Many are outraged by this continued coercion and corruption of Congress and do not believe Aquino should be allowed to get away with it. That could change the situation overnight.

think this is the end of Manny Pacquiao. I talked to him before he went to the hospital. He knows he made a mistake. He knows he got careless and walked into one. Roach believes that should Pacquiao continue fighting, he should take an easier fight first, before considering a fifth fight with Marquez, which the trainer also welcomed. If Manny comes into the gym and trains hard, sure I would welcome another fight, but it might be better to take an easier fight first, Roach said. For his part, Marquez said he had waited four-and-a-half months for this. I saw he was going to throw the 1-2 and I knocked him down, said Marquez. After he was dropped in the fifth round, Marquez added: I knew I had to be calm because he could knock me out with one punch. He caught me with a good punch. He was very quick, but I knew I could win. Ringside punching stats underscored the ferocity of the bout, showing Pacquiao landing 94 of 256 punches to 52 of 246 for Marquez. But it was the one big right hand from Marquez that counted more than anything, knocking Pacquiao out for the first time in a career that goes back 17 years. He (Pacquiao) was in charge, While House Speaker Feliciano Belmonte Jr. and House Majority Leader Neptali Gonzales II were bent on pushing for its passage, their Senate counterparts, Senate President Juan Ponce Enrile and Senate Majority Leader Vicente Sotto III were equally aggressive in blocking its passage, Palatino said. Palatino said he would not be surprised if Enrile and Sotto would elect themselves to be members of the bicameral conference committee to ensure a deadlock in reconciling the two versions. Enrile said even if his amendments had been carried, he would still vote no to the RH bill because he said he believed the measure was not meant to promote medical health care for women and children but to control the population. ACT Teachers Rep. Antonio Tinio and other authors disagreed with Palatino and said the House leadership and even the Cabinet members were in constant dialogue with the anti-RH camp and party leaders to support the bill. The President is not playing both sides. As far as we are concerned, his wish to have the bill approved had been made very clear, Tinio said. Without naming names, Tinio also said Cabinet members had been calling on both the pro- and anti-RH lawmakers, particularly the members of the ruling Liberal Party, to push for the passage of the bill. But Tinio admitted he would have preferred the President to have the bill certified as urgent to overcome the time constraints. Gonzales also called on the President to certify the bill as a Pacquiao did his best but Marquez turned out to be the better boxer, Army spokesman Arnulfo Burgos Jr. said. He said the entire military still supported Pacquiao, who holds the reserve rank of lieutenant colonel in the Army. We wish him the best in his future undertakings in the service of the Filipino people. Boxing fan Charlie Austria, 48, said Marquez looked well prepared against Pacquiao. efforts to churn out fabricated charges against activists, members of progressive organizations and unions, peace consultants and leaders of the revolutionary movement, and ordinary citizens, said Cristina Palabay, Karapatan secretary general. Such a dirty ploy is reminiscent of former President Arroyos tactics to silence the opposition during her rule. These are underhanded, malicious and desperate tactics that are direct attacks against the organizers and leaders and against the peoples right to organize, Palabay said. Karapatan said the trumped-up charges against Vegas and Camposano are the latest among the series of cases filed against rights defenders, peace consultants and ordinary individuals. The rights group said it has documented 467 victims of illegal arrests under the Aquino administration, with 127 political prisonRoach said. He just got a little too careless and got hit with a punch he didnt see. Pacquiao weighed the class limit of 147 pounds, but it was Marquez who looked like the stronger fighter entering the ring after having bulked up with the help of a strength conditioner, though he weighed in at 143 pounds. In their earlier fights, Pacquiao had been the bigger puncher, knocking Marquez down a total of four times, but on this night it was Marquez who had the biggest punch. The stunning knockout was the first real loss by Pacquiao in seven years. He lost a close decision to Bradley in his last fight, but most ringside observers believed he had won it fairly convincingly. Marquez improved to 55-6-1 with 40 knockouts, while Pacquiao fell to 54-5-2. Meanwhile, Pacquiaos mother Dionisia said she has accepted her sons loss after she watched the fight on a delayed basis. I didnt want him to abandon making the sign of the cross because thats what made him rich before and he won many fights, but he lost because Jesus Christ fought him, said Dionisia, a deeply religious Catholic, in Filipino. If I will just have my way, I want him to quit and concentrate on serving his people as a politician. With AP priority to save the three session days required between second and third reading. There were only five session days left, minus Mondays session, before Congress goes on Christmas recess on Dec. 21. As of Wednesday last week, the plenary was stuck discussing amendments to page 4 of the 27page RH bill. Albay Rep. Edcel Lagman, principal author of the RH bill, said he expected a few individual amendments to be tackled because the House leadership already consolidated the concerns raised by the anti-RH lawmakers that had been incorporated in the plenaryapproved substitute bill. On Sunday, the Catholic bishops stepped up their campaign against the RH bill and lobbied Congress to junk the bill because it promotes promiscuity, extramarital affairs and threatens the unborn child. They asked the lawmakers to vote No or abstain from voting. Some of them even texted Akbayan Rep. Arlene Kaka Bag-ao, a vocal author of the bill. Hon. Bag-ao, we pray you vote Yes to life, yes to God as author of life in all its stages from the womb to the tomb in natural conception. Please vote in conscience and not allow a dictator to impose his will on us, against our Catholic values, our Godfearing families and nation. Please vote No to RH bill, or Abstain. It is a very great poverty to decide than an unborn child, a fetus, must die that you might live as you wish, the text said. Earlier, the bishops also organized a text campaign to bolster the ranks of the anti-RH lawmakers. Now Marquez can retire, and Pacquiao should start a new career, he said. Pacquiaos mother Dionisia said she had accepted her sons loss but blamed his change of religion for it. I didnt want him to abandon making the sign of the cross because thats what made him rich before and he won many fights, but he lost because Jesus Christ fought him, Dionisia said. I want him to quit and conceners arrested and detained also under Aquinos two and a half years. The labor and human rights movements support to PALEA will never end until the walls of Jericho, which were preventing their reinstatement crumble, said Partido ng Manggagawa chairman and one of Nagkaisa convenors Renato Magtubo. Aside from labor, the human rights community lead by the Philippine Alliance of Human Rights Advocates is joining the protest. As Pacquiao was out cold lying flat on his face, Top Rank promoter Bob Arum, who was celebrating his 81st birthday, had to rush to Pacquiaos wife Jinkee, who was near hysterical after seeing her husband motionless on the canvas. Pacquiao was immediately rushed to the hospital for the routine medical check up, which Arum said would include a CAT Scan, because the Filipino ring icon appeared to have suffered a concussion. The brutal nature of the fight was also evidenced by the fact that Marquez also suffered a concussion besides a broken nose. Pacquiao, who had abandoned his strength and conditioning regimen under Alex Ariza, which Marquez adopted during his fourth months of training under conditioning coach Angel Heredia, appeared to have a bigger, muscular and stronger upper body. Pacquiao, however, still demonstrated his hand-speed, quick in-and-out movements, accurate punches and his old punching power, despite being dropped in the third round by an overhand right by Marquez. After taking the first two rounds, the third-round knock-
