NOTICE OF FINAL HEARING PLEASE TAKE NOTICE that, on July 9, 2009, the above-captioned debtors and debtors in possession (collectively, the Debtors) filed the Motion of the Debtors for Interim and Final Orders: (I) Prohibiting Utilities from Interrupting Service and (II) Determining that the Debtors Provided Adequate Assurance of Payment (Docket No. 6); Motion of the Debtors for Interim and Final Orders Authorizing DIP Financing, Authorizing the Use of Cash Collateral, Granting Adequate Protection and Scheduling Interim and Final Hearing (Docket No. 13); Application by the Debtors for an Order Authorizing the Retention and Employment of Morrison and Foerster LLP as Section 327(e) Counsel to the Debtors Nunc Pro Tunc to the Petition Date (Docket No. 15); and that on July 10, 2009 the Debtors filed the Motion of the Debtors for Order (I) Approving Bidding Procedures in Connection with the Anticipated Sale of Substantially All of the Debtors Assets; (II) Scheduling Hearing to Consider Sale of Assets; (III) Approving Form and Manner of Notice; (IV) Approving Maximum Break-Up Fee; and (V) Granting Related Relief (Docket No. 19); Application Requesting Entry of an Order Under Sections 327(a), 328(a) and 329 of the Bankruptcy Code and Bankruptcy Rules 2014, 2016 and 5002 Authorizing

Employment and Retention of Pepper Hamilton LLP as Counsel for Debtors (Docket No. 20) (collectively, the Motions). PLEASE TAKE FURTHER NOTICE that on July 13, 2009, a hearing was held on the Motion of the Debtors for Interim and Final Orders: (I) Prohibiting Utilities from Interrupting Service and (II) Determining that the Debtors Provided Adequate Assurance of Payment (Docket No. 6) and Motion of the Debtors for Interim and Final Orders Authorizing DIP Financing, Authorizing the Use of Cash Collateral, Granting Adequate Protection and Scheduling Interim and Final Hearing (Docket No. 13) (collectively the First Day Motions). The Court granted the relief requested in the First Day Motions on an interim basis. The Court entered the Interim Order (I) Prohibiting Utilities from Interrupting Service and (II) Approving Procedure for Providing Adequate Assurance of Payment (Docket No. 34); and Interim Order (I) Approving Debtor-in-Possession Financing Pursuant to 11 U.S.C. 105(a), 362, and 364 and Fed. Bankr. P. 2002, 4001 and 9014 and Local Bankruptcy Rule 4001-2; (II) Authorizing Use of Cash Collateral Pursuant to 11 U.S.C. Sections 105, 361, 362 and 363 of The Bankruptcy Code; (III) Granting Adequate Protection and Superpriority Administrative Claims; (IV) Scheduling a Final Hearing; and (V) Granting Related Relief (Docket No. 40) (collectively, the Orders). PLEASE TAKE FURTHER NOTICE that objections to the Motions and Orders on a final basis must be filed so as to be received on or before July 14, 2009 at 4:00 p.m. (Eastern Time) (the Objection Deadline) with the United States Bankruptcy Court for the District of Delaware, 824 Market Street, 3rd Floor, Wilmington, Delaware 19801.
