CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS: THAT I, PEDRO DELA CRUZ, of legal age, Filipino citizen, married and a resident of Bulua, Cagayan de Oro City, hereinafter called and referred to as the LESSOR; -andJUAN TAMAD, of legal age, Filipino citizen, married and a resident of Cagayan de Oro City, hereinafter called and referred to as LESSEE; WITNESSETH: WHEREAS, the LESSOR is the lawful owner of a certain two (2) storey Residential Building located at Zone 6, Bayabas, Cagayan de Oro City, with Original Certificate of Title No. 12345, containing an area of Ten Thousand (10, 000) Square Meters more particularly describes as follows: A Parcel of Land, located at Zone 6, Bayabas, Cagayan de Oro City, Island of Mindanao. Bounded on the Lot No. 1; on the East Lot No. 2; on the West Lot No. 3 and on the South Lot No. 4; containing an area of (10, 000) square meters, more or less. WHEREAS, the LESSEE offered to LEASE the whole two storey residential building owned by the LESSOR; NOW THEREFORE, for and in consideration of the foregoing stipulations, parties hereby AGREED in the following terms and conditions, to wit: 1. That Lessor is willing and agreeable that his whole Residential Building be LEASE by Lessee in the amount of FIVE THOUSAND (Php. 5, 000. 00) PESOS, Philippine Currency, per month for a period of One year starting June 26, 2010; 2. That the premises leased have been received by the lessee in good and habitable conditions; 3. That all ordinary repairs within the premises that arise in the daily use of the facilities therein shall be for the sole account and expense of the lessee, without right to reimbursement; 4. That the lessee shall use the leased premises exclusively for family dwelling, and shall have no right to use the same for business purposes; 5. That the lessee is expressly prohibited to sublet the leased premises to any one, without the express consent of the lessor in writing; 6. That all charges for water, light, and telephone used within the premises shall be at the sole account of the lessee; 7. That the lessee shall notify the lessor at least 30 days in advance should the lessee decide to abandon the leased premises; 8. That violation of any of the above terms and conditions will produce ipso facto the rescission of this contract of lease;

This instrument refers to a CONTRACT OF LEASE executed by the parties, consisting of two (2) pages including this page where this acknowledgment is written.
