Tucker, LLP ("Rutan") as Special Counsel to Debtors and Debtors in Possession for
Compensation for Services Rendered and Reimbursement of Expenses Incurred for the Period

October 1, 2009 through October 31, 2009 (Docket No. 1152) (the "Application") fied on
November 24,2009. The undersigned further certifies that he has reviewed the Court's docket in

this case and no answer, objection or other responsive pleading to the Application appears
thereon. Pursuant to the Notice of Application, objections to the Application were to be filed and

served no later than December 15,2009.

Pursuant to the Order Pursuant to Sections 105(a) and 331 of the Banptcy
Code Establishing Procedures for Interim Compensation and Reimbursement of Professionals,