down evened the score, with Mexican fans who outnumbered the large contingent of Filipinos jumping to their feet. Pacquiao recovered well from the knockdown and stood toe-totoe with Marquez in the fourth round in an effort to try and even things out as they continued to go after each other at the bell. Pacquiao continued to connect with rapid-fire combinations, but Marquez found his counter-punching instincts and ended the round with a flurry of punches. For fight fans, who had followed their three previous fights, both men appeared to be at their best and looking for a definitive ending and taking the decision away from the hands of the three judges. It was an epic fifth round, with Pacquiao nailing Marquez with a right straight, followed by a cracking left that dropped the Mexican, whose glove touched the canvas, with referee Kenny Bayless correctly calling it a knockdown. Marquez retaliated with a big right hand, but he couldnt stall Pacquiao, who came charging back and hurt his foe again and went for the kill, with both fighters trading vicious punches with the Filipino getting the better of the exchanges. Pacquiao wrecked Marquezs nose and bloodied his face as he We are asking for immediate assistance from the government, said Roger Navarro, president of the Philippine Maize Federation. Navarro said the seeds would be used for quick turn-around planting to replace the damaged crop. His group sent feelers to the government after Pablo ravaged 30,000 hectares of farmland planted to corn and destroyed 210,000 metric tons of the crop. The Mindanao Banana Farmers and Exporters Association, meanwhile, is asking the government for P3.5 billion in assistance after Pablo devastated an estimated 13,230 hectares of banana plantations in Davao del Norte alone. A bigger group, the Pilipino Banana Growers and Exporters Association, said P11.61 billion would be needed to rehabilitate the 23,230 hectares of farmland planted to bananas wiped out by the typhoon and to help 93,000 displaced banana farm workers. The Japanese government has donated P22 million in assistance to the typhoon victims in the form of relief including tents, sleeping pads and plastic sheets. Japanese Prime Minister Yoshihiko Noda earlier sent his condolences to President Aquino. The Red Cross Society of China has donated $30,000 to its Philippine counterpart, while Washington has released $100,000 to help the typhoon victims. The United States Agency for International Development will be sending teams to asses which areas in the Philippines need more assistance. continued to connect with devastating combinations that had the Mexican retreating early in the sixth. As Pacquiao sensed he had Marquez, where he wanted him, he appeared to step on the Mexicans foot and missed with a 1-2 combination. This was the opportune time Marquez was waiting for as he nailed him with a short, crunching right flush on the face, dropping Pacquiao flat on his face and was counted out, as doctors rushed to attend to him. At the time of the knockout, Pacquiao was leading on the scorecards of all three judges by one point, 47-46. I got overconfident and never expected that punch. He got in a good shot, thats boxing, said Pacquiao in a post-fight interview. Arum, who was by his side, said he expects that after a few months, Manny will get back to training and back to fight. Asked about a possible fifth fight, Arum said: Why not? The fight was a ring classic. Pacquiao himself said a fifth fight wouldnt be a problem, attributing his shocking knockout to being part of the game. between tobacco and alcohol, but some members of the bicameral conference committee want to increase tobaccos share to 70 percent. Enrile and Senator Ferdinand Marcos Jr. said the additional tax burden would hurt tobacco farmers and workers and their family members. He also warned those who supported the unreasonable hike in the excise tax on tobacco would hear from voters in the tobacco-producing North. Farmers from the countrys tobacco-producing provinces on Sunday vowed to make good their threat to campaign for the defeat of re-electionists who railroaded the approval of an excise tax that would effectively kill the local cigarette industry. The Philtobacco Growers Association said they will campaign not only on the streets but also online via the Internet and social networking sites to ensure that anti-farmer, anti-labor lawmakers get zero votes not only in the vote-rich provinces of Northern Luzon, but also in other regions in the country. Saturnino Distor, president of the 20,000 strong association, said re-electionists who ignored their appeal stand to lose 4.5 million votes from the major tobacco-producing provinces of Pangasinan, La Union, Ilocos Sur, Ilocos Norte, Abra, Cagayan, Isabela, and Mindoro. Distor noted that they will mobilize their forces in preparation for the campaign against lawmakers who voted to leave 2.5 million workers and dependents in the tobacco sector and its related industries jobless. They hit us with a 1,000 percent tax hike, we will hit them back on May 13, he said, referring to next years election. Distor said the PTGA and its allied organizations will campaign not only within the tobacco industry, but also among consumers already fed up with rising commodity prices. Our organization will brand senators who voted to kill the tobacco industry as members of the 1,000% Tax Hike Club, he said. Enrile and Marcos, both from the Ilocos, said they were protecting the interests of tobacco farmers in their home province. We are Ilocanos. The job of our constituents in Ilocos is working in the tobacco companies, planting tobacco. We dont want them to go hungry, Enrile said. The bicameral conference committee, which seeks to reconcile two different versions of the bill, on Thursday agreed on a target of P35 billion in new sin taxes, and a 1,000 percent increase in the tax on low-priced cigarettes over the 2013-2017 period. Enrile and Marcos said the industry would not be able to bear this increase considering these brands make up 65 percent of the domestic market. trate on serving his people as a politician. Domingo Ramos, head of the National Disaster Risk Reduction Management Council, said the storm damage to infrastructure, agriculture and property had so far reached P6 billion. He said Pablo had affected 1,096,067 families in 30 provinces. Typhoon signal no. 2 remained up in Ilocos Norte, Ilocos Sur and La Union, while signal no. 1 was still up in Cagayan Valley, the Babuyan group of islands, Abra, Kalinga Apayao, Mountain Province, Benguet and Pangasinan. Typhoon Pablo has weakened into a tropical depression, Ramos said. The people may not worry too much anymore, but must still be extra careful. Malacaang said Sunday the allegations of illegal mining in Compostela Valley would be included in the investigation of the factors that led to the high death toll from Typhoon Pablo ordered by President Benigno Aquino III. It may be one of the contributory factors, deputy presidential spokeswoman Abigail Valte said. We will find out after the agencies are done with their assessment. Valte said Mr. Aquino also ordered the National Police to look into the reports of the looting of shops and warehouses in Cateel, Davao Oriental, by hungry people as a result of the slow delivery of relief there. Our problem is that some areas remain inaccessible, Valte said. We need to do two things: open access to those areas to speed up the delivery of relief and make sure the looting does not happen again. An official said Sunday Typhoon Pablo damaged P3.04 billion worth of corn crops.

