NOW, THEREFORE, BE IT RESOLVEDBY THE BOARD

OF ALDERMEN OF THE CITY OF PELICAN BAY,
TEXAS:

I.

No c ont r ac t f or servj-ces, now purchase of goods as well as

public wor k s c ont r ac t s shall be 1et, executed, or made when the amount

inv olv ed ex c eeds $2, 000.0 0 unless and until competitive bidding has

been pur s ued and im plim en t e d as otherwise provided in Article 2368a of

Ver non' s Annot at ed Civ il Statutes.

II.

The pr ov is ions of Article 2368a shal1 be strictly adhered to

in eac h and ev er y ins t a n c e and the other change sought by this

r es olut ion and inplim ent e d hereby is that the amount as set forth in

s t at e s t at ut e is m ade m o r e r e s t r i c t i v e and lowered to $2r000.00.

III.

Any c ont r ac t f or public services, a pukrlic works contract, or

any pur c has e or ac quls it io n sha1l be nul1 and void and the contract

unenf or c eable unles s t he t e r m s and provisions of this resolution as

well as all o th e r p rovi si ons of A rti cl e 2358a are stri ctl y and

completely followed.

IV .

Moreover, it shall be unLawful for any official acting on

b e h a l f o f th e C i ty o f Pel i can B ay, Texas, to execute any such contract

as herej.nabove described without first having followed the procedures

as set fo rth h e re i n and w i thout fi rst havi ng been authori zed and

d l re c te d b y th e B o a rd of A l dermen to do so.

If th e l o w e s t a nd best bi ds are i denti cal i n both amount and

nature, the Board of Aldermen shall enter into a contract with only one

of the bidders selected by the casting of lots in such manner as the

mayor or county judge shall prescribe according to Article 2367a of

Ve rn o n ' s A n n o ta te d C i v i l S tatutes.
