JOINT AFFIDAVIT WE, spouses, ATTY. ROMEO B. ABACA, JR. and MARIA FRANCIA C. SANCHEZ-ABACA, 38 years old and 31 years old, respectively, both Filipinos and both with residence address at San Miguel, Nabua, Camarines Sur after having been sworn to in accordance with law, hereby depose and state that: 1. I, ATTY. ROMEO B. ABACA, JR. maintains a law and notarial office at Lazarte Bldg., San Francisco, Nabua, Camarines Sur; 2. On June 2, 2013, on or about 5:20 in the afternoon, we were in the law office, and about to go home, I, Atty. Romeo Abaca, Jr. was inside my office fronting the computer while Maria Francia Sanchez-Abaca was reading a book by her lonesome located at the front desk of the law office, When two unidentified men entered the law office and one of said men was armed with an improvised ice pick and is shorter than the other assailant; 3. The shorter assailant then aimed and pointed the improvised icepick he was holding towards me (Maria Francia Sanchez-Abaca) and demanded to give him money while the taller assailant grabbed hold of my Cellular Phone, a Samsung Galaxy Wonder, with selling price at Php 15, 000.00; I told them WALA AKONG PERA!! ( I DONT HAVE ANY MONEY); 4. I, Atty. Romeo B. Abaca, Jr. was shutting down the computer and I heard my wife talking at a high strung voice at somebody so I glanced towards where she were seated and saw his wife pleading to the armed assailant with an improvised icepick aimed at her; 5. I, Atty. Romeo B. Abaca, Jr. then shouted at the armed assailant Ano yan!? And I walked towards the assailant with the improvised icepick while the armed assailant walked towards me and aimed the improvised icepick towards me instead and stated kailangan lang naming ang pera nyo ibigay nyo na! ( ALL WE NEED IS YOUR MONEY, GIVE IT NOW!); 6. The second assailant, the taller one, then came out, stood beside Maria Francia Sanchez-Abaca and told Atty. Romeo B. Abaca, Jr., Ibigay mo na yung pera para walang masaktan (GIVE US THE MONEY SO THAT NO WOULD GET HURT.); 7. I, Atty. Romeo B. Abaca, Jr. reached in my right front pocket and took out a two hundred peso bill and gave it to the shorter assailant with the improvised icepick, to which the said assailant shouted at him and stated ito lang? wala ng iba? (IS THIS IT? NOTHING ELSE?) So I, Atty. Romeo B. Abaca, Jr. reached in his left front pocket and gave the armed assailant two pieces of a hundred peso bill, and he told both

assailants wala nang iba akong pera (I DONY HAVE ANYMORE MONEY); 8. The armed assailant was furious at Atty. Romeo B. Abaca, Jr but Maria Francia Sanchez-Abaca interjected that may 500 pa po ako na nasa loob ng cellphone na kinuha ninyo ( I STILL HAVE FIVE HUNDRED INSIDE THE CELLPHONE YOU TOOK). The taller unarmed assailant then checked the cellular phone that he took; 9. Afterwhich they warned us not to report the incident to the police or else they will be back and they told us not to follow them; 10. A few seconds after the assailants had left the law office, I, Romeo B. Abaca, Jr. hurriedly went outside called the attention of the neighboring tenants and asked assistance from them, but the assailants could no longer be located; 11. That we reported the incident to the police to track down the fleeing assailants.

12. We are executing this affidavit to attest to the veracity of the foregoing contents giving the authorities concerned and the correct data, information and reference and for whatever legal purpose this may proper, wise and equitable under the premises.