President Benigno Aquino III met with close to 200 lawmakers last week at the Palace to seek an end to the long-drawn debates. During the meeting, he told lawmakers not to be like ostriches who bury their heads in the sand when they are threatened when voting for or against the RH bill. The presidential push, however, was not enough for Kabataan Rep. Raymond Palatino, who accused Mr. Aquino of playing both sides by handing out vague executive persuasion. Palatino said there was little hope of the RH bill becoming a law starting Jan. 1, 2013 unless the President certified it as urgent. The President is playing both sides. He did not want to antagonize the Catholic bishops because of elections, Palatino told the Manila Standard. Palatino said the President should have made categorical his instruction to push for the immediate passage of the RH bill that seeks to establish a national policy on RH, responsible parenthood, population and development. The executive persuasion is not enough. The President should have been categorical in asking Congress to pass the bill and certifying the bill as urgent is as categorical as he can get, Palatino said. Even if the bill is passed on third reading, Palatino said, Congress has no more time to reconcile the House and Senate versions in the bicameral conference committee. I am not as positive anymore that the RH bill will ever become a law, especially now that the campaign period is fast approaching. and glory. Rear Adm. THE Bangko Sentral requirement for foreign banks in the country to be listed in the Philippine Stock Exchange and to sell 10 percent of their equity to the public implements a 1994 law that sought to liberalize and foster competition in the banking industry, a lawmaker said on Sunday.
LPG-MA Rep. Arnel Ty said public listing of foreign banks, which was provided for under Republic Act 7721 of 1994, would mean greater transparency in management and operations of banks with at least 60 percent owned by foreigners. They will be open to increased scrutiny by public shareholders, and subject to highly rigorous reportorial requirements, said Ty, a member of the House Committee on banks and Financial Intermediaries. Republic Act 7721 gave foreign banks reasonable period of time to be listed in the local stock market. BSP issued a circular on November 18 to implement the law 18 years after it was passed. the priest will likely be able to answer: Why would a just and all-powerful God punish the innocent poor whom the Church professes to protect from the evils of the Reproductive Health bill? When the death toll mounts to the hundreds, the truism that God works in mysterious ways seems completely inadequate. Under such circumstances, it is more logical to conclude that the bishop and the priest spoke out of turn, and that they were mistaken about the true message that Typhoon Pablo brought. Here are some more reasonable conclusions we can draw from the most powerful typhoon this year. First, we are woefully unprepared for the kind of extreme weather disturbances that have become sadly commonplace. The Aquino administration knew of Pablos strength and its coming one week before it entered the countrys area of responsibility, and even spoke of a zero-casualty target. Yet, some 540 people are now dead and 827 more are missing, with a nal death toll expected beyond 1,000. If there is any message here, it is that we need to improve our ood control measures and our emergency response. Second, the damage wrought by these storms will have a tremendous impact on our abil-

