THE Fijian government is rewriting the draft constitution drawn up by an internationally renowned expert, military ruler Frank Bainimarama said in a televised address.
The government's legal team will finalize a new constitution within three weeks - and may be expected to reflect substantially the army's own submission to the commission that wrote the draft. The commission, chaired by constitutional expert Yash Ghai, worked through 7000 submissions and meetings throughout Fiji last year, but last month police burned proofs and seized 599 copies of the draft, as Professor Ghai watched. Commodore Bainimarama will announce the membership of a constituent assembly that will discuss the draft, and present it to President Epeli Nailatikau for promulgation in March, to enable elections to be held by September next year. The Prime Minister said: "The government's legal team will amend the Ghai draft to ensure that the draft constitution presented to the constituent assembly is one that is positive, addresses fundamental issues of good governance, and will result in an enduring constitution and guarantees true democracy." Commodore Bainimarama, who seized power in December 2006, said that despite the drafting of a new constitution, he would issue a decree next week to govern the registration of political parties. A spokeswoman for the Department of Foreign Affairs and Trade said this week: "The draft constitution is a substantial document and another step along the path towards Fiji's return to democracy." Mr Tuilaepa said: "Most democratic countries know a lot more about constitutional processes than the inexperienced military gang in Suva."

Fiji In Hawaiians New Airbus Possibilities


Hawaiian has ordered a long range single aisle airliner that could change the airline map of the Pacific by reviving high frequency links with smaller Pacific states. Hawaiian is keeping quiet about specific routes for its surprise order for 16 Airbus A321 NEOs from 2017. But the single aisle jets will have more than enough range to serve Fiji, Tonga, Samoa, and New Caledonia from Honolulu, as well as fit into Port Vilas Bauerfield runway in Vanuatu, maybe. If it uses the jets this way, it will be taking its fast growing and successful strategy of developing Hawaiis airports as offshore hubs for mainland USA to a new level. The order announced includes further options for six of the A321 NEOs which if exercised in addition to the 16 firm jets would have a list price value of US$2.8 billion (FJ$5 billion). Hawaiian is already an Airbus customer, growing its fleet of A330-200s to replace the last of the older Boeing 767-300ERs in its fleet, with orders to augment and replace those jets with A350-800s for which the -800 may itself have proven too large. High-achiever Whatever course Hawaiian follows, it has been the quiet achiever on Australia-Hawaii routes. It has built up strong market support on services between Honolulu and Sydney, Melbourne and Brisbane in a commercial alliance in this market with Virgin Australia. Assailant Stabs Mum, Dumps Body In Creek


"MY mum will come back next week." These were the words echoed by a five-year-old girl to her family whose mother was brutally slain during a family dispute at Naisaumua Village in Tailevu yesterday morning. The incident happened at 6am when 33-year old wife Kasaya Veisei was stabbed with a kitchen knife several times on a bridge in the village and her body thrown into the creek below. In an interview yesterday, Veisei's cousin Lusiana Qionimacawa said Kasaya's assailant was drinking grog with the whole family until around 5am yesterday. She and Kasaya then went to sleep. After 10 minutes her assailant called her from outside the house, Ms Qionimacawa said. "My cousin (Kasaya) knew that something would happen so she asked me and another cousin to accompany her," she added. Ms Qionimacawa said while they were walking, a kitchen knife fell from a knapsack the assailant was carrying on his back. She said that was the time when an argument broke out between the two and Kasaya was stabbed. "When we saw my cousin stabbed with the knife, we started shouting to alert the village," Ms Qionimacawa said. "The last word that Kasaya uttered was sa oti (it is finished) and she was no more," she said. Ms Qionimacawa said after throwing the deceased in the nearby creek, the man fled the scene. She said her cousin had four children and was a woman with a big heart. "Her eldest child was 14-year old and the youngest five-years old. They are safe and are staying with us," Ms Qionimacawa said. "We will miss her a lot. She was one of the best in our family," she said. The incident has left the whole village in a state of shock and people are living in fear. Samoas prime minister has blasted Fijis military dictator Voreqe Bainimarama, calling him a dumb foot soldier. Prime Minister Tuilaepa Sailele used the term as one of Fijis senior military figures said they were getting the message from people that there was no need for elections next year. Bainimarama overthrew democracy in 2006 but has promised to hold elections next year. He commissioned Kenyan law professor Yash Ghai to draft a new constitution, but after it was presented, police seized copies of it and burnt printers proofs. Government has allocated $1.3 million dollars to rehabilitate schools in the western division that were affected by Hurricane Evan. Western Division commissioner, Commander Joeli Cawaki highlighted the importance of ensuring that all students have access to good education facilities despite the setbacks faced. School management has been advised to engage their contractors and liaise closely with their divisional office based in the western division, Commissioner Cawaki said. These contractors will be given strict guidelines once they are engaged to carry out the necessary works for the school. Timeline to complete the work is essential, he said. Cawaki said for schools in Lautoka, Nadi and Yasawa there are 86 which were partially or completely destroyed by Hurricane Evan. There were 22 primary schools and six secondary schools in Nadi, for

A Labasa SKM College student, one of the 11 accused of cheating, said he was so unhappy about getting zero marks in his Biology external seventh form exam paper that he thought of killing himself. Nathaneal Caleb Lal who is one of the schools top eight science student with high hopes to be a doctor said he was shell shocked. I was shocked. I could not believe it, Lal said. I had to re-check the name and ID number to check if it was really mine. In fact it still hasnt sunk in. I had done well in all of my subjects except Biology. This mark is not right, its not mine. His Biology paper aside, Lal passed his FSFE with 319/400, good enough to ensure he progresses to do tertiary studies, but not enough to guarantee him a place at the College of Medicine to pursue his ultimate dream of becoming a doctor. I cant concentrate on anything else.

Zero Marks Made Me Want To Kill Myself


If I dont get this marks my dream of becoming a doctor is finished. The 18-year-old is requesting the Education Ministry to make public evidence that prompted them to disqualify students because of cheating allegations. Id like to know how they arrived to that decision, because all 11 of us who have been affected were not even sitting together close to each other during the exams. How could we have cheated? All they told us that we got zero marks because we had the same answers. I just hope the ministry understands our concerns and does not play with our future because the only thing I can think of right now is killing myself. Lal said that they have been victimised. He claims that the ministry did not write in or send in a follow-up letter to their school to explain their decision. He is currently staying with his older brother in Samabula and is hopeful that come Friday, the education ministry

would have a favorable answer for them. A team was set up by the education ministry when the incident came to light last week to review the case and the ministrys standard processes regarding malpractice in exams. Acting education minister Viliame Naupoto had said findings were likely to be ready by the end of this week.

Students Hard Work Pays Off


The overseas scholarship was offered to Waqabitu and twenty seven other students who underwent an orientation program at the Ministry of iTaukei Affairs. For him, this scholarship will give him an edge over others once he completes his studies. Another recipient, Ms Kelera Yacalevu of Labasa, expressed her gratitude to the government and the ministry for the offer to also undertake studies in Malaysia for BSc (Hon) in Information Technology (Network Computing). I am very happy that I was chosen and I will try my very best to achieve my certificate and upon my return, to contribute to the government and also be a role model for other students, Ms Yacalevu said. Government this year awarded 28 new overseas scholarships which will now see 21 students study in Malaysia, Singapore, Australia and New Zealand. Addressing the successful applicants at the orientation program was the Ministrys permanent secretary Mr Savenaca Kaunisela. Mr Kaunisela said the orientation program was necessary to ensure that the Governments investment through education is realized and put to good use. The scholarships will enable many to participate in all facets of development which will continue to build a well educated and better Fiji. The Ministry of i-Taukei Affairs is adamant to continue to provide scholarships to iTaukei students in this case our focus is for 2013, Mr Kaunisela said. The permanent secretary reiterated governments objective in providing the opportunity to better education as reflected from base level of primary schools (free education, free text books, bus fares etc) to universities. Mr Kaunisela highlighted that education is the KEY to wellbeing and that the onus is on students to succeed depending on their efforts and in the end will contribute to the economy Fiji will be waiting for you to return and contribute positively to nation building, Mr Kaunisela said. The orientation program was conducted to help the students familiarise themselves with the scholarship policies and the governments expectations of them. The Chairman of the Public Service Commission, Mr Josefa Serulagilagi announced the appointments of Mr Amena Yauvoli as the new Permanent Secretary for Foreign Affairs and International Corporation and Mrs Saipora Mataikabara as Permanent Secretary Functional and Regulatory Review based with the Public Service Commission. Commenting on the appointments, Mr Serulagilagi said that both Mr Yauvoli and Mrs Mataikabara were experienced and dedicated officers who were well versed in matters relating to public service management and administration. They have the appropriate professional skills and knowledge and will be able to provide sound advice to Government in their new roles. Mr Yauvoli joins the Ministry of Foreign Affairs with 25 years of work experience in both the Fiji Public Service and regional organisations. Having started as a graduate Economist in 1988 with the Ministry of Finance and National Planning, Mr Yauvoli was promoted to chief economist in 1997 before serving as deputy permanent representative in the Fiji Mission to the United Nations in New York from 2000 to 2003. He was appointed as permanent secretary Commerce, Industry, Investment and Communication in March 2007. In 2008, Mr Yauvoli resigned from the service to take up the position of Director Secretariat of the Pacific Community North Pacific Regional Office in the Federated States of Micronesia where he served until his appointment as permanent secretary for Foreign Affairs and International Cooperation.

New Public Service Appointments Announced

The outgoing permanent secretary for Foreign Affairs and International Cooperation, Mrs Saipora Mataikabara joined the civil service in 1999 from the Reserve Bank as a principal economic planning officer in the Ministry of Finance. She was later promoted to chief planning officer with the Ministry of Regional and Provincial Development in 2002 before taking up the post of deputy secretary, Industry and Trade in 2010. In June 2010, Mrs Mataikabara was promoted to permanent secretary Industry and Trade and was later posted as permanent secretary Foreign Affairs and External Trade in September 2011 where she served before her current posting to the Public Service Commission as permanent secretary for Functional and Regulatory Review. Mrs Mataikabara will report to the chairman of the PSC and is required to review the achievements of the PSC Functional Review Team. She will also undertake research and consultations to establish the overlapping functions which can be removed amongst the ministries and departments. In addition, she will undertake a review of existing regulations and identify the rules and procedures which inhibit the development of enterprise, innovations and investment. Recommendations will also be made on the removal of or improvements to such regulations which would be pro-business, pro-enterprise and consumer responsive. She will prepare action plans and costings to remove redundant regulations or make recommendations to make them more business friendly. Both appointments are effective from January 7, 2013.

