MEMORANDUM FOR THE EXECUTIVE DIRECTOR OF THE


NATIONAL COMMISSION ON TERRORIST
ATTACKS UPON THE UNITED STATES

Dear Phil:

We spoke last week about the difficulties in copying the tapes from
NORAD/NEADS. At that time, I suggested that the Commission make
arrangements to travel to NEADS so that staff members could listen to the
tapes on the specialized equipment and then we would determine how to
proceed.

Since that time I have been informed that Dictaphone has recovered
most of the tracks. However, NEADS will require another period of time to
turn this effort into a product that will not require specialized equipment.
Therefore, I urge again that the Commission consider my suggestion from
last week to travel to NEADS to listen to the tracks and decide which are of
value.

On the question of the IIRs and MFRs, during the course of compiling
them, the staff disco vered a difference in the approach by the CITF to the
classification levels of its information and that used by other DoD entities
for the IIRs and MFRs. That difference concerns documents that may be
responsive to the Commission's requests with respect to a number of
individuals of interest to the Commission. We are working to reconcile the
differences in classification. Meanwhile, responsive IIR and MFR materials
classified by DoD, including such material relevant to the individuals of
interest, have been and will continue to be forwarded prior to 30 November.

Dear Mr. Zelikow:

I am writing to follow up on my testimony at the Commission's seventh public hearing on


"Borders, Transportation, and Managing Risk." At the hearing, Commissioner Ben-Veniste
requested written information on the intelligence gathering function of the North American
Aerospace Defense Command (NORAD). The request appears on page 177 of the hearing
transcript. The attached paper from NORAD and US Northern Command provides information
on the intelligence collection and analysis activities of both commands.

In addition to the NORAD-related request, Commissioner Ben-Veniste also requested


written information on the Department's interpretation of Public Law 107-40 in relation to the
Posse Comitatus Act, as well as information on the Terrorist Information Awareness program.
Responses to these requests will be forthcoming shortly.

I request your assistance in providing the attached paper to Commissioner Ben-Veniste and
any other members of your staff who may wish to see it. Thank you for your assistance.
