CALL TO ORDER The meeting was called to order by the OIC Assistant Director, in concurrent capacity as Chief Legal Division, Atty. Emelyne V. Talabis. There having a quorum the meeting ensued exactly at 1:00 PM.

DISCUSSIONS / AGREEMENTS DURING THE MEETING PROPER 1. Lifting of Suspension on the Processing of Friar Land Applications

There were a number of letter requests for the early lifting of suspension on the processing of Application on Friar Lands, from different individuals and cooperatives to the Undersecretary and Chief of Staff, Atty. Analiza RebueltaTeh. These were forwarded for action to the OIC Director for Land Management Bureau, Engr. Ralph C. Pablo and so, the creation of the LMB Special Team on Friar Lands tasked to evaluate friar land applications pursuant to the Memorandum of the Secretary dated January 31, 2012. The Chairman of the Policy Formulation Group (PFG), Mr. Ranier Balbuena, presented the report on the implementation of the Roadmap to rationalize policies on friar lands. This report covers the 23 estates located in six regions with a total friar lands area of 1,584,146,363. As a result of this inventory, around 25,040 deeds of conveyance have been accounted with an equivalent area of 694,519,592 sq. m. representing 42% of the total land area. Also included in this report, is the number of stale friar lands. It was recommended that the Policy Formulation Group (PFG) must come up with a step-by-step procedure with regard to the lifting of suspension and it must be on estate basis with recommendation on priority. Mr. Buenaventura Fabros raised the issue on how to reconstitute lost Original Certificate of Title (OCT). Atty. Fe Tuanda suggested that the presumption of judicial notice must be applied and the regional offices must not issue without Transfer Certificate of Title (TCT). Engr. Ariel Reyes also said to file a Mandamus. Atty. Emmanuel Genciana recommended that, out of the 23 estates, those which are not problematic must proceed first as well as, those which are finished with the inventory.

2. Revision of LMB/LMS Pro-forma Forms Atty. Emelyne V. Talabis asked the Land Administration and Utilization Division must submit a proposal together with the working documents regarding this subject so that this may be forwarded for review of the Policy Formulation (PFG) Group. The allotted timeframe for this must be within 1 week.

Recommendation of the Regional Executive Director, DENR - Region III re: Implementation of RA 10023

The request that Tax Declaration be regarded as an alternate document in the absence of zoning ordinance was denied since, as Atty. Emelyne V. Talabis reminded, the law provides that there must be a zoning ordinance.

Formulation of Policy Issuance/Guidelines in the Disposition of Foreshore Lands that had long Dried-up and Physically Ceased to be a Foreshore Area

Atty. Emelyne V. Talabis recommended that the tasking for this must be assigned to the members. The preparation of the proposal was assigned to Atty. Emmanuel Genciana, and the scope and coverage to Mr. Buenaventura Fabros. The definition of terms was designated to Ms. Carmelita A. Dayag and the creation of database to Mr. Ranier Balbuena and Ms. Irma Quirimit. It was also suggested that the guidelines must be simplified which must be based on the comment on the queries of DENR Region XI. Atty. Emmanuel Genciana proposed that the Policy Formulation Group (PFG) must simplify policy making and that they must introduce concise and direct to the point policies. Atty. Emelyne V. Talabis said that this must have a definite time frame. Then she returned this to the Policy Formulation Group and recommended that a simple memorandum circular may be enough. Engr. Ariel Reyes presented the proposed DENR Administrative Order (DAO) for the adoption of tabular format for technical description instead of narrative technical description because this type of format is easier to migrate. This was for further comment of the Policy Formulation Group. Atty. Emelyne V. Talabis commended the Geodetic Surveys Division for preparing the necessary working documents. 6. Atty. Emelyne V. Talabis tasked the Policy Formulation Group to review the timeframes on the processing of Sale and Lease Applications over public lands and the signing / approving and also, they should get a copy of the rates in land classification.

OTHER MATTERS A. Proposed DENR Memorandum Circular re: Amending Section 39, Art. 2 of DENR MC No. 2012-13 on the Specifications of Project Control Monuments

This was presented by Engr. Ariel Reyes. This proposed Memorandum Circular (MC) affects those highly urbanized areas wherein the control points have no recourse but to be located on concrete pavements which may pose danger to passing pedestrians. Thus, the Geodetic Surveys Division (GSD) proposed that the control points must be chiseled to the concrete pavements.

Amendment of composition of the Policy Formulation Group

As additional member, It was suggested and decided that Engr. Ariel Reyes form part of the Policy Formulation Group as a representative of the Geodetic Surveys Division.