Commission Teams Up With University To Boost Service Delivery

New Coin Confusion


STRIKING similarities between the new $2 coin and the $1 saqamoli are causing confusion among members of the public. The size, colour and weight issue has been the most talked-about subject for shopkeepers, bus operators and retail owners recently in the Central Division. Suva shopkeeper Bimla Wati said she made a few mistakes when issuing the new $2 coin as change. "Since receiving the new coins last week, it has been confusing," Ms Wati said. "There were times when I accidently gave a few customers the $2 coin instead of the $1 saqamoli. "But this happens during busy hours," she said. She urged the appropriate authorities to carefully look into this issue. Island Buses Limited director Ravendra Kewal shared similar sentiments saying the two coins were very confusing. "Some of the drivers are not really educated and the public can fool them. The drivers are now aware of the difference," Mr Kewal said. He said it would take time for the drivers to identify the difference before issuing the correct change to passengers. "The $1 saqamoli should be smaller than the $2 coin so that it can be easily identified and inconveniences can be avoided." "Some people can differentiate between the two coins in its new form but confusion arises after the shiny $2 coins fade. Fiji Bus Operators Association president Richard Lal said they had not received any complaints from bus operators on the confusion of the coins. However, Fiji Retailers Association president, Himmat Lodhia said the public would eventually become familiar with the coins. "Of course there will be teething problems but the public will get used to it in the future," Mr Lodhia said.

The Public Service Commission (PSC) signed a Memorandum of Understanding with the University of the South Pacific (USP) to assist in training and capacity building of staff at Senior Executive Services level (SES) within the Civil Service. The USPs Regional Centre for Continuing and Community Education (RCCCE) will be facilitating a training program for Director Level Staff in the civil service. Participants will be awarded a Professional Diploma in Business Leadership following the completion of the program. Public Service Commission permanent secretary, Mr Parmesh Chand said that the PSC is working on developing and implementing a Public Sector Leadership Development Program to be mandatory for the various levels of Senior Executives in the civil service. The PSC has completed leadership training for about 40% of the total number of Officers in the Senior

Executive cadre. Through the signing of this agreement, USP will be expected to train the remaining 60%. The Commission has made some significant reforms in the public service to improve efficiencies and service delivery. The message we are trying to put across now, is that in all positions in Government, we need well trained Officers who can think critically, assess analytically, and make informed and educated decisions. We need to be seen to be responsive and prompt in attending to ordinary members of the public and be forward thinking and strategic in our leadership role. The USP has designed an eight module program that includes face to face workshops, workplace and online learning. The leadership program is expected to be completed by September, 2013 and will be spread out at intervals to avoid disruptions to the flow of work in respective Ministries and Departments.

A FIJIAN soldier serving in the British Army in the Parachute Regiment has created history after being employed as the orderly for Prince William and his wife, the Duchess of Cambridge Kate Middleton. The new recruit who cannot be named for security reasons is the couple's first orderly. As reported, the lucky Fijian soldier apart from his responsibilities of having to be the chauffeur, and arranging and planning of logistics of the man who is second in line to the throne is also in charge of Prince William's wardrobe. The report stated the young Fijian lad was seen driving the Duchess of Cambridge and Prince William on several official engagements. It reported that the Fijian soldier drove the duchess when she visited her former preparatory school, where she played a game of hockey in November, shortly before she was taken to hospital with acute morning sickness. The media reported that a royal aide described the Fijian as a "lovely guy like all army, a superb can-do attitude and great sense of humour". According to the report, the cost is unknown and is being borne by the Ministry of Defence and therefore the taxpayer. With the couple now expecting their first child, the report stated that Prince William and the duchess have so far resisted the pressure in hiring more people to assist them with duties and have been doing their own cooking and shopping. The Parachute Regiment to which the Fijian soldier belongs is seen as an elite regiment in the British Army forces. The regiment is expected to provide or deploy an infantry force at short notice when needed. Soldiers in the regiment are trained with professionalism, resilience, discipline, versatility, courage and self resilience. They are also expected to provide direct support to the United Kingdom Special Forces.

An amended charge sheet was presented in the Magistrates Court in Suva in FICAC's case against former Principal Information Officer of the Ministry of Works, Transport and Public Utilities, Sainiana Waqainabete Radrodro who is charged with 11 counts of obtaining financial advantage by deception. FICAC prosecutor, Rashmi Aslam made an application to file the amended charges, in order to rectify the minor errors made in the initial charges. With the amended charges, the accused is alleged to have obtained financial advantage by falsely stating that the Minister for Works, Transport & Public Utilities had requested in grand total of $9560 over 11 separate occasions between May of 2010 and June 2011. Nayacalevu, upon confirming the receipt of the 2nd phase disclosures requested further documents such as the Ministers diary notes and correspondence and needed more time to peruse the amended charges for her client Radrodro, to take a plea. SPSE Outlines 2013 Plan


Fijis South Pacific Stock Exchange aspires to be the leading capital market in the Pacific Islands region. CEO Jinita Prasad in her 2012 report said 2013 would be a make-or-break year for the exchange in that its performance in terms of promoting listing, capital raising avenue and trading opportunities would shape its future prospects. Several initiatives have already been implemented in terms of regulatory and operational foundation in form of tax incentives and state of the art trading platform which can help us be the leading capital market in the Pacific Islands region and become more vibrant, she said. One of these, she says is the reduction of the corporate tax rate for listed companies to 18.5 per cent which was announced by the Fiji Government in their 2013 budget. The current incentive does not have an expiry period. In addition, the decrease in tax rate is much clearer. The many private companies that have been considering listing would be well-advised to take steps towards listing now. Current listed companies and investors recognise that the tax change will result in improved wealth distribution through increased retail investor participation as well. Prasad also highlighted the Investor Education Briefing, launched in June 2012, designed to keep listed company executives and stockbrokers to share first hand information on how these securities are performing and give insights on future prospects. Using these initiatives, the exchange will continue on its attempt to boost investor confidence and increase the level of trading activity in 2013, Prasad said. She further said the SPSE will continues to work with Fiji Revenue and Customs Authority (FRCA) to clarify some issues relating to capital market investments in order to provide clarity to investors and shareholders on potential tax implications. The exchange will continue to enhance its visibility at the international level to attract more foreign investor interests in our market together with its continued effort in scaling to new heights by developing an investment culture in Fiji, Prasad said. Going forward the exchange envisages listing of Depository Receipts for which SPSE and the relevant counterparts are in the process of carrying out feasibility studies and formulating the necessary regulatory frameworks.

RFMF Alleges Foreign Influence On Commission


Fijis military Land Force Commander Colonel Mosese Tikoitoga believes that the now dissolved Constitution Commission was influenced by another country. Speaking to the media, Tikoitoga said we can assume now in hindsight that the commission was influenced by another country. He said because the commissions work was funded by the AusAID, the 5-member team would have felt they were not answerable to the Fiji government and its people judging from their actions and comments. But, let it be known that the people are happy with the government. We have had feedback from the rural and the urban sectors who are happy with how things are and feel that there is no need for an election, Tikoitoga said. He said if anyone is in the wrong, it is Ghai and the commission members whose actions were not in line with an oath they had taken in High Court to follow the terms of the country which includes performing their duties within the confines of decrees 57 and 64. But, they did not. They went back on their words and said they wanted to be transparent and accountable. But, the fact remains that they took an oath to follow the set rules. They claim they want transparency and accountability for all Fijians. But in doing up the draft constitution they did not reveal who all were involved in the formation of the draft constitution. We now know it was not all the commissions work as they had taken on advisors, unionists, political parties, NGOs that actually advised the commission on what the constitution should formulate. What does that say about transparency and accountability. And then theres the commission thats telling us that we need to go back to pre2006, how does that happen. And then theres Penny Moore who is speaking to overseas media about the criteria. Her responsibility and the commissions is to look after the peoples interest and not further their own. He reiterated that the RFMF remained firm in their statement that the commission had no right under the decrees to disseminate and hold public consultation on the draft constitution. Tikoitoga also admitted they would not be able to take any legal action against Ghai as no provisions were made in the Constitution Commission decrees about it. He said these were not considered because the commission members were then believed to be "credible" people.

Hansons Supermarket Good Self Misleading


The Consumer Council of Fiji is calling on Hansons Supermarket not to misleadingly portray itself as a trader with substantial goodwill and reputation as contained in its press release published in the Fiji Times on 5th January 2013 (p.61). The Consumer Council has recorded many bad practices by Hansons in the past several years. Our market surveillance and complaints record can attest to this. The Council's letters to Hansons Supermarket are most often not replied to and its Makoi outlet continues to be a problem as our regular market surveillance has found many problems from expired goods to unhygienic conditions. For example in February 2010, our staff found expired soft drinks on sale on the shelves. Our letter to Hansons on the issue was not replied to, although the items were removed. In March 2010 we found conditional selling of sugar at this supermarket, whereby customers could only purchase sugar if they spend $10 or more at the store. In September 2011, the Council reported Hansons to the Fiji Commerce Commission (FCC) for issuing nonitemized receipts. Their receipts did not provide the individual item names and other details that a consumer purchased and thus restricting the consumer's ability to seek redress in case of overcharging or return of bad products. In February 2011, the Council received complaints in regards to Hansons' 200g Cooks Choice Natrala soya chunks where a live fly was found inside a sealed packet of this product. The product packaging also did not have an expiry date. The issue was the subject of a Fiji One television news report on 6th Feburary 2011. The Council is aware that Hansons was fined $1034.50 by the Court for conditional selling of 1litre packets of Rewa Life milk. Last year our market surveillance found a dirty spice section at the store and requested them to take necessary action. The Council's market surveillance and complaints from consumers in the past several years have also found other issues such as absence of price tags on some items and half-cut rotten fruits being re-packed for sale. The Council finds it rather nave for Hansons to publicly declare itself as a trader that has substantial goodwill and reputation and that it will continue providing the excellent service that it has been doing so over the years. The below standard of services and problems associated with this supermarket has led the Council to include Hansons as a must-checktrader during its regular market surveillance. The bad practices by Hansons are also a major concern for the Council because of the fact that it serves an area densely populated by ordinary and low-income consumers. The Council is aware of other supermarket chains that have branches located in similar areas and take advantage of the situation by engaging in unscrupulous business practices.

