JOINT MOTION BY KZC SERVICES, LLC AND THE C&A POST-CONSUMMATION TRUST FOR POSTPONEMENT OF PRETRIAL HEARING AND TRIAL OF KZC SERVICES FINAL FEE APPLICATION NOW COMES KZC Services, LLC (KZC) and the C&A Post-Consummation Trust (the Trust), jointly, requesting the Court to Postpone the Pre-Trial Conference and Trial with regard to the KZC Services, LLCs Final Fee Application, which is the subject of an objection filed by the Trust.. KZC and the Trust state in support of this Motion as follows: 1. On January 30, 2008, the Court entered a scheduling order (Docket 8821), which sets forth dates for a final pretrial conference on April 7, 2008 at 3:30 p.m. and a trial on April 22, 2008 at 9:30 a.m. 2. As set forth in detail on KZCs Motion to Compel C&A Post-Consummation Trust to Fully Respond to First Set of Requests for Production of Documents of KZC Services, LLC and John Boken (Docket 8929), the parties have worked productively, cooperatively and diligently to agree on the scope of discovery by KZC. There are a few remaining issues on which the parties are seeking the Courts direction. 3. The parties have already agreed on who will be deposed, but the depositions cannot commence prior to the production of documents and an opportunity to review them.

4. For these reasons, the parties believe that it would be appropriate and beneficial to the parties, in order to fully prepared at trial to efficiently present their positions to the Court, to reschedule the pretrial conference and the trial for approximately sixty (60) days. 5.
