 INSTRUMENT …CHARGEABLE
TO DUTY
• Sec. 3 lays down list of all the instruments
including bills of exchange which have to
be stamped. There is a schedule – which
contains list of all such instruments.
• No duty is required on government
instrument.

 Stamp..
• Stamp may be adhesive stamp also. But it
must be properly cancelled by the maker
of the instrument. Signature or mere cross
can also be considered valid, provided it
makes the stamp not-usable
subsequently.

• Sec. 30 : any person receiving Rs. 500
(now Rs. 5000) or more will have to give a
stamped receipt.

• Adhesive stamping

 Cases when adhesive stamps are
allowed….
• Bill of exchange
• Promissory note
• Entry as high court etc.
• Instruments chargeable upto 10 paise
• Notarial acts
• Transfers by endorsements.

 Mode of cancellation ..
• Sec. 12 (3)
• Hafiz allah Baksh v/s Dost Mohammad : (1935)
if it is possible to reuse stamp, then there is no
proper cancellation
• Melaram V/s Brij Lal : (1920) diagonal line
(extending to the paper) is effective manner of
cancellation.
• Daya Ram V.s Chandu lal (1925): third party
putting a date on stamp is improper cancellation

• Sec 17: at the time of execution..
• If the instrument is a foreign instrument :
within 3 months of brining the instrument
in India – it has to be stamped …