PLANS for the construction of a bridge to connect Vanua Levu to Viti Levu have been cancelled. Divisional planning officer north Alipate Bolalevu confirmed the plans had been dropped after considering a number of factors surrounding the project. The initial plan was to build a bridge

5 Year Old Waits For Mum


"My mum will come back next week." These were the words echoed by a fiveyear-old girl to her family whose mother was brutally slain during a family dispute at Naisaumua Village in Tailevu. The incident happened at 6am when 33-year old wife Kasaya Veisei was stabbed with a kitchen knife several times on a bridge in the village and her body thrown into the creek below. In an interview, Veisei's cousin Lusiana Qionimacawa said Kasaya's assailant was drinking grog with the whole family until around 5am. She and Kasaya then went to sleep. After 10 minutes her assailant called her from outside the house, Ms Qionimacawa said. "My cousin (Kasaya) knew that something would happen so she asked me and another cousin to accompany her," she added. Ms Qionimacawa said while they were walking, a kitchen knife fell from a knapsack the assailant was carrying on his back. She said that was the time when an argument broke out between the two and Kasaya was stabbed. "When we saw my cousin stabbed with the knife, we started shouting to alert the village," Ms Qionimacawa said. "The last word that Kasaya uttered was 'sa oti' (it is finished) and she was no more," she said. Ms Qionimacawa said after throwing the deceased in the nearby creek, the man fled the scene. She said her cousin had four children and was a woman with a big heart. "Her eldest child was 14-year old and the youngest five-years old. They are safe and are staying with us," Ms Qionimacawa said. "We will miss her a lot. She was one of the best in our family," she said. The incident has left the whole village in a state of shock and people are living in fear. Police spokeswoman Ana Naisoro said police had erected roadblocks along the Kings Rd as the hunt continues for the man.

It Can Change - RFMF


The Republic of Fiji Military Forces (RFMF) has maintained that changes can be made to the draft constitution that has been presented to the President by the Constitution Commission. However, RFMF Land Force Commander and military spokesman Colonel Mosese Tikoitoga says changes to the document prepared by the commission led by academic Yash Ghai will have to be made via the soonto-be set up Constituent Assembly. As an example, Colonel Tikoitoga said people should not forget the draft and the process of Fijis third Constitution. There was a good draft prepared by Sir Paul Reeves in 1997. But, it was merely that, it was a draft that was handed over to the Parliamentary Select Committee, who re-wrote it and came up with the 1997 Constitution, he said. Colonel Tikoitoga said Fijians needed to remember that this was just a draft which has now given them a basis to discuss and debate a Constitution for Fiji and Fijians. A draft is just a draft. It has given us a base to work on but the main responsibility of putting together a Constitution which is good for Fiji will depend on the Constituent Assembly, the Chair of which is yet to be named. The 1997 draft Constitution: The difference is between the draft and the final constitution and people should not assume that the draft would be accepted in its current form. It is just a draft and the process through the Constituent Assembly would determine the final outcome, Colonel Tikoitoga said. All arguments, whether it is the RFMF argument or any other submissions, we will again make another attempt before the Constituent Assembly and debate what is best for Fiji. Colonel Tikoitoga said they were grateful that there was a draft that people could work on. We are grateful that we have a draft that we can work on but RFMF wants to state that it is just a draft and improvements on the draft will be made by the Constituent Assembly, so that we have a Constitution which is good for Fiji and Fijians and would last for 100 years and not have people changing it every year. The Reeves Commission presented its draft report, containing 697 recommendations, to the then President on September 6, 1996. The report was subsequently tabled in Parliament, at a joint sitting of the Senate and the House of Representatives. A parliamentary committee then worked on the draft and presented the 1997 Constitution. Colonel Tikoitoga said in 1997 reference had not been made to the draft constitution, as opposed to what is being done now. There was no reference of the draft then, whereas in this case, everybody is making reference to the draft. Call for temporary bodies, not a permanent solution Colonel Tikoitoga said the section in the draft which calls for the formation of a National Assembly and the Great Council of Chiefs are some of the issues which has no place in a Constitution. The National Assembly is just a temporary body and you cant put that in a Constitution unless you have already considered the Constitution as a temporary document, he said. If you want a Constitution that lasts, it needs to be a permanent document based on generic principles and it should not have temporary bodies as part of it. The formation of the Great Council of Chiefs, he said, was another such body, which had no place in the Constitution. That can come out of the iTaukei Act, but it should not be in the Constitution, Colonel Tikoitoga said. These are some of the things that are making this draft Constitution seem like it is more of an academic paper rather than the constitution of a country. This is written more like an academic paper rather than a legal document. Need for 71 Parliamentarians questioned: Colonel Tikoitoga also questioned the need to have 71 parliamentarians for a country with 800,000 people. The draft suggests that as in the 1997 Constitution, 71 seats be contested for the Parliament. Colonel Tikoitoga said on ratio, this would mean Fiji would have one of the largest Parliaments in the world. The RFMF had made submissions for 46 seats after studying the Parliament structure of our neighbours Australia and New Zealand together with other countries. Our 46 was based on actual rationale, on other parliaments in the World. The electoral system we want is an open system, Colonel Tikoitoga said. THE Australian government has welcomed the completion of Fiji's new draft constitution despite a bitter row between Yash Ghai, the chairman of the constitutional commission, and the Fiji military government. "The draft constitution is a substantial document and another step along the path towards Fiji's return to democracy," a spokeswoman for the Department of Foreign Affairs and Trade said. "The strong interest of the people of Fiji in the commission's work was shown by the very large number of submissions it received - over 7000. "The Fiji police have confiscated printed copies of the draft constitution, but it is now available on websites. Some political parties and individuals have already commented on it publicly." Confirming the extent of the antipathy between the government and internationally respected constitutional expert Professor Ghai, Fiji's Information Secretary Sharon Smith wrote a letter to the editor of The Australian, published today, saying the professor's request for copies of the draft constitution to be printed was "contrary to law". Ms Smith writes that police burned printers' proofs "for security reasons", in an action taken "to preserve the integrity of the constitutional process". She said that 599 copies of the constitution "were sequestered by police on the government's instruction". Three of the country's largest political parties, the Soqosoqo Duavata ni Lewenivanua (the United Fiji Party), the Fiji Labour Party and the United People's Party, have said they support the new draft constitution. Jenny Hayward-Jones, the Lowy Institute's Pacific expert, said yesterday "it is the right thing at this stage" for the Gillard government to help keep the constitutional and democratic momentum going in Fiji. Despite the falling out between the Fiji government and the constitutional commission, she believes "it is unlikely they would try to start again" with a fresh constitution, and that it remains strongly likely that the Constituent Assembly will frame its discussions around the draft completed by Professor Ghai and his colleagues. She described Professor Ghai as having "unparalleled expertise" in drafting constitutions, in often extremely challenging settings. "(Interim Prime Minister Frank) Bainimarama appeared to be concerned that he seemed to have ceded some control over the process to Ghai, which through the recent chain of events he seems to have regained," she said. Ms Hayward-Jones said much depended on who was appointed to the Constituent Assembly.

Captain Cook: Full Cruising Ahead

Its a story of perseverance and finally success. Captain Cook Cruises Fiji is now reaping the rewards of investing into cruise trips to the North despite the odds against them Captain Cook Cruises developed seven-night Discovery Heritage and Discovery Cultural cruises. Managing director Commander Semi Koroilavesau said the company had an exceptional year in 2012. We did well especially coming towards the end of the year. We noticed that business was greatly improving especially on our cruises to the North, Commander Koroilavesau said. The light-bulb moment The idea of developing new routes for cruising, Commander Koroilavesau said, came about from requests of returnees who wanted to see more of Fiji. Commander Koroilavesau said: We have been operating cruises to the Yasawas for 18 years and it was time to give our passengers something new. So thats how we developed the two North cruises. The seven-night Heritage Cruise takes tourists aboard the companys flagship; MV Reef Endeavour to explore Savusavus hot springs and markets, Taveuni, nearby islands and historic Levuka. The Cultural Cruise explores the islands, rivers and rainforests of the North like the Kioa and Rabi islands, the Labasa River and up the Dreketi River. He said at first the company was making a loss because the cost of such a cruise was huge and the returns were not good. At times there would only be 40 to 50 people on board and we lost a lot

of money because we had to travel a longer distance and burned more fuel than our Yasawa trips. It became a huge cost for us but we continued to be true to our commitment and it soon paid off and we began to do better, he said. Last year a total of six trips were made to the North and Commander Koroilavesau said the company has planned nine such trips this year with the ninth being the debut of an 11-night Lau Cruise. New Lau Cruise Commander Koroilavesau said: There was a lot of awareness after we began operating our North cruises and it attracted a lot of our international visitors. After a period of time a lot of locals also became interested in these cruises and thats exactly how the Lau Cruise was created. Then we started to get calls and written requests from people in Lau inviting telling us to visit their island as well. A lot of work has to gone into the planning the Lau cruise which is scheduled to be launched on October 22. Hard work ahead We have to develop an itinerary and then take one of our ships to these islands and meet with the villages to discuss and plan for the trip. Im hoping that at least by the end of next month we would have visited all the islands, he said. It certainly has its work cut out for the New Year but one thing is for sure; Captain Cook Cruises is pushing the boundaries in tourism. Its success has proved that perseverance comes at a cost but does pay off in the long run.

