J bar K Horse Ranch, agent for the above named stallion, is herin referred to as Breeder. This service is engaged subject to the following: 1) A completed breeding contract, booking fee and a photocopy of both sides of the mare's registration papers must be on file. 2) A non-refundable booking fee of $150.00 is payable with this contract. The balance of $450 and service charge for the first shipment (See #3 below) are due prior to shipment of semen. 3) Shipped semen service charge will be as follows: (1) Shipments within the U.S: Collection fees and Federal Express Priority Overnight, $400.00 per shipment (2) Canadian shipments: Collection fees, USDA requirements and Federal Express at $575.00 per shipment. Shipping dates are Mon-Friday. We highly recommend sending your mare to a vet clinic or breeding farm for her 4) heat cycle. They will coordinate optimum shipping times with us. Adequate notice is required. 5) Live Foal Guarantee: Live foal is defined as a foal that stands and nurses without assistance. It is understood that if the mare proves barren, aborts her foal, or if foal is stillborn, a return season (or new shipment of semen) will be guaranteed the following year only, provided a written notification from a licensed veterinarian is delivered within seven (7) days of producing a non-viable foal. 6) Mare Owner shall not be entitled to a refund of fees. The breeding fee will be waived on a new shipment of semen. Mare owner will be responsible for additional collection and shipping fees. 7) A Breeders Certificate will be issued to the Mare Owner after all expenses have been paid in full and upon notification of birth of foal. 8) It is agreed that should above named stallion die or become unfit for service, then this contract shall become null and void and the booking fee refunded. For those with a paid return breeding, if the stallion dies the mare owner may select another stallion standing at J bar K Horse Ranch/RockinH Appaloosas. There will be no money refunded. 9) Waiver of Liability: It is understood that the breeding farm, its owners, employees, shall not be liable for any injury, escape disability, or death of any horse on its premise. 10) This agreement constitutes the entire agreement between parties; any amendment to or modifications must be made in writing. Should it be necessary for breeder to employ an attorney to enforce any terms of this agreement, including collection of money owed, Mare Owner shall pay all reasonable attorneys fees, costs and other expenses related to enforcing this agreement. ____________________________________ Stallion Owner/J bar K Ranch
