Respected Radio Amateurs:

We acknowledge receipt of your Right to Petition referenced above. In accordance with

the requested, I notify:

1. During the years 2007 and 2008, the Ministry of Communications has not issued an
amateur radio operator license to Mr. DIMITRI KRYUKOV – RA3CO (of the
Russian Federation) nor has it issued a permit or authorization.
2. During the years 2007 and 2008, nor to date has Mr. DIMITRI KRYUKOV –
RA3CO applied for an amateur radio operator license, permit or authorization to this
Ministry.
3. During the year 2006, nor to this date, has GIRTS BUDIS – YL2KL (from the
Republic of Latvia) been granted an amateur radio operator license, permit or
authorization.
4. Mr. GIRTS BUDIS – YL2KL, during the year 2006 nor to this date, has not applied
or requested for anything from this Ministry.
5. It is prohibited in COLOMBIA that an amateur radio operator allow the use of his
call sign to another local or foreign amateur radio operator. As in fact, Section 9 of
Article 76 of Decree 2058 of 1995, establishes as one of the special responsibilities of
amateur radio operators, leagues or associations: “Not allow the use of its call sign
to any other person”.
6. According to the established in Decree 2058 of 1995 and to the previous point, it is
illegal and prohibited that any amateur radio operator allow use of his call sign to any
other person; and he who wishes to be an amateur radio operator requires a license,
authorization and/or permit (Article 2 Decree 2058 of 1995). Therefore it is illegal
that Mr. DIMITRI KRYUKOV – RA3CO, who does not posses an amateur radio
permit or license issued by this Ministry, to operate from Colombia with call signs
issued to other people, nor is it legal for people that have a legal issued amateur radio
licence as is the case of Mr. ANTHONY ROGOZINKSY – HK1AR and
WOLFGANG TORRES – HK3RA to allow its use to another person.
7. It is illegal that Mr. GIRTS BUDIS – YL2KL, operate from Colombia using the
amateur radio call sign HK1/YL2KL, taking into account that the Ministry of
Communication has not issued an authorization or permit (Article 28, Decree 1058 of
1995).
8. The Republic of Colombia does not have a reciprocal operating agreement with the
Russian Federation nor an amateur radio operator from said Federation, without the
prior authorization or permit issued by the Government of the Republic of Colombia,
operate the radio amateur service in Colombia and least using a self-assigned
illegitimate call sign.
9. The Republic of Colombia does not have a reciprocal operating agreement with the
Republic of Latvia. Nor an amateur radio operator from said country; illegally operate
the amateur radio service in Colombia without the prior authorization or permit and
least using a self-assigned illegitimate call sign.
10. The legal precept of “amateur radio guest operator” does not exist in current
amateur radio regulations or law governing amateur radio special service. As
previously explained in the fifth point, a resident local or foreign amateur radio
operator, by the simple fact of loaning his radio equipment, may not loan or allow use
of his call sign to any other person (Section 9, Article 76, Chapter VII, Special
Responsibilities of Amateur Radio Operators, Leagues or Associations, Decree 2058
of 1995).