PRIME Minister Commodore Voreqe Bainimarama has confirmed receiving a letter of complaint from parents of protesting students at Labasa SKM College. Commodore Bainimarama said the letter was forwarded to the Education Ministry for necessary action. The letter contained queries about the ministry's decision to award zero to 11 students' Fiji Seventh Form biology exam results. The parents also expressed outrage at the ministry's decision not to reveal the findings of an inquiry team that looked into the issue. A representative of the protesting party, Rajesh Lal, claimed that in making such a decision the ministry was trying to hide proof that was fundamental to those concerned. "At least the findings should be let known to the schools, the students and

the parents concerned," said Mr Lal. "We need to know the terms of reference for the investigations as well. Fiji suffered less damage from Cyclone Evan because of better preparation, says the country's interim Minister for National Disaster Management. A state of disaster was declared after Evan hit the Pacific island nation last month, causing widespread damage to several cities and forcing thousands of people to flee their homes. Lieutenant Colonel Inia Seruiratu says preparations began as soon as the cyclone watch was started by the Fiji Weather Service. He told the Australian media that Fiji is putting less emphasis on recovering from disasters, and more on minimising the risk of damage. RFMF Supports All Fijians Farmers Prepare For Cane Season


The Republic of Fiji Military Forces (RFMF) started Fijis new journey and will see that it continues until the 2014 elections, a top officer said. Land Force Commander Colonel Mosese Tikoitoga has urged members of the public to bear with the military. The RFMF supports all Fijians and will at all times protect them and I urge you all to bear with the military until the 2014 elections, Colonel Tikoitoga said. He said critics of the military like Mick Beddoes can carry on with their criticisms against the RFMF but the militarys work would not be affected. Colonel Tikoitoga said Mr Beddoes criticism was baseless and his politics was for the old Fiji and not the modern Fiji. He said in the last parliament, it was corrupt leadership that led the military to take over leadership. After the change of leadership in 2006 reforms were put in place to build a better Fiji for all. THE RFMF TALKS ON ISSUES With regard to the RFMF releases on the draft constitution, Colonel Tikoitoga said they talked on issues. He said one of the major issues the Government and the military had championed was the reforms and they would like to see that happening especially when they had brought changes effective to the people. As for Mr Beddoes (United Peoples Party) and the Fiji Labour Party, they were speaking on things that only promoted themselves, he said. They should ask themselves if they have the support of the people they are claiming they represent. In his latest attack on the military Mr Beddoes said, I consider the Land Force Commanders claim that the military are, (quote); the last bastion of defence for the people of Fiji and that there is an enveloping comfort that the force exists to deal with both internal and external threats (unquote), to be delusionary nonsense. The truth is, since independence there has only been one clear and present danger to our people, their lives, rights and liberties, property and economic prosperity and that threat is internal and our people have been subjected to its brutal imposition on three separate occasions in 1987, 2000 and 2006 and this threat comes from the very institution that the Land Force Commander would have us believe is our last bastion of defence. It is hypocrisy of the highest order when the very institution that carried out or supported the forceful removal of our elected governments of 1987, 2000 and 2006 should attempt a cosmetic makeover in an attempt to represent itself as quote the last bastion for law and order in Fiji unquote. Colonel Tikoitoga said one of the reasons why the 1997 Constitution was abrogated was because it promoted discrimination. This old politics is again promoted by these political parties and the Land Force Commander has reminded them that their politics is for the old Fiji and not the Fiji that Government is currently building. RFMF TO RETURN TO THE BARRACKS AFTER POLLS The RFMF will continue its support for the Government until a new government is democratically elected in 2014, he said. Only after the elections will the soldiers return to the barracks. Utilising weather change Meanwhile, a cane farmer in Seaqaqa said the change in weather from sunny and dry to wet and humid should bring out the best in his farm as he waits for the crushing season to begin. The 13-acre cane farm owner, Mohammed Rafiq, believes farmers need to find ways in which they could benefit through the change in weather. This time of the year when it becomes wet, people should plant more rice but then sugarcane will also grow more quickly and longer also, Mr Rafiq said. Mr Rafiq is also excited about the cane crushing season coming soon as his crops would be ready by then. Sara Ege: Life Jail For Son's Murder Over Koran Studies
A mother who beat her seven-yearold son to death when he failed to memorise passages from the Koran has been jailed for life, for a minimum of 17 years. The judge told Sara Ege, 33, she subjected Yaseen Ege to prolonged cruelty and a ferocious beating at home in Pontcanna, Cardiff, in July 2010. She also set fire to his body, and was convicted after a five-week trial. Ege collapsed as the sentence was read out at Cardiff Crown Court and had to be helped from the dock. She was also found guilty of perverting the course of justice and given a fouryear sentence for that crime. Her husband Yousuf Ege, a taxi driver, was cleared of allowing the death of a child by failing to protect him. Sara Ege had pleaded not guilty to murder and claimed her husband was responsible for Yaseen's death. 'Prolonged cruelty' Mr Justice Wyn Williams said: "I am satisfied that it was his failure to learn the Koran that day that resulted in the beating that caused his death." He continued: "On the day of Yaseen's death you had kept him home from school so he could devote himself to his study of the Koran. "He was memorising passages but on that day Yaseen must have failed in some way and it was that which was a trigger for the beating. "You killed your own son. At the time of the killing he was particularly vulnerable because of his age and because of his relative physical frailty "In killing your son you abused a precious relationship of trust which does and should exist between a parent when I left him," she said. "He was still murmuring the same thing over and over again. I thought that he was just tired." When she returned 10 minutes later she said she found her son shaking and shivering on the floor. He then died. She then used barbecue gel to burn her son's body in an attempt to hide the evidence. The mother also confessed to beating her son for no reason and that her anger often led to her being out of control. She and her husband had enrolled Yaseen in advanced classes at their local mosque as they wanted him to become Hafiz - an Islamic term for someone who memorises the Koran. As a child Sara Ege had taken part in competitions showing her knowledge of Islam and had recited from the Koran. The court heard that she had become increasingly frustrated with her son's inability to learn the passages. She told officers: "I was getting all this bad stuff in my head, like I couldn't concentrate, I was getting angry too much, I would shout at Yaseen all the time. "I was getting very wild and I hit Yaseen with a stick on his back like a dog." She later retracted her statement. The trial heard that Yaseen suffered significant abdominal injuries that were the cause of his death. They included fractures which were non-accidental. He also had numerous historical injuries. "Sara Ege made no attempt to seek the medical attention he so obviously needed," the court was told during the trial by prosecutor Ian Murphy.

In another move to protect Canadas borders, Kenney, under the Protecting Canadas Immigration System Act, introduced biometric measures the collection of fingerprints and photos from applicants in 29 countries, including Afghanistan, Bangladesh, Burma, Colombia, Democratic Republic of Congo, Haiti, Iran, Jamaica, Jordan, Haiti, Pakistan, Vietnam and Yemen. This fingerprint information will be sent to the RCMP for storage and will be checked against the fingerprint records of refugee claimants, previous deportees, persons with Canadian criminal records and previous temporary resident applicants before a visa decision is made. must now provide proof of language proficiency in English or French before they can apply for citizenship. The new regulation will affect candidates between the ages of 18 and 54. Immigration officials will return applications of those who do not provide evidence of proficiency. Kenney announced in September he would be revoking the citizenship of 3,100 people mostly from the Persian Gulf States who had lied about their residency and failed to reside in Canada for three of the four previous years when they applied for citizenship. The announcement came after the creation of an immigration fraud tip line in 2011. Temporary Foreign Workers Rules surrounding temporary foreign workers were radically rewritten. Close to 191,000 temporary foreign workers

came to Canada in 2011, 67,000 in Ontario. Changes were made to allow employers to pay temporary high-skilled foreign workers up to 15 per cent less than the prevailing local wage. In the case of low-skilled workers, its 5 per cent less. In December, Ottawa eliminated the special parental benefits for foreign migrant workers who contribute an estimated $3.4 million to the countrys employment insurance system. This means 30,000 migrant workers who are employed under the Seasonal Agricultural Workers Program are not eligible to take leave and collect any benefit while caring for newborns or sick children. Migrant workers have never been eligible for full EI benefits but previously they could access special benefits for up to 35 weeks even if they were outside of Canada.

Encouraged by his girlfriends mother, a New Zealand man spent his Christmas building a colourful igloo in Edmonton. Home for the holidays from her studies at the University of Canterbury in New Zealand, Kathleen Starrie brought her Kiwi boyfriend Dan Gray to stay with her family. Starries mother decided to put Dans civil engineering studies to a test while teasing him that if he wanted her daughters hand in marriage, he needed to construct a real igloo out of ice blocks. The result was astounding. Its beautiful, what the kids came up with, said Brigid Burton, Starries mother. He wasnt going to be here very long and it was actually an idea I had many years ago, said Brigid. Dan kind of ran with it and did it and him and Kat worked wonderfully together. Its kind of gone viral and its fun. Brigid spent months collecting milk cartons from friends and co-workers to freeze the ice blocks and colour them with different dyes. Working with a mixture of snow and hot water the happy couple dubbed Snowcrete, the family spent the better part of five days building and tilting the over 500 ice blocks into an igloo Brigid says resembles the colours of the northern lights. Now, Brigid says her grandchildren look forward to coming over and playing inside the igloo. While she expects the ice to melt away in May, shes happy to have a colourful reminder of Kathleen and Dans Christmas visit right outside of her window.

