On May 27, 2010, the Court held a hearing on the emergency motion (the Motion) filed by Westcliff Medical Laboratories,
Inc. (Westcliff) and BioLabs, Inc. (BioLabs), the Chapter 11 debtors and debtors in possession herein (jointly, the
Debtors), seeking the entry of an order authorizing the Debtors to provide adequate assurance of payment to certain utility companies pursuant to Section 366(c) of the Bankruptcy Code.
Appearances were as set forth on the record. Having considered the Motion and the evidence submitted in support thereof, and the arguments of counsel made during the hearing, and having found notice to have been appropriate under the circumstances and the relief requested necessary to avoid immediate and irreparable harm, and for the reasons set forth on the record: THE COURT HEREBY ORDERS AS FOLLOWS: 1. 2. the Motion is granted in its entirety; the Debtors are authorized to provide adequate
assurance of payment to those entities listed in Exhibit 1 to the Motion (the Utility Companies) via cash deposits in the amounts set forth in Exhibit 1; 3. the cash deposits to be paid by the Debtors to the
Utility Companies in the amounts set forth in Exhibit 1 are hereby deemed to constitute adequate assurance of payment
