department radio and other communications and a review of the 911 system that is presently operating in the interest of our entire City population rather than the singular issues that have been proffered by the City Administration.

12-559 A Revised per Bond Counsel To: The President and Members of the Medford City Council

From: Michael J. McGlynn, Mayor Re: Loan Order-School Labs

Dear Mr. President and City Councilors: I respectfully request and recommend that your Honorable Body approve the following Loan Order: CITY OF MEDFORD, MASSACHUSETTS LOAN ORDER (Medford High School Science Lab Project Construction) BE IT ORDERED: That the City of Medford appropriates $13,809,000 for the purpose of paying costs of design and construction in connection with the development of new science labs at Medford High School, located at 489 Winthrop Street, Medford, including the payment of all owners project manager costs, design costs, construction costs, and all other costs incidental or related thereto (the Project), which facility shall have an anticipated useful life as an educational facility for the instruction of school children of at least 50 years, and for which the City of Medford may be eligible for a grant from the Massachusetts School Building Authority (MSBA), said amount to be expended under the direction of the School Building Committee. To meet this appropriation the Treasurer, with the approval of the Mayor, is authorized to borrow said amount under and pursuant to M.G.L. Chapter 44, or pursuant to any other enabling authority. The City of Medford acknowledges that the MSBAs grant program is a non-entitlement, discretionary program based on need, as determined by the MSBA, and any costs the City of Medford incurs in excess of any grant approved 2

by and received from the MSBA shall be the sole responsibility of the City of Medford; provided further that any grant that the City of Medford may receive from the MSBA for the Project shall not exceed the lesser of (i) Fifty-nine and 16/100 percent (59.16%) of eligible approved project costs, as determined by the MSBA, or (ii) the total maximum grant amount determined by the MSBA, and that the amount of borrowing authorized pursuant to this vote shall be reduced by any grant amount set forth in the Project Funding Agreement that may be executed between the City and the MSBA.

AND FURTHER ORDERED: That the City Treasurer is authorized to file an application with The Commonwealth of Massachusetts Municipal Finance Oversight Board to qualify under Chapter 44A of the General Laws any and all bonds or notes of the City authorized by this vote or pursuant to any prior vote of the City, and in connection therewith, to provide such information and execute such documents as the Municipal Finance Oversight Board of The Commonwealth of Massachusetts may require.
