Article One: Payment of value added tax on public tenders Law n 25/2005 of 04/12/2005 on tax procedures as modified and complemented to date, is complemented by Article 10 bis worded as follows: Article 10 bis: Payment of value added tax on public tenders The value added tax on public tenders is withheld by a public institution which awarded the tender. A public institution which awarded the tender has the responsibility to file a tax declaration in accordance with the form prescribed by the Commissioner General of Rwanda Revenue Authority and pay the tax withheld within fifteen (15) days following the end of the month in which the winner of public tender has submitted the invoice. The public institution which fails to withhold the value added tax or which withheld value added tax and failed to pay the tax withheld to the Tax Administration must pay the Tax not withheld or not paid, fines and interests as provided for by this Law.
Article premier: Paiement de la taxe sur la valeur ajoute sur les marchs publics La Loi n 25/2005 du 04/12/2005 portant cration des procdures fiscales telle que modifie et complte ce jour, est complte par larticle 10 bis libell comme suit:
Article 10 bis: Paiement de la taxe sur la valeur ajoute sur les marchs publics La taxe sur la valeur ajoute payable sur les marchs publics est retenue par lentit publique de passation de march. Lentit publique de passation de march doit faire la dclaration suivant le formulaire spcifi par le Commissaire Gnral de lOffice Rwandais des Recettes et doit payer le montant retenu dans un dlai ne dpassant pas quinze (15) jours aprs la fin du mois au cours duquel lattributaire du march a prsent la facture. Lentit publique qui na pas retenu la taxe sur la valeur ajoute sur le march public ou qui la retenue mais ne la pas paye lAdministration Fiscale doit payer la taxe non retenue ou non paye ainsi que les pnalits et intrts de retard, tels que prvus par la prsente loi.
Official Gazette n 04 of 28 January 2013 Ingingo ya 2: Inyandiko ikosora Article 2: Rectification note Article 2: Avis de rectification Larticle 27 de la Loi n 25/2005 du 04/12/2005 portant cration des procdures fiscales telle que modifie et complte ce jour est modifi et complt comme suit: En cas de rectification du formulaire fiscal, ladministration fiscale transmet un avis de rectification de limposition au contribuable. Cet avis comprend un projet de rectification ainsi que tous les lments qui entranent celui-ci. Lavis de rectification peut comporter des amendes administratives dtermines par ladministration fiscale en cas de non-respect des lois fiscales. Le contribuable a le droit de donner par crit, dans un dlai de trente (30) jours, des observations au sujet de lavis de rectification. Le contribuable peut galement transmettre des preuves complmentaires ladministration fiscale ainsi que tout renseignement dmontrant que le redressement est inexact. Le contribuable a le droit dtre entendu, pour autant que la demande daudition figure dans la rponse. Lavis de rectification peut tre mis pendant une priode de cinq (5) ans, compter du 1er janvier de lanne qui suit lexercice fiscal concern. Cette priode est de dix (10) ans en cas de fraude fiscale. Lavis de rectification devient dfinitif:

Iyo nyandiko iba ikubiyemo umushinga w'inyandiko ikosora nibindi bintu byose byashingiweho kugira ngo ikosorwa rikorwe. Inyandiko ikosora igaragaramo amahazabu agenwa nubuyobozi bwimisoro iyo habayeho kutubahiriza amategeko agena imitunganyirize yimisoro. Umusoreshwa afite uburenganzira bwo kugaragaza mu nyandiko igitekerezo cye ku birebana ninyandiko ikosora mu gihe cyiminsi mirongo itatu (30). Umusoreshwa ashobora kandi gushyikiriza ubuyobozi bwimisoro ibindi bimenyetso cyangwa se ibindi bisobanuro bigaragaza ko inyandiko yakosowe idasobanutse neza.
