This pertains to the letter-request of the Presidential Management Staff (PMS) for recommendation and inputs relative to the invitation of Executive Vice-President Akihiro Ushimaru of Nakayama Technology Corporation (NTC) for the President to visit the companys plant site at Diversion Road, Barangay Cogon, Digos City, Davao del Sur. We are recommending the granting of the companys request with the following information that may be considered by the President: (taken from RD Suyaos Memo) May we respectfully inform the Secretary that there is NO pending labor related complaint or case involving Nakayama Technology Corporation filed before the DOLE-Region XI. Please see the attached Certificate of No Pending case. As added information, Nakayama Technology Corporation is one of the recipients of the Tripartite Certificate of Compliance with Labor Standard (TCCLS), which was awarded last December 6, 2012. As such, the company has been validated to have fully complied with Labor Standards Laws, Occupational Health and Safety Standards and Child Labor Laws. Likewise, Nakayama Technology Corporation is a supporter of the DOLE Child Labor program, being a donor of school supplies for the identified child laborers in Brgy. Kibuaya, Hagonoy, Davao del Sur and Brgy. Pasig, Kablawan, Davao del Sur. In 2012, a Memorandum of Understanding was signed between DOLE XI and Nakayama Technology Corporation, wherein the company committed to continuously support the child laborers though the DOLE Angel Tree project. Inquiries were also conducted, through telephone, with the Regional Conciliation and Board XI (RCMB XI) and NLRC Regional Arbitration Branch XI (NLRC RAB XI) as to any pending cases filed against the company and

pending resolution before the said Offices. RCMB XI confirmed that there is NO pending labor related complaint or case involving Nakayama Technology Corporation filed before said Office. However, records of NLRC RAB XI indicate that a case for Illegal Dismissal was filed by Mr. Henry R. Ovillo against Nakayama Technology Corporation on 17 January 2013, docketed as RABXI-01-0034-13. The 2nd conciliation conference is scheduled on 26 February 2013. For the Presidents consideration.
