Representation seeking exemption from the requirement of NET and regularization of my services as lecturer

Sir, This representation is being submitted with a request that since my initial appointment took place in 1999, my case for exemption from NET should be considered under the Regulations then existing and applicable to me and not under the present Regulations of the University Grants Commission for the reasons given below: I was initially appointed on 17.08.1984 as a part-time lecturer in Indraprastha College for Women. Subsequently, a post of lecturer in IRPM (Industrial Relation & Personnel Management) was advertised by the College on 06.07.1999. I was selected as a Lecturer, against the said post, through a duly constituted Selection Committee on 01.12.1999. The Governing Body/Managing Committee of Indraprastha College for Women endorsed my candidature and sought exemption from the requirement of NET on the following grounds: a) I was the only candidate with specialization of IRPM at Post-Graduate level. b) I had maximum experience of teaching the relevant subject and even earlier I had already been selected by the Delhi College of Arts and Commerce in the year 1985 (30.07.1985) through a duly constituted Selection Committee. Accordingly, a proposal seeking exemption from NET was sent to the University Grants Commission by the College through the Registrar, Delhi University. However, it appears that on 17.01.2002, the proposal was rejected without assigning any reason. In December, 2002, another proposal was sent to the University Grants Commission through the Principal of Indraprastha College and the Registrar, Delhi University. But in January, 2003 University Grants Commission again rejected the proposal without assigning any reason. It is respectfully submitted that in March 2009 the College sent another letter seeking exemption from NET to the University Grants Commission, along with the request of the Registrar, University of Delhi and the recommendation of the Principal of Indraprastha College. In this regard, on 16.03.2010, the University Grants Commission sought more information. The College replied on 29.03.2010 categorically

informing that I was the only candidate with requisite qualification and experience of IRPM and had been selected unanimously by the duly appointed Selection Committee. Unfortunately the University Grants Commission UGC on 09.07.2010 again rejected my case stating that now onwards all appointments will be made only with NET qualification. It is respectfully submitted that my appointment has taken place in December 1999 and is therefore governed by the University Grants Commission Regulation of 19.09.1991 which provides as under; Good academic record with at least 55% marks or an equivalent grade at Masters degree level in the relevant subject form an Indian University or an equivalent degree from a foreign University. Candidates, besides fulfilling the above qualifications, should have cleared the eligibility test for lecturers conducted by University Grants Commission, CSIR or similar test accredited by the University Grants Commission. The Regulations of 1991 also provided that any relaxation in the prescribed qualifications can be made by a University, with the prior approval of the Commission. Further, on 21.06.1995, the University Grants Commission also made a provision that the candidates who have submitted Ph.D. thesis or had passed the M.Phil examination by 31st December, 1993 are exempted from the eligibility test for lecturers conducted by UGC, CSIR or similar test accredited by the University Grants Commission. Therefore, undeniably, exemption from Net has been granted in deserving case. It is respectfully submitted that since I was initially appointed in December 1999, I am governed by the 1991 Regulations of the University Grants Commission and the clarification made in 1995. My case should be considered as being covered under 1991 regulation of University Grants Commission and not under the present Regulations of University Grants Commission. In terms thereof, I should be granted exemption from NET and my services should be deemed regularized with retrospective effect. Thanking you. Yours faithfully,
