DIRECTOR'S UNOPPOSED MOTION TO ENLARGE THE TIME
FOR FILING THE DIRECTOR'S BRIEF
The Director of the United States Patent and Trademark Office, pursuant to
Fed. Cir. R. 26, requests that the time for filing the Director's brief in the above-
captioned appeal, now due January 10,2013, be extended forty-one (41) days to
February 20, 2013. This is the Director's first request for an enlargement of time
in this case.
Counsel for the Director requests this enlargement due to the heavy
workload in the Solicitor's Office as well as the absence of key personnel during
the December 2012, January 2013 time frame. Further, the undersigned attorney
assigned as the lead attorney on this case is involved in several other litigation
matters, at the trial court and appellate level, making this extension oftime
necessary. Appellant's counsel, James R. Barney, was contacted on December 13,
2012 and he indicated that Appellant will not oppose this request for enlargement
of time.

DECLARATION IN SUPPORT OF DIRECTOR'S UNOPPOSED
MOTION TO ENLARGE THE TIME
FOR FILING THE DIRECTORS BRIEF
1. I am the lead attorney assigned to work on this case.
2. During the month of December 2012 and January 2013, I will be
preparing for a trial set to take place during mid-late January 2013.
Due to layers of pre-trial briefing, motions, other preparations
associated with the trial, several other pending matters and a
continued heavy work load in our office, I need extra time to prepare
the government's brief in the above captioned appeal.
3. Further, due to the upcoming holidays, several other attorneys and
management personnel that will be involved in reviewing the
government's brief will be out of the office during the same time
period which also makes an extension necessary.
4. On December 13,2012, I contacted counsel for Appellant who
indicated that Appellant does not oppose this Motion.