Starting Feb. 15, 2013, and over the next five years, eligible British Columbians between the ages of 19 and 74 will be required to replace their CareCard with the new BC Services Card by renewing their enrolment in the Medical Services Plan. The current CareCard was introduced in 1989 and has not been significantly updated over the last 20 years. The new BC Services Card takes advantage of significant advances in technology since that time, to provide a more convenient and secure piece of identification with enhanced features to protect citizens' personal information. The new card is more secure as it includes a photograph of the beneficiary, anti-forgery features, identity proofing and an expiry date. The card can also be combined with a driver's licence and acts as photo IDmeaning one less card to carry. To get a new BC Services Card, eligible British Columbians can simply enrol when renewing their driver's licence. People who do not drive can still enrol

at the nearest location where driver's licences are issued. Once a person enrols, they will be issued a new BC Services Card, or a combined card, and will need to re-enrol every five years. Children and certain groups of adults, such as the elderly or those in residential care or extended hospital care - for whom renewed enrolment would be impractical or present a hardship - will be exempted from re-enrolling or managed through special arrangements. The BC Services Card also provides the foundation for supporting the potential future development of more convenient access for citizens to new online government services. Government first announced plans to roll out a replacement to the CareCard in May 2011 when amendments to the Medicare Protection Act were introduced to support the introduction of a more secure card, designed to improve patient safety. Edmonton Police and the Canadian Anti-Fraud Centre are warning people not to be taken in by an apartment rental scam on Craigslist and other want-ad websites. The scammers lure their victims with attractive ads for rental apartments, condos and houses. The victims are told the owner has been transferred out of town and they will get the keys once they send a damage deposit via Western Union. The apartment may actually exist but the ad is fake, made up of images plucked from other sales or rental websites. Were seeing it come up quite often," said Det. Bill Allen of Edmonton Police Services economic crimes section. "Weekly were fielding phone calls from complainants who have been victimized." Afghanistan veteran victim of scam Capt. Rebecca Evans, 30, thought she had found the perfect condo on Craigslist. It was nearly new, loaded with amenities and a short drive from the Edmonton Garrison where she is stationed. She responded to the email address listed in the advertisement and received a reply from someone calling himself Leo Jeffrey. Jeffrey asked for more information about her as he was looking for a tenant who would take good care of the condo. So I thought, I want to win this and I gave him a big overview of who I am, where I work and tried to convince them I was a mature, responsible renter, said Evans. Evans then received an email informing her she had been accepted and would receive the keys once she wired $800 for the damage deposit. Jeffrey told her he had been transferred to the U.S. and had taken the keys because he and his wife had only just made the decision to rent out their Edmonton condo. Evans agreed to send the $800, and was then conned out of another $1,000 for the first months rent after being given a tracking number with the company shipping the keys. The shipping company and its website were also bogus. It was only the beginning of a scam that would eventually cost her $2,800. He sounded like a legitimate family man, and I could hear a baby crying in the background," she said. "I really thought it was authentic. He was saying God bless at the end of the emails, and I took that as a sign of some humanity there. Scammers experts at manipulating emotions Every scammer loves to take advantage; theyre pretty heartless (and) go after the vulnerable where they can, said Daniel Williams of the Canadian AntiFraud Centre in North Bay, Ontario. The scammers know the psychology of gaining trust. Theyve had a lot of practice doing what they do. Williams says scams such as the one that caught Evans are complicated. The real mastermind is separated from the expendable runners who claim the money at Western Union, and may not be in the same country. The scammers hide in the anonymity of disposable cell phones and email accounts. The complexity of it does indicate that it has to be organized crime. Its way too much work for an individual to do. Scammers apparently believe Edmontons rental market is fertile ground. Even experts can be scammed "Theres no golden rule on how not to be a victim, said Det. Allen. Policemen have found themselves to be victims, and we're supposed be trained to look for these things. There are however, some trademarks to watch for in the apartment scam, especially people who wont meet face to face, claiming theyve been transferred out of town. Many of the scammers have an imperfect knowledge of English poor grammar and spelling are red flags. Experts warn never to use Western Union, Money Gram or other wire services to send money to people you dont know well as the money will be never be recovered. In a new twist, scammers get you to wire money to yourself or a family member. In a matter of hours someone claims the money using fake identification. Experts also warn potential renters to never rent a property without physically touring the suite and being satisfied the person you are dealing with is the actual owner.

Backcountry enthusiasts warned of high avalanche danger
Authorities around British Columbia have been forced to close sections of highway because of avalanche control measures. The road closures were announced Tuesday as Environment Canada issued snowfall warnings across southern B.C., noting accumulations were expected to surpass 20 centimetres in some areas. According to DriveBC, the following sections of highway were closed Wednesday morning because of a high avalanche hazard or heavy snowfall warnings: Highway 1 four kilometers east of Yale. Highway 1 at Jackass Mountain Summit. Highway 1 from Hope to Jackass Mountain Summit. Highway 1 27 kilometres west of Revelstoke to nine kilometers west of Revelstoke. Highway 1 in Glacier National Park. Highway 3 from Hope to Allison Pass Summit. Highway 3 five kilometres west of Kootenay Pass. Highway 5 from Hope to Merritt. Highway 5 from Merritt to Logan Lake. Highway 5A 20 kilometres north of Princeton. Highway 31 12 kilometres north of Trout Lake. Highway 97C from Merritt to Pennask Summit. Avalanche technicians are expected to start an assessment of the danger of slides on the Coquihalla. "Once they have had a chance to look at it they will make a decision on whether there is control needed or not and we will make that decision," said Bob Gilowski with VSA Highway Maintenance, which maintains much of the Coquihalla and the Okanagan Connector. "With this closure, our maintenance crews are still permitted to work in this closure area so when the road does open the road will be in great shape for travellers." Meanwhile, the Canadian Avalanche Centre is warning back country enthusiasts in the Columbia Mountains, Kootenay-Boundary and around Whistler to use extreme caution because of the high avalanche danger. We've got a lot of new snow and in some places it's rested on these layers we are concerned about, said forecaster Ilya Storm. For advanced users you can probably work around in the mountains fairly well as long as you stay to gentle terrain. If you have less training you may want to stay within ski area.

An MRI scanner damaged when Surrey Memorial Hospital's ER was flooded in November will be replaced and not repaired. Fraser Health officials say they decided against fixing the old scanner at a cost of about $700,000 because it's 11 years old and at the end of its useful life anyway. The insurance payout for the repair costs will instead be put against the estimated $2 to $3-million cost of a new MRI scanner and shield, said Fraser Health executive director Rowena Rizzotti. "We were scheduled for a replacement [MRI] in the new year," she said. "To invest in a repair that would then be replaced would not be as cost-effective." On January 5th, 2013 at approximately 7:30pm, Surrey RCMP were advised of a motor vehicle collision at the intersection of 138th Street and 92nd Avenue. B.C. Judge Certifies Class-Action Lawsuit Against Lottery Corporation


Two problem gamblers who enrolled in a program that barred them from government-run casinos can go ahead with a class-action lawsuit to try to get their winnings back, says a B.C. Supreme Court judge. In a ruling released Wednesday, Judge John Savage said the proceedings could resolve common issues raised by Michael Lee and Hamidreza Haghdust who argue the British Columbia Lottery Corp. "wrongfully withheld" approximately $42,000 and $35,000 they won, respectively, while participating in the voluntary selfexclusion program. The program allows problem gamblers to register so they're barred from the corporation's facilities for a specific period of time. While he didn't rule on the substance of the lawsuits, Savage also said an identifiable class of two or more people exists, and a plaintiff is available to represent the interests of the class. "A class proceedings is the preferable procedure for the fair and efficient resolution of these common issues," he said. According to the court document, the men have problems controlling their gambling urges, and each registered for the program, with the first one-year term beginning in 2006 and the second three-year term beginning in 2007. Both signed the voluntary-exclusion form, which at the time did not include any provisions that notified registrants they would forfeit any winnings, according to Savage's ruling. Despite signing the forms, the men continued to gamble at corporation facilities, with Haghdust losing about $200,000 and Lee losing about $30,000. On Sept. 25, 2009, Haghdust won a $15,000 jackpot at a Coquitlam, B.C., casino, and on June 15, 2010, he won $20,028 at a casino in Vancouver. Meantime, Lee won a $42,484 jackpot at a casino in Duncan, B.C., on Jan. 10, 2010. Even before he won his first jackpot, Haghdust was excluded from corporation facilities nine separate times, states the court document, and between Aug. 6, 2010 and the expiry of his second exclusion term, he was removed from corporation facilities five more times. Lee was asked to leave a casino once before he won his jackpot. Their lawyer, Paul Bennett, said the exclusion program is flawed because it allowed his clients to lose, but never win. "That's why it's a penalty. People come into the casino, they gamble, they lose their money, but when they win they can't win." Bennett expects the corporation will likely appeal the certification decision. A date has yet to be set for the next court appearance, but Savage has asked the plaintiffs to develop a casemanagement plan to move the action forward. The ruling noted that between June 4, 2010, and July 4, 2012, the corporation withheld 187 jackpot prizes from program participants.

Black Ice' Blamed For Oregon Bus Crash


The lawyer for a Vancouver bus company involved in a deadly Oregon crash says black ice, not driver fatigue, was responsible for the tragedy. Nine people died and 38 were injured Dec. 30 when the tour bus owned by Mi Joo Tour & Travel Ltd. crashed near the northeast Oregon community of Pendleton. "Black ice was a significant factor in the cause of the accident," said Scheer Wednesday evening. "It appears that the area in question near Pendleton, Ore., ... has a history of traffic incidents, and there were other accidents in the area close to this one involving black ice on Dec. 30, 2012." The U.S. Department of Transportation on Tuesday pulled the company's authority to operate saying it had determined the bus driver had spent 92 hours operating the bus over the eightday trip. Scheer says the bus driver had about seven and one-half hours of sleep the night before the crash, and that morning had only been on the road for about two and one-half hours, including a rest break. He says the bus driver had a good safety record, is in good health, doesn't use alcohol or tobacco, and there is no evidence to suggest alcohol or drugs played any role in the crash. Two of the surviving passengers have filed a lawsuit in Washington against the bus company, alleging the driver should legally not have been behind the wheel due because he had worked too many hours.

