Board Meeting Minutes May 14, 2009


The board meeting for Colonial Lakes was held at 9404 Rosalie Court, Orlando, FL. The meeting was called to order at 6:20 p.m. There was a quorum of the board present. Board Members attending: Dusan Kuzmanovic -President Ray Hankele Vice President Ana Hernandez Alberto Rodriguez - Treasurer Rosie Melendez - Secretary Yvette Hernandez

Board Members absent:

1. There was discussion regarding committees and appointing board members. Generally appointments to the board are made to fill a board vacancy. The board is elected annually at the annual membership meeting. A motion was made by Dee Kuzmanovic to create the Community Beautification committee to be comprised of Helen Rodriguez, Linda Marquez, Jeremiah Castleman and Anibal Madera. 2. There was discussion regarding the burned down home at 1200 Brookebridge Drive. The owner posed a question regarding HOA deed restrictions that would require him to re-build the home. The board did not see any deed restrictions that require the owner to rebuild. There was discussion as to adding an amendment to the Declaration of Covenants and Restrictions that would require an owner to rebuild a home. 2/3 of the owners would have to approve it. The cost of attorney fees to draft the proposed amendment is unknown. 3. Alberto Rodriguez presented information regarding the paint supplies needed to paint the entrance sign. Color samples were also presented and will be chosen by the Community Beautification Committee. 4. There was discussion as to the course of action regarding owners who violate deed restrictions. Management writes letters to try and correct various issues. If the owner does not comply with the letters the next step would be for the board to authorize the HOAs attorney to write a letter. If that does not remedy the problem, in certain situations civil litigation would be the next step. A question as the HOA mowing owners lawns and billing them for that was asked. The HOA should not enter onto private property to perform any maintenance; it exposes the HOA to many liabilities. Liens can only be placed on property for non-payment of HOA dues. Collection of HOA dues was discussed. The last notice sent was Final Notice before Attorney Action. The deadline to pay is May 31, 2009. Accounts that are delinquent in June will be sent to collections. 5. There was discussion of the web-site and trying to get owners to use it more, possibly for paying dues. 6 & 7. There was discussion regarding the Orange County Grant program. Painting the entrance sign and painting cement block wall on Dearmont were discussed as options. Adjournment: 8:05 PM
