Pursuant to Rule 17 of the Ohio Ru1es of Appellate Procedure, Cincinnati USA Regional
Chamber, Cincinnati Center City Development Corp., Port of Greater Cincinnati Development
Authority, Uptown Consortium, lnc., AI. Neyer, Associated Builders & Contractors, Flaherty &
Collins Properties, roL Wann Construction LLC, Messer Construction Co., Miller-Valentine
Group, NorthPointe Group, Oswald Company, and Town Properties (collectively. the "Proposed
Amici") respectfully request leave of court to file the attached amici curiae brief in support of
reversal of the trial court's order granting Appellees' Motion for Permanent Injunction and
Declaratory Judgment currentJy on appeal before this Court and to enter judgment in favor oflhe
Appellant City of Cincinnati.
As set forth in greater detail in the brief, Proposed Amici all regularly deal with the City
and other municipalities regarding economic development activities in the region. As such, the
Proposed Amici have an interest in the outcome of this litigation, which will have a direct impact
on their ability to initiate and move forward on economic development projects in the City. The
trial court's order has far reaching effects beyond the proposed parking transaction. By making
every ordinance passed by the City subject to a referendum, including those adopted as
emergency measures intended to take effect immediately, development entities, like the
Proposed Amici, would have no finality about the status of their economic development projects
and would be deprived of the expedited scheduling often necessitated because of construction
schedules, market conditions, contracting requirements, financing availability and deadlines, and
other numerous reasons.
Therefore, Proposed Amici respectfully request leave to file the attached Brief of Amici
Curiae.