FOR the second time this year, a Catholic prelate suggested that a vengeful God punished the Philippines because lawmakers had the temerity to consider the passage of the Reproductive Health bill. In remarks made in Filipino to the Church-owned Radio Veritas, Manila Auxiliary Bishop Broderick Pabillo said tragedies such as the death and destruction wrought by Typhoon Pablo occurred whenever lawmakers pushed to pass the bill, and that this might be a message from God. In August, the executive secretary of the Episcopal Commission on Family Life of the
UNDER present rules governing pretrial, parties are supposed to inform the court, and each other, about the witnesses they are to present, what they are to testify on and the time it will take for each witness to testify. That is the rule; it is hardly ever the practice. For fear of allowing the stringency of procedure to defeat the merits of substance, almost all rules that impose limits provide for some kind of escape route -- and what was meant as a diversion road soon becomes the highway, because lawyers are never wanting for reasons by which to support their pleas for the admission of unannounced testimony. Come January 2013, the freshly minted Judicial Afdavit Rule of the Supreme Court -- yet one more exercise of its rulemaking power -- takes effect. To be sure, it is not all that new. As a proposal, it was mulled repeatedly by the research and consultants groups of the Philippine Judicial Academy, committees of which I was a member. It is also the rule in summary proceedings. But this is the rst time that the rule is made to apply to all actions, proceedings and incidents, requiring the reception of evidence before all courts, including the Supreme Court in those matters that require that it admit evidence. Its applicability to criminal proceedings is still limited, though. In essence, the rule directs that parties submit before pre-trial the afdavits of the witnesses that will take the place of direct testimony. Direct examination is what happens when a partys lawyer presents the party himself, or a witness favorable to the party and examines him to allow his testimony to form part of the evidence before the court. Unlike the usual afdavit, however, the judicial afdavit will take the form of a deposition -- in question and answer form. The witness-afant must nevertheless still take the stand to afrm what he averred in his testimony and to subject himself to cross-examination, on which the traditions of the legal profession and judicial procedure seem to have repose trust as the ultimate sieve of the veridical! O And as Judge Jet Aquino, my RTC judge and brother points out, the preparation of the judicial afdavit can be demanding on the part of the witness lawyer who must be certain not to omit anything that he will be foreclosed from introducing at a later time. Sticking points remain, however. One of them is a non-issue for my father, Justice Hilarion Aquino, a lecturer and a Bar Examiner in remedial law. It is, for me, perhaps because I do

not know as much procedure. When is the formal offer made? Under the ordinary rules of procedure, testimonial evidence is formally offered before the witness commences testimony, so that even before direct examination starts, the adverse party has the opportunity to object to the very offer, and the court, the duty to rule on whether the witness should even get into the witness box or not. Under the new Rule, the offer is made at the start of the presentation of the witness, but the afdavit has already been submitted to the court! If the afdavit takes the place of the live testimony of the witness, then when the afdavit is submitted, the testimony of the witness is already before the court! Is the submission prior to pre-trial also formal offer? If not, then is the formal offer made when the witness is summoned for crossexamination? And if the court should nd merit in the objection to the offer and refuse him leave to testify, then my sympathy goes to his lawyer who had to labor over formulating what I can only presume is an exhaustively written afdavit only to be made short shrift of. Since the adverse party is served a copy of the judicial afdavit prior to pre-trial, would it not have been the more expedient procedure to require opposing counsel to interpose his objection to the proposed testimony of the witness, or to parts thereof, to give the court a chance to rule even before the witness is summoned to take the stand for cross-examination, if this is not waived? More testy for me is the matter of the hostile witness. One is allowed to cross-examine ones own hostile witness, something you are not allowed to do to a friendly witness. So, is the judicial afdavit of a hostile witness to include a cross-examination of the witness as well? The spirit of the rule seems to be: No judicial afdavit, no testimony. Unfortunately, that is not what the rule says. A party who fails to submit the required judicial afdavits and exhibits on time shall be deemed to have waived their submission. What is waived is not the right to testify, not even the testimony, but the submission of the afdavit. Will the court then still be open to the testimony of the witness? But I think men and women of goodwill are willing to give the rule a chance. It will help the public, the Bench and the Bar, however, to clarify the issuesnot only mine, but others as wellwith respect to the rule. And, for Gods sake, let us be sure that the judicial afdavits are crafted in tolerably compehensible English. rannie_aquino@sanbeda.edu.ph rannie_aquino@csu.edu.ph rannie_aquino@yahoo.com

to mislead. If you look at all the efforts the critics of the AES/PCOS it would look like they are not only committing misinformation they are actually engaged in disinformation. Undeterred by the Supreme Courts June 2012 decision declaring Comelecs purchase of the PCOS machines from Smartmatic/TIM valid (this decision was afrmed by the high court last October), the AES/PCOS bashers continue to make media rounds and hold press conferences to warn people about the looming disaster in the 2013 elections. Their warning, however, sounds like the end-of-the-world Mayan prediction which is more imagined than real. The present mantra of the AES/PCOS bashers is source code. The source code, in IT parlance, is the set of instructions that allows a program to run on a computer or a computing machine. Citing the business dispute in the United States between Smartmatic and its licensing company, Dominion Voting Systems International, AES/PCOS bashers are now claiming that no source code for the 2010 election was ever deposited by Smartmatic with the Bangko Sentral ng Pilipinas as required by law. In response to the source code issue, Comelec spokesman Director James Jimenez wrote in his Nov. 28 column in a business daily that the licensing agreement between Smartmatic and Dominion included a provision that obligates Dominion to place all its source codes in escrow. Jimenez said that there is a safety clause in the contract that allows Smartmatic to take the codes out of escrow and use them to x any problems arising from Dominions violation of their licensing agreement, if any. This provision is the center of the legal feud between Smartmatic and Dominion. Comelec Chairman Sixto Brillantes

