Sitter-Support LLC Terms and Conditions

Babysitting Placements: Process, Fees, and Terms


Definition: Sitter-Support LLC considers a babysitting placement one that is provided on a random basis, without a contractual agreement made between the Client and the Babysitter.

A. Placement Process:
1. The Client may begin using Sitter-Support babysitting referral services by completing the registration form on the website and paying the placement fee through GoogleCheckout. 2. Sitter-Support service users ('The Client') submit a Sitter Request to the Agency. This can be done by logging in on the website and completing the "Sitter Request" form. 3. The Agency will match the Client with a Sitter who has experience working with the ages of the Client's children. 4. The Agency contacts the Client with a Sitter Confirmation by phone and/or email. In the confirmation email t he Agency will list the name of the Sitter matched to the Clients request and link the page Our Babysitters that lists all Sitter profiles so that the Client may review the Sitter's experience. 5. The Sitter arrives at the Clients home to fulfill her babysitting placement at the arranged date/time. 6. Clients pay Sitters directly, $12/hour (or the holiday rate) at the end of the placement. 7. Areas we serve include Rochester, East Rochester, Brighton, Pittsford, Fairport, Perinton, Penfield, Webster, Irondequoit, Greece, Chili, Gates, and Henrietta. Our Sitters may also travel to areas such as Scottsville, Churchville, Spencerport, Rush, and Mendon. For t hose areas, the Client will be required to pay an extended driving fee of $10 directly to the Sitter in addition to the regular hourly rate.

B. Babysitting Placement Fees:


1. Standard (Non-Member) Placement Fee Sitter-Support charges a standard flat fee of $ 12.99 for a 1-day placement. For a request of 2 consecutive days of ba bysitting the fee will be $19.99 . Any placement request for 3 day s will be 26.99 and any placement request longer than 3 days is a flat fee of $30.99 . This fee is non-refundable. After completing the Sitter Request Form, t he Client will complete the payment process through GoogleCheckout. If the Agency is unable to provide the Client with a Sitter, no placement fee will be charged. 2. Babysitter's Hourly Rate: $12/hour The Client pays the B abysitter $12/hour directly at the end of the placement. For services performed on holidays (Thanksgiving, Christmas Eve, Christmas Day, New Years Eve, New Years Day, Easter Sunday, Memorial Day, and the 4th of

July. Sitter compensation should be increased to $20.00 per hour. No money is passed from the Agency to the Babysitter, or vice versa.

C. Terms and Conditions:


1. Maximum Length of Placement: Sitter-Support does not place sitters for the long -term. The maximum length of a temporary placement is one business week . This equals a total of 5 consecutive days of babysitting. If a Client needs a sitter for longer they will need to pay an additional placement fee after one week. If a Client is interested in a regular sitter they may ask about our Set -Sitter Option. 2. Cancelation Policy: Sitter-Support understands that unexpected situations come up for busy families. If a Client needs to cancel the sitter request the Client will be not be issued a refund, but a credit will be issued to your account equal to the amount paid for the canceled placement . The Agency asks that the Client give notice of cancellation as soon as possible so that a new placement can be found for the Sitter. 3. 3 Hour Minimum: The Agency requires babysitting requests made by Clients to be a minimum of three hours in duration. Should the Client request a Sitter for less than three hours the client is obligated to pay the Sitter for the equivalent of working three hours which amounts to $36.00. 4. Exclusivity Agreement: Clients must contact th e Agency to schedule additional times with any S itters they meet through the Agency. Sitter-Support has an exclusivity agreement with each of our sitters that states that if a Sitter babysits privately for a Client they have met through the Agency, they wi ll be excused from the Agency. Contacting a Sitter directly without going through the A gency will compromise that Sit ter's employment with Sitter -Support.

"Set-Sitter" Option: Process, Fees, and Terms


Definition: The Agency considers the " Set-Sitter" Option a legitimate way for the Client to cut the Agency out of the equation so they can contact a specific babysitter directly without going through the Agency and without paying the $12.99 Agency Fee. A. "Set-Sitter" Option Process 1. The Client is an established Sitter-Support Member using our Babysitting Services consistently and is introduced to a S itter that meets most of the Client's needs and the Client feels very comfortable with. 2. The Client communicates to the Agency that they w ould like to pursue the " SetSitter" option with this particular Babys itter.

3. The Agency contacts the Sitter and offers her the option of working directly for this family. The Sitter has the right to either accept or decline the offer. 4. Upon the Sitter's acceptance, the Agency will send the Client the Babysitter's contact information. The Client is free to contact this particular Sitter without going through the Agency and without paying the $12 .99 Agency Fee each time. 5. The Client is still a Sitter-Support Member and is encouraged to continue to use the Sitter-Support Sitting Service if their now regular sitter is ever unavailable. B. "Set-Sitter" Fee: $125.00 1. An invoice for the Set -Sitter fee will be emailed to the Clients email address. The $125.00 fee is charged to the Client's credit card upon the acceptance of this offer by the babysitter. The " Set-Sitter" Agency Fee is non-refundable. C. "Set-Sitter" Terms 1. The "Set-Sitter" Option does not include a contractual agreement between the Sitter and the Client. 2. The Agency will not arrange a pool of Sitter Candidates for a Client to meet if the Client wants to do the "Set -Sitter" option. This option is only for Clients who have met a babysitter through our babysitting service. Confidentiality and Privacy Policy The Babysitter shall not, during her employment with the Client and/or the Agency, or at any time thereafter (other than in the proper course of her duties or as is required by law), without the prior written approval of the Client and/or the Agency, divulge or disclose any information which, by reason of its character or the circumstances or matter of its disclosure, is evidently confidential to the Client and/or the Agency. The Agency and Client shall not during the term of this Agreement, or at any time thereafter (other than as necessary for the proper discharge of their duties hereunder or as is required by law), without the prior written approval of the Babysitter, divulge or disclose any information which, by reason of its character or the circumstances or matter of its disclosure, is evidently confidential to the Babysitter. Indemnification and Hold Harmless Agreement The Client covenants and agrees to indemnif y and hold the Agency harmless from all claims, demands, actions or damage of every kind an d description, including reasonable attorney's fees and all other costs and expenses necessarily incurred, which may accrue to or be suffered by Clien t as a result of Client's, Babysitter 's, or a third-party's acts and/or omissions and not as a result of the Agency's acts and/or omissions, including, but not limited to, negligence, malfeasance, misfeasance, nonfeasance, and/or willful misconduct of the Babysitter or a third-party.

Termination Policy.

The agency explicitly reserves the right and th e Client acknowledges that the Agency may terminate this contract, or its working relationship with Clients, or Babysitters for any irreconcilable issues that may be communicated to the Client or Babysitter in writing. Equal Opportunities No client or sitter will be treated unfavorably in any part of the recruitment or placement process by the Agency due to his or her disability, gender, race, sexual orientation, religion or belief or in any other professional dealings. All agency staff and all babysitters are expected to be aware of Equality legislation; this includes discrimination on the grounds of disability, gender, race, sexual orientation, religion or belief and to apply them in all their professional dealings. This policy is regularly monitored to ensu re that the objectives are achieved. It will be reviewed and, if necessary, revised in the light of legislative or organizational changes.
