TIMOTHY LEULIETTES SUPPLEMENTAL RESPONSE TO COLLINS & AIKMAN LITIGATION TRUSTS SIXTY-EIGHTH OMNIBUS OBJECTION TO CLAIMS (INSUFFICIENT BOOKS AND RECORDS) 1. On or around July 30, 2008, The Collins & Aikman Litigation Trust (C&A

Trust) filed its Sixty-Eighth Omnibus Objection to claims, including claim Nos. 5250 and 4653, (the Objection). 2. The claims register states that Claim No. 5250 was filed on behalf of Timothy

Leuliette along with other former directors of Collins & Aikman seeking indemnity pursuant to Collins & Aikmans bylaws, Delaware corporate law, and under a services agreement with Collins & Aikman. 3. On or around September 5, 2008, Leuliette filed a response to the Objection

specifically referring to Leuliettes claim No. 4653, but not to Claim No. 5250. 4. Claim No. 5250 should be allowed for the same reasons that claim No. 4653

should be allowed as stated in Leuliettes response to the Objection. Therefore, Leuliette hereby supplements his response to C&A Trusts Sixty-Eighth Omnibus Objection to specifically include Leuliettes interest in Claim No. 5250.

WHEREFORE, for the reasons stated in Leuliettes response to C&A Trusts SixtyEighth Omnibus Objection, Leuliette hereby requests C&A Trusts Objection be overruled and Claim No. 5250 be allowed to the extent of Leuliettes interest in the claim.