He has also made clear that the dispute would have no effect on the use of the PCOS for the 2013 elections. Brillantes, one of the countrys leading election lawyers before his appointment to chair the Comelec and who is also a certied public accountant, said that what contributes to the confusion on the Smartmatic and Dominion legal tussle is when non-lawyers interpret complicated legal issues and when the comments are based not on source documents but on third party accounts. Jimenez also explained that the Dominion-Smartmatic legal feud does not in any way imply that Smartmatic never got the source code for the 2010 elections. In fact he said that the source code was submitted by Smartmatic and Comelec for a third-party review. After the review was completed, the source code was used to create a nal version of the software that was used in the 2010 elections. It is strange that former acting Comelec Commissioner Lagman now raises the issue of whether there is a source code when he has lashed out against Comelec before against the poll bodys bias against local IT experts when it awarded a P70-million contract to SysTest Labs to perform he mandatory review instead of making the source code available for review by Filipino IT professionals. Jimenez said that Comelec even invited the very same groups now claiming the non-existence of the source code to examine it in the presence of representatives from Smartmatic and Dominion. Unfortunately, the review process was boycotted by the very same people who now claim that the code never actually existed.

Continued from page 1 Aquinos directive to his Congress allies to dispose of the controversial measure before Congress adjourns for Christmas, despite the inability of its authors and sponsors to refute the various constitutional, moral and scientic objections to its passage, could provide a turning point. It could provoke a restorm and create an active, organized opposition on the ground, which no political party elding candidates in the May 2013 elections has so far been willing or able to provide. Opposition to Aquino could be led by those who regard the bill as a naked attack on religious liberty and a deliberate attempt to destroy the Filipino family and society, and are ready to accuse him of abuse of power. This could revive the situation in the seventies, although probably not in all its details. In the seventies, the principal organized opposition to the abuses committed during martial law came from the Catholic Church. The most active then were the religious and the clergy. In the nal push for regime change in 1986, the Catholic Bishops Conference of the Philippines (CBCP) statement of Feb. 13, 1986, on the conduct of the Feb. 7, 1986 elections, provided the moral basis for the civilian-backed military uprising that brought down Marcos. It was the powerful voice of Jaime Cardinal Sin, the archbishop of Manila, that drew entire families out into EDSA to support the military. In 2000-2001, the same voice was heard again to call for the resignation of then-President Joseph Ejercito Estrada. A similar statement from the CBCP at this time denouncing the grave immorality of Aquinos action vis-vis the RH bill could produce the same moral convulsion. It could provoke a clamor for regime change. So far no Catholic Filipino prelate has replaced the charismatic and politically active Jaime Cardinal Sin, who retired as Manilas archbishop in 2003 and died in 2005. There may be no high churchman around to lead the call for Aquinos resignation. But where the laity had tended to give way to the political initiative of the clergy and the religious in the seventies, they seem prepared to assume a more active and pronounced political role today. They are likely to lead any political resistance to Aquino. Resistance could be either passive or active, both of which are permitted under moral law. It could take the form of civil disobedience at the very least and armed resistance in the extreme, depending on the injustice or injury that needs to be addressed. In either case, Aquino would not nd it easy to govern, assuming he has been governing at all. The irony is that whereas in 1986, Mrs. Corazon Cojuangco Aquino, the Presidents late mother, was the beneciary of active Church intervention in the nations politics, this time her son, whom many of the Churchs faithful mistakenly supported when he sought the presidency in 2010, would be the adversary. What they seem to resent is not so much his apparent inability to understand even the most fundamental issues or his inability to recognize his enormous limitationshis countrymen seem prepared to overlook or forgive theseas his apparent eagerness to use the powers of the presidency to carry out the dictate of foreign population controllers who are out to destroy the Filipino family and society for their own ends.

