AGREEMENT OF TENANCY

This Agreement of Tenancy is made Between in Continuation of Agreement of Tenancy which was Executed and signed by both the parties on____________.

This Deed of Rent Agreement is made at Karachi, on this ________ day of ______.

BETWEEN
MRS. RIFFAT SOHAIL W/O SQ. LDR. SOHAIL SHAFI (LATE), holding CNIC No. 42501-1404633-0, Muslim, adult, resident of PAF, Malir Cantt Karachi, hereinafter called OWNER of the one part:

AND
MR. KHAWAJA REHAN HASSAN S/O KHAWAJA ATHAR HASSAN, holding CNIC No. 37405-0227083-5, Muslim, adult, resident of House No. 25/A, Sheet No. 25, Model Colony Karachi, hereinafter called the TENANT Party of the other Part: (Both expression shall wherever the context so permits, mean & include their heirs, executors, administrators, successors, and assigns)

Whereas the OWNER is the sole and absolute OWNER of House bearing No. SD-121, AFOHS Housing Scheme, hereinafter called the Said Premise. AND WHEREAS the OWNER has agreed to rent out the Said Premises, to the aforesaid TENANT on MONTHLY RENT of Rs. 35,200,/- (Rupees Thirty Five Thousand Two Hundred Only), on the following terms and condition:

WITNESSETH AS UNDER

1.

That the TENANT had already Deposited a sum of Rs. 64,000/MONEY,

(Rupees Sixty Four Thousand Only), which will be treated as FIXED SECURITY DEPOSIT refundable to the TENANT at the time of entire vacation of the Said Premises (without interest) after deducting dues, damages, charges, if any. Continued on Page - 2

That the TENANT has paid 11 Months Advance Rent i.e. Rs. 3,87,200/(Rupees Three Lacs Eighty Seven Thousand Two Hundred Only), which shall be adjusted in the rent by the OWNER commencing from 09-062012 to 10-05-2013, through Cheque No. __________________________________________, dated ______________. 3. That, the OWNER has handed over the vacant peaceful possession of the SAID PREMISES to the Tenant with all necessary fitting & fixtures, hence this Agreement of Tenancy, shall come into force with effect from the above mentioned date and shall be valid for ELEVEN (11) MONTHS only i.e. effect from 09-06-2012 to 10-05-2013. The rent shall start from the date of obtaining NOC from Station Headquarter. 4. That the TENANT shall use the SAID PREMISES, for his/her own [RESIDENTIAL PURPOSE ONLY] and shall not sub-let the SAID PREMISE to any other person(s). 5. That the TENANT would pay the Electricity Bill according to Meter/SubMeter reading, Sui-gas charges Water/Motor, Water Conservancy Charges, Union fee, Telephone Bill if any, to the concerned authorities or to the OWNER and the OWNER shall pay all Government Taxes, Property Taxes, etc., from his/her own sources and own expenses. 6. That the TENANT shall not make any alteration, etc., of any kind in the SAID PREMISES. Any deamge to the fitting & fixtures. Etc. would be payable by the Tenant at full cost. 7. That if the OWNER wants to get the SAID PREMISE, vacated from the Tenant he/she will have to give one months notice to the TENANT or Viceversa. 8. That the TENANT will be ejected from the SAID PREMISE. if he/she fails to pay the MONTHLY RENT for continuously three (3) months on the notice of fifteen (15) days from the OWNER. 9. That this AGREEMENT OF TENANCY can be renewed by mutual consent of both the parties for further Eleven (11) Months period, with 11 Months Advance and 10% Monthly Rent shall be enhanced on Renewal of the Agreement on completion of the tenure. 10. That if the TENANT could not qualify for NOC from AHQ/Station Headquarter ten advance amounts shall be refunded without deduction. IN WITNESSES WHEREOF the parties set their respective hands before the witnesses here at Karachi, the day monthly and the year first above mentioned.