Five Canadians Lose $200,000 In Automotive Scam


Several Canadians who thought they were buying a luxury car online are out $200,000 after it was discovered that the purportedly U.S.-based company may not actually exist. Authorities say American scammers have been targeting Canadians because cross-border prosecutions are more difficult. Any time you have a jurisdictional border between the victim and the criminals its a massive headache, said Daniel Williams, a supervisor at the Canadian Anti-Fraud Centre. It will sadly always work to their advantage. The centre has passed information along to law enforcement agencies in the U.S., but its up to them to decide if they have resources to devote to an investigation, he said. Alleged victims likely wont get their money back. The possibility is there, Williams said. From what we see, the track record for it isnt encouraging. Advertisements of luxury vehicles appear on the Canadian websites of AutoTrader, eBay, Craigslist, Kijiji and Wheels.ca at prices regulators say are too good to be true. At least five Canadians fell victim to one such ploy, the Ontario Motor Vehicle Industry Council said Tuesday. Terry OKeefe, a spokesman for the council, said those people came forward to say they had lost tens of thousands of dollars each after arranging to buy cars through Ambient Auto Centre, which said it was in Oklahoma. The cars never came and those people havent been able to get their money back. Shortly after the council publicized a fraud warning last month Ambients website disappeared and their phone number went dead. The address Ambient had on their website led authorities in Oklahoma to an empty field. Two weeks later Sprint Luxury Autos started advertising on the same websites and their homepage looked nearly identical to the former Ambient site, OKeefe said. The physical address listed on that website led to a Sprint telecommunications building in Oklahoma, he said. The council issued another news release warning Canadians about online auto frauds and named Sprint, OKeefe said. Shortly after that the Sprint Luxury Autos website went down. Now, the council believes a company called Husen Original Autos may be related. It is advertising luxury vehicle sales in the same forums, has a website that looks almost exactly like the former two in design and in wordings and testimonials, OKeefe said. A call to the number listed on Husen Original Autos website goes to a voicemail for Sprint Luxury Autos but a message left there was not returned. U.S. authorities say Husen Original Autos is not licensed and has no physical presence the address listed on their website is actually a community centre in Phoenix, Ariz. OKeefe points to various websites for legitimate motor vehicle dealers on which pictures that appear to match pictures of cars listed on Husen Original Autos website can be found. Pictures of a 2011 Maserati GranTurismo S listed on Husen Original Autos website for $95,000 appear to be the same as ones for the same car listed for $135,000 on the website for Eurospeed Imports, which OKeefe said is a legitimate dealer in California. Some fraudsters use luxury cars to entice victims from abroad because, OKeefe said, people arent likely to pay to have a five-year-old Honda Civic shipped to them, but they might if they think theyre saving tens of thousands of dollars on a luxury car. The best way to prevent these problems from occurring is to educate consumers so they understand that if a price looks too good to be true, well, you know, that shouldnt be seen as an opportunity, OKeefe said. Thats a warning because it is too good to be true. No one is going to sell a $135,000 vehicle for $90,000. The alleged victims in this case come from across Canada and are reporting the incidents to their local police forces, so O'Keefe urged anyone who thinks they may have fallen prey to such a scam to also contact the Canadian AntiFraud Centre jointly managed by the RCMP, Ontario Provincial Police and the Competition Bureau Canada.

Bottled Water Not So Healthy


Though health-conscious fitness enthusiasts are never seen without bottled water, and it is subject to less stringent safety tests than tap water, the bottled variety is much more likely to be contaminated, says a new study. Bottled water costs more than tap water but is more likely to become a source of infection, the reporter cited a study by market researchers. On average, Britons drink 33 litres of bottled water annually, whether ordinary mineral, fizzy, or 'purified' tap water. Almost a quarter of people who drink bottled water at home say they do so because they believe it is better than tap water. But what consumers do not realise is that tap water is checked daily under a rigorous inspection regime. It also contains trace amounts of chlorine that prevent the spread of anything harmful such as bacterial infections. In contrast, makers of bottled water are only required to undertake monthly testing at source. Once filled and sealed, a bottle of water might remain in storage for months before it is sold. Bottled water contains no disinfecting additives such as chlorine. After a bottle of water is opened, it has no way of remaining sterile, and so must be drunk within days. Batches of bottled water have had to be removed from British supermarkets because of questions over contamination. In 1990, a firm had to withdraw millions of bottles worldwide after traces of benzene were found in the water.

Ranbir Kapoor bagged the Zee Cine best actor awards for the film Barfi! and Vidya Balan won the best female actor awards for Kahaani. Jaya Prada was born as Lalita Rani (born April 3, 1962) is an Indian film actress and politician. Jaya Prada was born in a middle-class home; her father was a Telugu film financier. Her mother enrolled her in dance and music classes at an early age. She was fourteen years old, when she gave a dance performance at her school. A film director and producer K.B Tilak was in audience and he offered her a three-minute musical number in a Telugu film Bhoomi Kosam (1976). She was hesitant but her family encouraged her to accept it. The rushes of those three minutes of film were shown to the major figures of the Telugu film industry, and the floodgates opened. Big-name directors approached her with leading roles in good movies and she accepted them. She became a major star in 1976 with huge hits: K. Balachander's Anthuleni Katha showcased her dramatic skills; K. Viswanath's Siri Siri Muvva showed her playing a mute with excellent dancing skills; and her title role as Sita in the big-budget mythological film Seetha Kalyanam confirmed her versatility. In 1977, she starred in Adavi Ramudu, which broke box office records and which permanently cemented her star status. The song "Aaresukoboyi Paresukunnanu" picturized on her and co-star N.T. Rama Rao became a classic hit. She branched out to star in Tamil, Malayalam, and Kannada films, and had hit films in all of them. K. Viswanath remade Siri Siri Muvva (1976) into the Hindi film Sargam and introduced Jaya Prada to Bollywood in 1979. The film became a huge hit and she became an overnight star there as well. She earned her first Filmfare nomination as Best Actress but couldn't capitalize on her success as she couldn't speak Hindi. It took three more years before director K.

Vishwanath relaunched her again in Hindi films, with the hit film Kaamchor (1982) where she spoke Hindi fluently for the first time. She was now able to consistently work in Hindi films and earn two more Filmfare nominations as Best Actress for playing Amitabh Bachchan's endearing girlfriend in Prakash Mehra's Sharaabi (1984) and for her challenging double role in K. Vishwanath's Sanjog (1985) with Jeetendra. Along with her Bollywood film career, she continued to star in acclaimed films in the South, such as K. Vishwanath's Telugu hit film Sagara Sangamam (1983). She earned fans, not just with the masses, but also with the great Indian director Satyajit Ray, who has said she was one of the prettiest women in the world. Although, she has acted in Bengali films, she has never worked for Ray. (She claimed that Ray had her in mind for a film, but his illness and subsequent death prevented their collaboration.) Jaya made a successful team, not just with Amitabh Bachchan and Jeetendra, but also with her immediate screen rival Sridevi, with whom she has acted in about a dozen films. Their hit Telugu film Devata (film) (1982) where they played sisters who made big sacrifices for each other, was remade into the hit Hindi film Tohfaa (1984). These films endeared Jaya Pradha to the traditional conservative section of filmgoers. It was an image that would serve her well when she started a new career as a politician. She and Srikanth do not have any children together, even though she has expressed a desire to have children. She also said that she and her husband's first wife Chandra cannot live without Srikanth and have cordially agreed to share him together.

Bollywood superstar Amitabh Bachchan is in trouble. His earnings and paid tax amount have been questioned by the Income Tax Department. Tuesday the Supreme Court took up the petition that was filed by Income Tax Department that claimed that the superstar owes Rs 1.66 crore as his tax amount solely from the income he amassed by hosting the reality quiz show KBC during the year of 20012002. The bench of Justice Madan B Lokur and Justice DK Jain issued a notice to the actor seeking response against the petition that was filed against an order that was issued in the Bombay High Court. The order dismissed the IT departments plea that defied the exemption that was granted to Bachchan in the year 2010 by the Income Tax Appellate Tribunal (ITAT). The IT Departments plea was dismissed by the Bombay High Court on the 29th of February, 2012. The petition of the Income Tax Department has claimed that the actor has produced only Rs 3.23 crores as his taxable income meant for

A similar kind of plea is also pending since the month of May 2009, in Apex Court which too had issued a notice to the star. In the year 2008, High Court had permitted an IT exemption of 30% of the stars gross income of Rs 50.92 that he had collected from the show. The actors plea was accepted that claimed that he was an artiste and thus was entitled to get a tax relief under the Income Tax Acts Section 80 RR. The Income Tax Department, on the other hand, had challenged such a decision on the grounds of the relief being for those artistes who were earning either by performing outside their country or was receiving payment from other foreign agencies. Thus Bachchan who was the host of Kaun Banega Crorepati was working in the show that was part of Star India Ltd., and thus is not applicable for such a tax relief.

The film is slated for a world-wide release on January 11th, 2013 Plot Set in the rustic surroundings of a village in Haryana, the film is a comedy-drama about Harry Mandola (Pankaj Kapur), a wealthy industrialist who loves his drink, his daughter Bijlee (Anushka Sharma) and the unusual bond they both share with Harrys man friday, Matru (Imran Khan). Matru studies LLB in Delhi University but does not get a job upon graduation and returns to his village to take up his family profession of serving the Mandola family. Also, he loves Bijlee. Bijlee later goes to Oxford University to study and falls in love with Baadal (Arya Babbar), the son of a powerful politician, Chaudhari Devi (Shabana Azmi), and much to her father's delight, Bijlee is all set to marry Baadal. Shahid Kapoor was later approached by Bhardwaj. Imran Khan was then approached and was officially confirmed for the male lead role. The first trailer of the film was released in October 2012 on YouTube which created a lot of buzz due to a bold act by Anushka Sharma. About her character in the film, Anushka says, I play a strong headed, outspoken girl in the film. My look highlights the bold approach of the character. The actress however seemed more appreciative of Imrans look. She quoted "Imran looks hot". One other thing which caught the attention of people was the pink buffalo, "Gulabi Bhains". In the movie, Anushka Sharma will be sporting a tattoo on her lower waist which reads "Dekho Magar Pyaar Se", which was unveiled in a press conference on December 4, 2012. The Censor Board of India gave the film 'A' (Adult) certificate which director Vishal Bhardwaj refused. Therefore The Film was rechecked and was given U/A Certificate by the Censor Board of India. At The Movies Promised Land (G) * * * *