custody battles between husband and wife, a mother cannot be separated from her child who is seven years of age or below. Many other laws have been passed to benet Filipino women. Where before, a wife had no right to refuse to have sex with her husband for any reason, now, under the Anti-Rape Law passed in 1997, married women who are forced to have sex by their husbands may sue for rape. An Anti-Sexual Harassment Law was passed in 1994 giving women in the workforce and in schools and learning environments the right to sue men who, with the use of their ascendancy or position, seek sexual favors from women or girls in exchange for a promotion, keeping a job, getting better grades or not being given a failing mark. In 1995, the Women in Development and Nation-Building Act was passed, giving women the right to enter into contracts without having to seek their husbands consent. In the same year, Congress also enacted the Women in Small Business Enterprises Act, empowering women to engage in trade or industry as participants in nation building. The most signicant among laws passed protecting women is the Anti Violence against Women and their Children Act (RA 9262) passed in 2004. Under this law, women are given the right to seek protection from courts to prevent or stop the commission of violence and abuse against them. This law penalizes domestic violence or violence in intimate relationships. It denes violence against women and their children as any act or a series of acts committed by a man against a woman who is his wife, former wife, or with whom he has or had a sexual or dating relationship, or with whom he has a common child. The prohibited acts consist of battery, assault, coercion, harassment, arbitrary deprivation of liberty and the withdrawal of, or refusal to support, including threatening to commit any or all of these acts. Even if the act is directed by a man against a womans child alone, whether legitimate or illegitimate, inside or outside the family home, as long as it results, or is likely to result, in physical, sexual, psychological harm or suffering, or economic abuse to her or her child, a man may be penalized under this law Violence against women is a worldwide curse. The World Health Organization has reported that half of all women who die from homicide are killed by their current or former husbands and partners. Data from the Philippine National Police indicate that eight years before the enactment of the law, an average of 7,383 cases of violence against women were reported. The highest number was in 2001 where 10, 343 cases of violence against women were posted. Although great strides have been taken by Filipino women through legislation, they need to continue their vigilance for gender equality, not only in laws but in reality. Filipino women may be better off than their counterparts in many parts of the globe but remnants of the colonial and ancient concept that women are chattel and are not equal to men still exist. Mindanaos Precean Rivera and Jenni Celine Dizon set up an all-Filipino nale in girls singles, while Puerto Princesas Mil Joseph Apdon, Jeferd Rugay and Kaiko Ravina toppled Team Mindanao, 3-1, in the preliminary round of the mens regu competition. Rivera, a 16-year-old campaigner from Tupi, South Cotabato, was in full control against Joanne Chong of Sabah, Malaysia for a 6-2, 6-1 triumph in the seminals, just moments after the 15-year-old Dizon from Ateneo de Davao registered an equally easy 6-1, 6-2 win over Janice Chong of Sabah. ``Maganda ang chance ko sa nals. Medyo kulang pa kasi sa skill at stamina ang kalaban, said Rivera, who made it to the semis after pulling off a 6-2, 7-5 victory over Khrizzele Rivera of Puerto Princesa in the second round. In the boys singles, Rubylito Saga of Mindanao demolished Bruneis Ak Md Rauddudin Izzul Islam, 6-1, 6-1, under intense heat at the GenSan City Court. Stefan Walter Alex later defeated Sarawaks Mohamad Zaki Pauzi, 6-4, 7-6 to set up a seminal clash with Saga in the fournation event backed by Dunlop/ Slazenger tennis balls, Marathon Sepak Takraw Equipment, Pacman Pambansang Tubig and SM City General Santos. Competition in all venues temporarily ceased by midday, allowing athletes and ofcials to witness the Manny PacquiaoJuan Manuel Marquez ght on television, which was held at the MGM Grand in Las Vegas. The trio of Apdon, Rugay and Ravina seized the rst two sets, 17-16, 16-4, but allowed Mindanaos Romel Moriones, Bille Villanueva and Alfred Erecito to steal the third, 15-12, before Puerto Princesa nished it off, 15-12, in the next set. BAGUIO CITYForest Hills won the Fil-Championship title, even as Matikas stunned the eld with its breakthrough victory in the Am Championship Division of the 63rd Fil-Am Invitational Golf Tournament at the Baguio Country Club and Camp John Hay golf courses, respectively. With the pair of 30s from Jin Ho Kim and Edsel Tan, Forest Hills saved the best for last as it had the days best score of 114 for the teams 479 and a two-shot victory over the deposed champion. In Jae Kim and Edgar Lee added 29 and 25 for the team, which had been in the sidelights for several years and nally made it to the top team work. Everybody contributed his own share in this momentous triumph. I am so blessed because this is my rst time to captain a team in the famous Fil-Am Golf championship. I thank God for this gift. Forest Hills started nal round at third, ve points behind three-day leader AAV-Ventureslink-Robros and two off the Mizuno Superstars. But the erstwhile leader faltered against Forest Hills and Mizuno. The former pro Raymund Sangil had a 28, to back Vince Lauron and King Stehmeiers 29, while Rodel Mangulabnan added 27 for the teams supposed 113 points and 479 total. But the penalty cost the team two points when Sangil putted af-
ter a bogey at the fth hole after their nal score went down to 472. It could even be a more exciting nale as the fth men, Raffy Garcia for Forest Hills and Ace Stehmeier for Mizuno, both scored 22 points. The winner will be determined by the nal scores of the two tied teams. Forest Hills, however, will still win with its higher nal- day score of 114 against the 113 of Mizuno, said tournament co-chairman Shin Paul Chan. But it was the second mistake of Sangil after failing to recheck his score the third day when he registered a 24 instead of 25 that could have cut the lead of AAV-Ventureslink to only three and a two-point lead on Forest Hills.

over Pacquiao. Like Pacquiao, Marquez packs power. How to land that killer punch has always been also the universal question each time both great, durable ghters meet. Now, as I said, when two powerful combatants decide to mix it up a la telephone booth brawl, one of them will surely be hit by a haymaker. In short, when all offense dictates a ght, defense is as alien as E.T. Pacquiao had no defense in the last 10 seconds of Round 6 yesterday. So with Marquez. One lucky enough could land the haymaker that will win it as proven by Marquez when his overhead right hit and attacking Pacquiao smack in the face. So powerfully exact on the dot was the Mexican Dynamites blast that PacMan fell like a chopped log, the impact of the blow creating a thud so loud everybody at
ringside watched in horror at the bizarre result. Anxiety was written all over the faces of those who saw Pacquiao fall face rst; as he lay almost motionless on the canvas, people panicked. Jinkee, Pacquiaos wife, wept unabashedly at the sight, desperately trying to climb up the ring herself and check on her hubbys condition. Thank, God, Pacquiao would soon regain his bearings and assured everybody, I am all right. Still, he was taken to the hospital for precautionary tests. Immediately, the nation described Pacquiaos knockout loss as the second tragedy to strike us in two successive weeks, adding the loss of hundreds of lives caused by typhoon Pablo last week in Mindanaonot to mention more than 500 more listed as missing in the Compostela Valley, Davao Oriental and Surigao. But even as Pacquiao absorbed
his only knockout loss since 1998, a fth ght with Marquez was quickly oated after the ght with no less than chief PacquiaoMarquez promoter Bob Arum not discounting the possibility. When it happens, it could be dull, boring, and not worth watching anymore, you might say? Uh-oh. Think again, fellers. Suckers teem in boxing. Besides, ask the dude seated next to you. Hed tell you Pacquiao merely lost on a lucky punch. * * * ALL IN. GLOBE Telecom Inc. said over the weekend it is nearing completion of a tender offer to purchase the restructured debt of Bayan Telecommunications Inc. and unit Radio Communications of the Philippines Inc. Globe chief nancial ofcer Alberto de Larrazabal said preliminary results of the tender offer showed at least 98.2 percent of the aggregate remaining principal of BTI loans had been tendered. About 85.1 percent of the remaining principal of RCPI loans were also tendered and not withdrawn in the offering period. De Larrazabal said of the original outstanding principal of $200 million, the remaining principal amount stood at $184.5 million or $922.391 per $1,000 original principal amount
of the notes. He said despite the overall acceptance level of 94.1 percent, all tenders remained subject to validation by Globe. Globe is very pleased with the preliminary results of its tender offers for the restructured debt of BayanTel and RCPI. Creditors of BayanTel and RCPI have demonstrated overwhelming support for Globes tender offers, De Larrazabal said. He said the terms and conditions provided that if the acceptance level was less than 75 percent, Globe would pay each holder an amount equal to $280 for each $1,000 remaining principal amount of notes. Globe would pay $290 if the acceptance level was equal to or greater than 75 percent but less than 80 percent; $300 if the acceptance level was equal to or greater than 80 percent but less than 85 percent; and $310 if the
acceptance level was equal to or greater than 85 percent. Globe said it would not pay any accrued interest to holders whose notes were accepted in the tender offer. Globe expects the settlement date of both tender offers to take place not later than Dec. 21 this year. Bayan has been covered by a court-supervised rehabilitation since 2003. The current rehabilitation plan anticipates that Bayan and RCPI will remain in rehabilitation until 2023. In the event that the debt offers are completed, Globe intends to apply with the rehabilitation court to amend the terms of the rehabilitation plan in the interest of assuring Bayans long-term sustainability. Globe expects that the debt will remain subject to the jurisdiction of the rehabilitation court after the completion of the debt offers, Globe assistant corporate secretary Marisalve Ciocson-Co said earlier.

