Pursuant to Ninth Circuit Rule 28-2.6 and General Order 2.1, Defendants wish to apprise the Ninth Circuit of a related case currently pending before it, Pickup et al. v. Brown, et al., No. 12-17601, filed on December 4, 2012, in which Plaintiffs-Appellants appeal from the December 4, 2012 Order of Judge Kimberly J. Mueller in Case No. 2:12-cv-02497 (Docket # 80) denying a motion for a preliminary injunction that would have enjoined enforcement of Senate Bill 1172 (Cal. Stats. 2012, ch. 835, 2), the same Act enjoined by Judge William B. Shubb in this case. Both appeals involve the constitutionality of Senate Bill 1172 and raise the same and/or closely related legal issues.