Small town America versus corporate greed is just one of the themes explored in Promised Land, a first rate drama from Alliance Films now forcing folks to think at the International Village Cinema. Sure to be a hot topic among environmentalists, politicians, the corporate elite and just plain folk this searing tale is revealing, emotional and extremely topical. Residents of British Columbia should be particular aware of this tale as it explores an issue thats currently boiling to the surface. Energy is a big topic throughout the world. Scarce resources meet companies and nations are striving to find new raw materials in hopes of creating fuel. At the heart of Promised Land is a quest by a corporation to secure land rights in rural American to find gas through fracking. Controversial, this process involved deep penetration into the land by drilling and injecting chemicals in hopes of raising gas. Many are unhappy and fearful of this process no matter what the financial benefits. This argument is the basis for director Gus Van Sants latest film project. Noted environmentalist Matt Damon (The Bourne Identity) stars as mild mannered Steve Butler. Along with colleague Sue Thompson the pair are jettisoned into a small rural Pennsylvania farm community with the mandate to sell the local populace to sign leases to let their employer, Global Crosspower Solutions, to drill on their land. Frances McDormand plays a nice sidekick to Damon as the pair does their best to convince the townsfolk to get on board with the program. Needless to say the sales job becomes rather a bit of an uphill battle. Beautifully written by Damon and fellow star John Krasinski Promised Land pulls no punches and turns into a battle of wills. Which side is right is left for the viewer to decide as all angles are covered in this extremely relevant movie. Krasinski shares screen time with Damon as Dustin Noble, an environmentalist out to stop the plans of this behemoth energy company. Where Promised Lands is at the interaction all these city slickers have with the local towns people. No stone is left unturned as you get a fair picture of the fear many in the community have of selling out both the positive and negative aspects of cashing in. Rural life is put to the test as is the farming lifestyle. Folksy work from veteran acting ace Hal Holbrook and newcomer Rosemary DeWitt as a fetching schoolmarm all add to the appeal of this telling tale. Raw emotions boil to the surface in Promised Land, a penetrating

2013 Honda Accord Coupe EX-L V6


lot of confidence in close quarters. For city drivers, there are a few items that work out in the Accords favor though. The multi-angle rear-view camera is a nice touch, including a useful birdseye-view mode, which is a huge help in tighter parking spots. Furthermore, the LaneWatch feature helps drivers get an unobstructed view of whats going on beside the vehicle, which may be a handy feature for those not used to the size of the Accord and its blind spots. Steering feel is light and a tad vague. It just doesnt translate the feeling of 278 hp into your hands, particularly at speed. Combine this with the soft suspension and its easy to miss the sportiness that some of the other big coupes bring to the table. Instead of being track focused, the Accord combines on road manners with in-car comforts to make for something more akin to a Grand Tourer. LUXURIOUS AND TECH-FILLED The EX-L model with its leather upholstery screams luxury-car and seems lifted from a more premium Acura vehicle. This same thought applies to the overall interior design, with buttons and knobs being placed intuitively, meaning you wont reach too far, or get wandering hand syndrome when it comes to car controls. Rear seat leg and headroom are actually decent, something you wont get in a muscle car. Its practically impossible to feel claustrophobic in the Accord. The tech features on the fully-loaded EX-L are easy to use and innovative. The LaneWatch feature uses a highresolution camera to check your blind-spots for you, and while it wont always beat out shoulder-checking, it does help for quick lane changes. The i-MID system is also appreciated and is controllable via voice commands, or the knob below the screen. The system can

Muscle cars are known for their ability to look cool, drive comfortably and be generally liveable sports coupes. Theyre also known for being big, fat and inefficient. With the latest generation Accord Coupe, has Honda made the switch from a focus on conservative reliability and decided to join the fray of muscle cars? Not quite, but looking at the stable of ponies out there, the Accord Coupe is a pretty interesting take on how Honda will compete with other big V6 equipped two-doors. AN ACCORD FOR EVERY BUDGET Lets start with the price of the Accord Coupe. At $24,140 including destination, the base Accord LX-S is right around the V6 Camaro or Mustang, and while powered with a much less potent 4-cylinder engine with 185 hp, it is generously equipped. Available with a six-speed manual transmission or CVT, even the base Accord looks slick with its 17-inch alloys and chrome accents on the door handles and exhaust tips. Inside this Accord youll find many modern touches like Bluetooth phone pairing and streaming, as well as Hondas 8-inch i-MID multimedia system, which also supports hands free SMS texting and Pandora internet radio. Drivers will appreciate the convenience touches like auto on-off headlights, hill-start assist (on manual transmissions equipped models) and a rear-view camera (a feature thats practically necessary in big coupes.) Essentially, just about every important and desirable feature is packed into the most affordable Accord Coupe, something that cant be said about the V6 pony cars. Move up through the trim models and youll find the $25,815 EX model which has a sunroof, fog-lights, keyless entry and touch-screen for audio controls. The EX also gets a better rear-view camera with more viewing angles. The $28,860 EX-L gets a few more features, like paddle-shifters on the CVT equipped car, leather upholstery with heated seats and a better sound system. EX-L models also get a few more safety features like Hondas LaneWatch which has a camera on the passenger side mirror to peer into your blind-spot. Theres also a lane-departure warning and forward collision warning system. For $2,000 EX-L buyers can also get GPS navigation. Finally, you can opt for the model

were testing, the EX-L V6, which sports a 278 hp V6 engine, 18-inch rims, LED daytime running lights and a dual exhaust system. This vehicle comes in at $31,140, and buyers can tack on $2,000 for the GPS navigation. It might seem like a lot for an Accord, and even more when you realize that other coupes offer V8 power around this price point. Still, in the Honda youre getting higher-grade material and tech. Its also worth mentioning that a fully loaded V6 Camaro, or Mustang, can easily reach the price point of this V6 Accord and still doesnt offer the creature comforts that the Honda can. SHOWING OFF OR LOOKING GOOD? Style wise, the Accord cant compete with the loud and outspoken muscle cars, but truthfully, it doesnt have to. Instead of a weekend toy with hoodbulges, fender-flares and colored calipers, the Accords strong body lines make it look like its wearing a tailored suit. A blacked out honeycomb grille adds a little aggression, while with chrome accenting and LED headlights, and at first glimpse the Accord looks like a Lexus. HONDA REVS UP THE PERFORMANCE Anyone laughing at comparing this coup-ified family sedan to a muscle car needs to take a look at how quick it can reach highway speeds, despite being down at least 30 or so horsepower. The Accord can hit 60 mph in just over 5 seconds, though seems to actively avoid any hint it can do so. The engine noise is also wonderfully refined and polished, and while it might not rock the road the way that an American machine would, it can still warm the heart of the driver when the pedal is pressed. Even with Hondas active noise cancellation, the Accords engine frolics happily throughout the cabin at full throttle. Without fail, the V6 in the Accord is a free-breathing, rev-happy engine that is surprisingly responsive. Its incredibly easy to get carried away in this car, a character trait thats not exactly common to modern Hondas, let alone an Accord. However, something that is common to Honda is the companys great FWD manual transmission. Shifts are intuitive and smooth, and the transmission responds well to rushed shifts or lazier ones. Trying to hustle around town isnt the Accord Coupes strength. Like many other big coupes, it doesnt inspire a

even read out text messages, incoming callers or your phonebook, so the driver can focus on the road. A new feature is the touch-screen radio controls, which is the only low point in the cars tech offerings. Its not bad at all, but seems a little tacked-on, and unnecessary. Hondas traditional radio controls would have worked just fine here. The Accord Coupe fits right in with its V6 competition in terms of fuel efficiency, but features an extra addition that you definitely wont find in a Mustang or Camaro: an ecobutton. The Accords ECON mode helps to smooth out throttle response and encourage fuel-friendly driving practices. Our tester achieved a decent 21 miles per gallon in combined driving situations, which is better than the muscle car competition and the EPA fuel ratings. If anything, with the ECON mode active, the Accord drives smoothly and leisurely. THE VERDICT The Accord nameplate might not make you wide-eyed in anticipation of drag-racing and road ripping performance, but that doesnt make it any less potent. Its sure to be more reliable than a traditional muscle-car, and doesnt make you look like youre compensating for something. While those cars are designed to be cool, fast and affordable, with luxuries and comfort being the last priority, the Accord is the complete opposite, which is great for people who cant stand the current selection of big coupes. With no more Solara or V6 Altima Coupe, if youre looking for a comfortable 2-door cruiser, with some speed, the Accord Coupe is pretty much the sole option. And while not as emotional a purchase as a muscle car, its the smart choice. It is, after all, still a Honda Accord.