WITH only three weeks to go before the end of 2012, the local equities market is poised to sustain a record run as investors continue to focus on positive developments in the domestic market, rather than the negative news overseas.
The market has sustained a rally due to lack of negative news and despite warnings by analysts that stocks were ripe for technical correction. If a year-end rally is to materialize, the long-waited for correction may be brief and sudden, if at all, Accord Capital Equities trader Justino Calaycay said. Calaycay said the market should have made a correction after the Philippine Stock Exchange index hit the 5,600point level, the year-end target of most analysts. But the PSEi retreated only once over the last seven trading days, when it posted an 18-point decline Thursday. The stock market expects more positive developments in the local front in the coming weeks, especially on the possible rate cut by the Monetary Board on Dec. 13. The PSEi last week rose 153 points to close at 5,794.20 on Friday, with the daily volume turnover averaging at 3.43 billion shares and the daily value hitting P9.64 billion. AB Capital Securities said gains were seen across the board with noteworthy performances
from some banks, properties and holdings companies. Banking issues continued to soar despite valuations surpassing historical values while property companies are beneting from strong residential and retail sales. We have already seen how fundamental valuations did not hold inuence over the market this past week as share prices have continued to soar. While technical indicators likewise pointed to reaching overbought levels for stocks and the index alike, the current bullish sentiment might continue to propel the PSEi higher, AB Capital said. Analysts, however, do not discount a momentary rest or consolidation after the stock market rose too fast. The PSEi level that we are seeing right now came a few weeks early from the usual month or year-end window dressing, AB Capital said.

CITICORE-MEGAWIDE Corp., a
joint venture between listed construction company Megawide Corp. and parent Citicore Holdings Investment Inc., raised P6.5 billion from the issuance of xed rate notes, which it will use to nance the building of schools for the Education Department.
Megawide chief finance year fixed rate notes were officer Oliver Tan said during oversubscribed, with total the signing ceremony the 10- demand reaching P8.1 billion.
The P6.5 billion, together with the equity of P2 billion for a total of P8.5 billion, will be sufficient to meet funding for the phase 1 of the two packages, Tan said. The Megawide-Citicore partnership in August won a bidding for the contract to build school infrastructure projects of the DepEd under the so-called Public-PrivatePartnership scheme of the government. Megawide under the buildlease-transfer agreement will construct 2,885 classrooms in Region 3 and 4,259 classrooms
co-lead arrangers. The noteholders include Metropolitan Bank & Trust Co., Bank of the Philippine Islands, PNB, LandBank, DBP and Bank of Makati. Tan, meanwhile, said the company expects to achieve a net income of P900 million this year and post revenues of P8 billion to P8.5 billion. Tan said the company was slowly diversifying its construction portfolio with its foray in the PPP project. Megawide has generated the bulk of construction revenues from the residential projects of
SM Development Corp., owned by retail magnate Henry Sy. The Sy family holds a minority interest in Megawide. Tan said SM Development now only accounted for 50 percent of the companys revenues from a high of 73 percent. Megawide also started to book revenues from office buildings and hotels. Moving forward we are looking to book more on social infrastructure projects like schools and hospitals. That would somehow give us a more balance and diversified book order, Tan said.

