The Florida Sunshine Laws were to bring about transparency in the Government departments and its agencies to create to allow all citizens access to information in a timely manner. The only time that it applies to our Association is when there is an Architectural Review Committee of the Association reviewing and approving applications for county building permits, this is when the Florida Sunshine Law does apply says the Attorney General. However, the Condominium Act applies to our Association. The Condominium Act requires the unit owners association and its board to comply with the Act and with the condominium's declaration, bylaws, rules, and regulations As an Owner, if you are thinking about major repairs, changes to your condo, this includes changing your air conditioner/furnace, installing a water filter system that may require a outside tank, a letter should be sent to the Board advising them of the repairs, to ensure that any structural changes that may occur are approved by the Board prior to the work being started. The Condominium Act prohibits a unit owner from doing any work that could jeopardize the soundness or safety of the property, reduce its value, or impair any right or other interest constituting a common element without the unanimous consent of all the other unit owners If you are looking for the Bylaws of the Association, you can find them in the Original Documents on the Management website, exhibit C & D of these documents include the Articles of Incorporation and the By Laws. It might be good to familiarize yourself with these By Laws, to understand your rights and responsibilities as an owner.