Lohri Festival
Lohri, is celebrated every year on 13th of January. It is a festival to worship fire. Lohri Festival is celebrated with great pomp in North India. At this time Earth starts moving towards the sun marking the auspicious period of Uttarayan. The Legends of Lohri There are few renowned legends associated with this historic festival of Punjab, the most significant of them being the Dullah Bhatti, which evolved around the Festival of Lohri. Lohri marks the end of the dreary and awfully cold month of Pos (mid Dec to mid Jan) and the next day of Makar Sakranti, ushers in the bright and sunny month of Magh. This is particularly a happy occasion for the couples who for the first time celebrated Lohri after their marriage and also the first Lohri of the son born in a family The Legend of Sun God Few days before Lohri, a bevy of village maidens assemble and visit the households to ask cow-dung cake. The girls gather round the house and chant: We've come, all the girls of the village! We've come to your courtyard! And so they go from house to house collecting cow-dung cakes till they have a veritable pile. They deposit all of them in one house and return to their homes. Their is a valid reason for girls to perform this ritual. Lohri is celebrated on the last day of the month of Pans to mark the end of winter. It is said that the forefathers formulated a sacred mantra which protected them from the cold. This mantra invoked the Sun God to send them so much heat that the winter cold would not affect them. And, in thanksgiving to the Sun God, they chanted this mantra round a fire on the last day of Pans. The Lohri fire is symbolic of the homage to the sun. A song is sung on this occasion: "Where have the shawls and braziers gone? To the golden mountain Where's the golden mountain gone? To the sun's ray Where has the sun's ray gone? To the sun Where's the sun gone? To the fire The fire burns, the ray warms The snows melt, the cold days have ended." Our ancients believed that the flames of the fires they lit took their message to the sun, and that is why on the morning after Lohri, which is the first of the new month Magh, the sun's rays suddenly turn warm and take the chill out of peoples bones. The origin of Lohri is related to the central character of most Lohri songs that is Dulla Bhatti, a Muslim highway robber who lived in Punjab during the reign of emperor Akbar. Besides robbing the rich, he rescued Hindu girls being forcibly taken to be sold in slave markets of the Middle East. He arranged their marriages to Hindu boys with Hindu rituals and provided them with dowries. Understandably, though a bandit, he became a hero of all Punjabis. So every other Lohri song has words to express gratitude to Dulla Bhatti. Some believe that Lohri has derived its name from Loi, the wife of Sant Kabir, for in rural Punjab Lohri is pronounced as Lohi. Others believe that Lohri comes from the word 'loh', a thick iron sheet tawa used for baking chapattis for community feasts. Another legend says that Holika and Lohri were sisters. While the former perished in the Holi fire, the latter survived. Eating of til (sesame seeds) and rorhi (jaggery) is considered to be essential on this day. Perhaps the words til and rorhi merged to become tilorhi, which eventually got shortened to Lohri and hence the festival got this name in this unique fashion. For the people of North India, Lohri is symbolic of their love for celebrations. People in the states of Punjab, Haryana and parts of Himachal Pradesh are busy in preparing for this festival. The favoured mode of transport for many locals in their day-to-day lives, the noisy threewheeled vehicles provide cheap and efficient travel to all corners. In Hyderabad it is harder to walk past a tuk-tuk without being offered a ride than it is to find one when needed. Far cheaper than taxis, even for a tourist being fleeced on their first day, they are an ideal way to experience the sights, sounds and smells of the city. To the inexperienced eye, it's as if your tuk-tuk driver treats road rules as a minor inconvenience, and every other motorist is attempting to advise the error of his ways with their horn. But it soon becomes clear your driver is not the only one who needs to brush up on the road code. The seemingly lawless roads in Hyderabad are almost a free-for-all and it is cause of endless wonderment that accidents are conspicuous by their absence. Countless rupees in traffic signs and road paint must be saved, with the only semblance of order shown at intersections marshaled by traffic police (perhaps the most thankless job in the city). The intersections without traffic police, on the other hand, can be lifechanging to traverse. There appears no method to the madness as vehicles from all directions negotiate a number of hazards to proceed in the desired direction. Forget about indicators preventing the possible carnage. Who needs them when a wave of the hand will suffice? A tuk-tuk driver's brakes double with the horn for the most overused device in the vehicle and a combination of the two, complemented by some creative steering, ensures safe passage through even the most crowded of Hyderabad crossroads. The voyage can occasionally feel more a theme park ride than a taxi ride but, like a theme park, the chaos is a controlled variety, and any potential danger is belied by the number of collisions. Sure, the lack of wing mirrors on cars is evidence of a few close shaves, but a similar lack of helmets among motorcyclists and seatbelts in tuk-tuks is no cause for consternation. The cavalier attitude of the locals, in particular, reinforces the notion the roads are a lot safer than at first glance. A man would be less inclined to take his whole family in the back of an

auto - the record was five - if he were worried about a crash. That absence of anxiety owes much to the skill of those in control of the bright yellow bugs. The Indian Grand Prix is being raced next month in far sleeker surroundings, but some tuk-tuk drivers could probably give you a run for your money on the streets of Hyderabad. The affable drivers can even act as tour guides at times, taking a break from honking the horn to point out some of the landmarks whizzing past. They also hold an impressive knowledge of the city and an ability to navigate a labyrinth of roads, alleyways and tracks - though the success of that navigation is occasionally reliant on the accuracy of the directions of a few helpful locals. And don't worry if your tuk-tuk driver does err and overshoots the requested destination. That is easily fixed by a quick U-turn before back-tracking into some obliging oncoming traffic.

Brian Burke Fired by Toronto Maple Leafs: It's About Time


Burke also wanted to make the Leafs bigger, stronger and tougher. One of his attempts to do that was trading for Dion Phaneuf in January 2010. The robust former Calgary defenseman had the reputation as a hard-nosed player who could lead his teammates. He certainly has the size at 6'3" and 214 pounds, but the Leafs have not followed his lead. If anything, Phaneuf does not seem as much of a tough guy as he was during his run with the Flames. Burke's decision to trade for Boston Bruins restricted free agent Phil Kessel prior to the start of the 2009-10 season may be the primary reason that his tenure in Toronto will be branded as a failure. There was certainly pressure on Burke to improve and bring in a potential superstar. Kessel had scored 36 goals in his last season with the Bruins and there was every reason to think he would continue to put the puck in the back of the net. Kessel responded for the Maple Leafs with three consecutive 30-plus goal seasons. However, the Leafs gave up high draft picks for Kessel that resulted in Boston's selections of Tyler Seguin,

Dougie Hamilton and Jared Knight. Seguin is on the cusp of superstardom, Hamilton will likely be one of the NHL's most highly touted rookies this season and Knight has the wherewithal to become a productive player. These players could have been the core of the Leafs if the trade had not been made. The year before the Bruins drafted Seguin, the Leafs drafted a player who was expected to become an explosive scorer in Nazem Kadri with the seventh pick of the first round in the 2009 draft. Kadri has not delivered to this point, having scored 19 points in 51 games over three years. He also reported to Toronto Marlies training camp in less-than-stellar shape (source: TheStar.com). That does not mean he won't become a solid pro, but it's not a choice that Burke can look at with pride. The Leafs have been in the middle of rumors that they will soon be acquiring goalie Roberto Luongo from the Vancouver Canucks (source: CBC.ca). It will now be Nonis's responsibility if they are going to complete that deal. The pressure to win in Toronto remains high. That responsibility now shifts to Nonis.

When Brian Burke was hired by the Toronto Maple Leafs in 2008, there were expectations that the Leafs would return to glory. Burke had been the general manager of the Anaheim Ducks when they won the Stanley Cup in 2007. He had a track record of success, and there was every reason for the Maple Leafs to expect a return to prominence under his stewardship. That did not happen. It was not even close. It may not be all Burke's fault, but the Leafs did not even get back to the postseason while Burke was general manager of the Leafs and the team's Board of Directors fired him from that position. (source: TSN.ca). The timing of the move is curious. Bob McKenzie of TSN.ca broke the news hours before NHL owners were scheduled to vote their approval on the proposed Collective Bargaining Agreement that was reached Jan. 6 between the NHL and the NHL Players' Association. While one has to wonder about the exact timing of the move, it appears that the Leafs have made the call based on meritor lack thereof. Burke's assistant Dave Nonis will

take over as senior vice president and general manager, while Burke moves into the senior advisor role. Burke's tenure as Leafs' GM has been filled with bluster and righteous indignation, but it has not been about winning, consistency or following a plan. He deserved to get the gate and probably should have gotten it a year or two ago. If you look at Burke's time with the Ducks prior to coming to Toronto, that team was able to rise through the ranks and win the Cup in large part because of a strong defense. In particular, the Ducks had the goaltending to gain the title in the person of Jean-Sebastien Giguere. The Leafs have not had goodor even decentgoaltending at any point during his tenure. If Burke were a solid general manager, he would have addressed and solved this issue early in his run in Toronto. One of Burke's moves in Toronto was acquiring Giguere in early 2010. At that point, he was struggling in Anaheim and Burke was hoping the change in environment would help him return to form. That did not happen.

NHL Agreement Changes Rules On Trade Salaries


The NHL and its players union continue with the plodding process of ratifying the tentative Collective Bargaining Agreement. While there were no new updates Tuesday morning on the ratification, several new details of the agreement surfaced. Some will affect the Leafs. One detail that came out is how teams split the salaries of players involved in a trade. Teams are now required to take no more than 50 per cent (each) of a players salary both in regular dollars and cap hit after a trade. There was no sharing of salaries under the previous deal, and Leaf GM Brian Burke had pushed for years at GM meetings to have the CBA updated to reflect this new sharing plan. The new CBA also deals with the socalled back diving contracts, which under the old CBA, saw players like Roberto Luongo and Marian Hossa with long-term deals where actual salary at the tail end of the contract dipped well below the official cap hit, providing a built-in exit plan for the player if he retired before the expiry of his deal. In the new CBA, any contract running beyond six years that is traded will now see both teams involved in the trade absorb a percentage of the cap hit should the player retire before the end of his contract (previously, only the team that traded that player would be responsible for the entire cap hit). This new provision affects Luongo and any potential trade to the Leafs. Luongo has played two years of the 12-year contract he signed with the Canucks. His cap hit is $5.3 million per season, but his salary over those first two years is $16.7 million. The Canucks show just over $6 million in savings on cap space, but under the new deal, if Luongo retires from this contract with three or four years left on his deal, the Canucks would be charged those savings against their cap. If Luongo is traded to the Leafs and retires with three or four years remaining on his deal, the Leafs would also pay a price on their cap over the final years of that deal. Its something that makes the Leafs more responsible for the back end money on his contract theoretically, that makes the contract less attractive. But, its not likely to dissuade the Leafs if they feel Luongo is the answer to To Get The Best Value For their goaltending woes.Your Dollar

Vancouver Canucks: 2013 Season Preview


Last years story Coming off an epic seven-game Stanley Cup final defeat to Boston in 2011, Vancouver won its second Presidents Trophy in a row. But the Canucks flamed out in the first playoff round, exiting in five games to the eventual-champion Kings. Meanwhile, a simmering goaltending controversy reached its boiling point after Game 2 of the playoffs, when coach Alain Vigneault replaced 0-2 Roberto Luongo with Cory Schneider. Even though Schneider lost two of the next three games, it seemed the torch had been passed to the backup, who posted superior numbers in the regular season. Luongo appeared resigned to that fate when he indicated hed be open to a trade, but he remains on the roster (for now). This years outlook Job No. 1 for GM Mike Gillis is to work out a Luongo deal. Given the veterans enormous contract (10 years

remaining at an annual cap hit of $5.33 million), the return could be small. Schneider appears to be a capable replacement (.933 save percentage in 58 starts over the last two seasons), though its uncertain how hell handle the workload and pressure (and perhaps tougher opponents) that come with being a No. 1 goalie. Jason Garrison was signed away from Florida to bolster an already productive power play after potting nine goals with the man advantage last season (second-most among NHL defencemen). Gillis didnt add any impact forwards, but hes still got a strong unit led by the silky Sedin brothers and the sandpapery Alex Burrows, whos averaged 29 goals over the last four seasons. The big question surrounds the health of two-way centre Ryan Kesler, whos recovering from off-season shoulder and wrist surgeries. Theres still no timetable for his return.