Italys PM to quit
IN BRIEF
Local and international activists demonstrate inside a conferences center to demand urgent action to address climate change at the UN climate talks in Doha, Qatar on Dec.8. After all-night wrangling, the latest draft agreements Saturday lacked the strong commitments on climate action and nancing by rich countries that poor countries had hoped for. But they did include a text on loss and damage, a relatively new concept which relates to damages from climate-related disasters. AP
ROMEPremier Mario Monti told the Italian president Saturday he is resigning soon, saying he can no longer govern after Silvio Berlusconis party withdrew crucial support. It paves the way for early elections a year after the unelected economist helped pull the country back from the brink of nancial disaster. Only hours earlier, Berlusconi announced he would run for a fourth term as premier, aiming for a dramatic comeback, considering the billionaire media baron quit in disgrace in November 2011. The ofce of President Giorgio Napolitano, who met for nearly two hours with Monti at the presidential palace, said the premier told the head of state that without the support of Berlusconis party, he cannot further carry out his mandate, and consequently made clear his intention to resign once Parliament passes a crucial budget bill soon. Political turmoil in Italy, mired in recession and trying to escape the eurozone sovereign debt crisis, could spook nancial markets, which, with Monti at the helm, had steadily regained faith in the countrys ability to honor its debts. LONDONIt started out as a joke, but ended in tragedy. The sudden death of a nurse who unwittingly accepted a prank call to a London hospital about Prince Williams pregnant wife Kate has shocked Britain and Australia, and sparked an angry backlash Saturday from some who argue the DJs who carried out the hoax should be held responsible. At rst, the call by two irreverent Australian DJs posing as royals was picked up by news outlets around the world as an amusing anecdote about the royal pregnancy. Some complained about the invasion of privacy, the hospital was embarrassed, and the radio presenters sheepishly apologized. But the prank took a dark twist Friday with the death of nurse Jacintha Saldanha, a 46-year-old mother of two, three days after she took the hoax call. Police have not yet determined Saldanhas cause of death, but people from London to Sydney have been making the assumption that she died because of stress from the call. AP

YOUR hair is said to be your crowning glory but your skin is equally important. Sadly, skin is also very sensitive and can be prone to acne breakouts. Stress can take a toll on our skin. You can only get that lit from within look when your skin looks healthy and properly nourished. There are thousands of skin-brightening formulations claiming dermatologist-caliber promises, but not all of them work. Proactiv Solution is a solid and effective alternative to expensive visits to beauty clinics. With diligent application, it can give you a long-lasting, illuminating effect on your skin. Just follow the three simple Proactiv steps: Renew, Revitalize and Repair. This revolutionary, dermatologistdeveloped acne system helps clear existing and stubborn acne and prevents them from coming back. The Renewing Cleanser is a unique, oil-free formulated acne cleanser, with smooth tiny beads that exfoliate dead skin cells and other impurities. Deep cleaning, prescription-grade benzoyl peroxide (a grade not available in storebought brands that penetrates pores) attacks and heals blemishes fast. The second step is the refreshing, alcohol-free Revitalizing Toner. It removes plugs to eliminate clogged pores and helps eliminate excess oil for a refreshed, clearer skin, while soothing botanicals gently balance your skin tone. The nal step is the Repairing Lotion, a light, oil-free skin-clearing lotion with prescription-grade benzoyl peroxide lotion that heals blemishes and helps prevent new ones. In less than ve minutes a day, Proactiv Solution can eventually make your skin clean, clear and refreshed. Glowing skin catches the light, then that makes you catch peoples eyes.

One is the ability to charge the phone wirelessly simply by laying it on top of an optional $49 charging pad. (AT&T is including the pad for a limited time at no extra cost.) And theres an excellent maps application. (Nokia owns Navteq, one of the worlds major providers of geographic data.) While the Lumia 920 is so far available only on AT&T, HTCs 8X is appearing on both AT&T and Verizon Wireless, where it can access LTE, as well as on T-Mobile, whose non-LTE 4G network generally provides slower speeds. The Verizon version also supports wireless charging, though I wasnt able to try it out since my test unit was from AT&T. The 8X has the same processor as the Lumia 920 but costs twice as much for half the storage: $200 for 16 gigabytes. (AT&T is also offering an eightgigabyte model for $100.) It also has a less-beefy battery (though both should get you through a full day of normal use) and an eight-megapixel camera thats OK, but that I didnt like as much as the Lumias. On the other hand, the 8X is a far more compact package, both lighter -- 4.6 ouncesand thinner.

Or do we take into account external issues, like the business struggles of both companies and the fact that WinPhone 8 versions of such critical applications as Spotify, Instagram and Pinterest are missing in action? In that case, these look more like desperate efforts by two alsorans in hardware to hitch their fates to an also-ran in mobiledevice software. I prefer to think the former. But a little caution is in order. On the surface, Windows Phone 8 looks a lot like its predecessor, Windows Phone 7. It preserves the same distinctive, tile-based interface, albeit with a few tweaks. You can now, for instance, choose from three sizes of tiles, giving you additional control over your start screen. New Kids Corner parental controls let you lock down certain features and content before you hand the phone over to Junior to play with. Parent. For Piolo, family always comes rst. With his son Iigo growing up, the actor sees the pressing need to give him the best life possible. Piolos hard work is to no avail if he provides him with any less. Now that hes becoming an adolescent, his needs are changing and I have to be prepared to fulll them, he optimistically asserts. Producer. Piolos venture from star to being the brains behind the scenes was no easy transition. That requires a 24/7 commitment as the thinker and the nancier of the production. For somebody like Piolo Pascual, late hours are essential and the thinking process continues long after everyone calls it a day. As a producer, Piolos hard work is seen through his P100M box ofce hits, like the two Kimmy Dora movies. Servant. Even with his popularity, Piolos feet are still on the ground. The success he has achieved has inspired him to give back to the people who have helped him realize his dreams. He pays forward to society not only by entertaining his fans, but also through giving to several foundations and charities he supports. Piolo Pascual founded Hebreo 12:1 Foundation with his siblings that helps give hope to terminally ill children to make their wishes come true through Make A Wish Foundation. The foundation also supports volunteers in Gawad Kalinga by being an Organ Donor Cardholder under the National Kidney and Transplant Institute, among others. Athlete.
