Buthaveyouevertakenalookatwhatactuallyhappens? FilmTaxCredit$60Million/Year,Proposed:Unlimited ThisweektheSenateFinanceCommitteereportedoutSenateBill1035(PileggiRDelaware), legislationthatwoulduncapandexpandataxcreditprogramforthefilmandtelevisionproduction industrywhich,upuntilnow,hada$60millionperyearlimit. Thisprogramallowsfilmandtelevisionproductioncompaniestoforegopayingtaxestheywould ordinarilypaytothestateforindividualmoviesandtelevisionshowstheyshootinPennsylvania.An amendmentaddedinCommitteewouldalsoexpandthecredittoproducinggamesandotherindividual digitalproductions. StatetaxpayershavehelpedpayforsuchmemorablemovieslikeZack&MiriMakeAPorno andTVprogramsliketheQVChomeshoppingnetwork.ThemostrecentBatmanmoviefilmedin Pittsburgh,interestingly,wasnotsupportedbythecredit.

Moreinteresting,thetaxcreditisnotforactualproductionfacilities,bricksandmortar.Itsfor theindividualproductionsthemselves,temporaryjobsthatlastmonthsatmost. Whileitistruethe$10million/yearResourceEnhancementandProtection(REAP)farm conservationtaxcreditwhichfundspermanentprojectswouldnothavebeenpassedwithoutthe filmtaxcreditin2007,shouldlegislatorsreallybeconsideringablankcheck? ManureManagementSystemSubsidyTensOfMillions/Year AnotherproposalnowbeforetheSenateinSenateBill994(VogelRBeaver),whichonthe surfaceinjectsmorecompetitioninmeetingChesapeakeBaycleanuprequirements,wouldactuallyrig thesystemtorequiretaxpayerstofundonlyexpensivemanuremanagementtechnologiestomeetthe requirements.. Thekicker?Anypollutionreductionsmadeafterinvestingallthosetaxpayersdollarsinthe manuretechnologywouldnotcounttowardmeetingfederalChesapeakeBaycleanupmilestones.It wouldalsoforcetaxpayerstobuythesereductions,thatwillnotcount,atthreetimeswhatanyoneelse wouldpayinthefreemarket. Theproposalcouldpotentiallyinvolvetensofmillionsoftaxpayerdollarsandmanymore. Althoughtechnicallynotfunded,whenhaveyouseenaprogramcreatedbythestatewhichwasntlater funded? EthaneManufacturingTaxCredit$66Million/YearFor30+Years In2012theGeneralAssemblyadoptedtheResourceManufacturingTaxCreditforethane manufacturingwhichwouldprovideupto$66millionayearover30yearsnearly$2billionifthe facilityisupandinthenextthreeyearsorso. Whiletherearecertainlytightrestrictionsonwhatacompanymustdotoqualifyforthecredit, thecompanylookingatsettingupanethanemanufacturingfacilityinWesternPennsylvaniasaiditdid notaskforthetaxcredit,Pennsylvaniaoffered. PrevailingWageUpto$2Billion/Year Alsoconsideranotherstateprogram:prevailingwage. Taxpayersmaynotknowit,butthestatesPrevailingWagelawrequiresmostprojects undertakenbythestateorlocalgovernmentand,importantlymostgrantrecipients,topayprevailing wagestoconstructthoseprojects. Thatincludesroads,bridges,buildings,minereclamationandstreamrestorationprojects, schoolsandmostanyotherbricksandmortartypeprojectfundedbythestate. Accordingtosomeestimates,requiringtheuseofartificiallysetprevailingwagesincreasethe costofconstructionprojectsby10to17percentoverwhattheywouldcostifrealbiddingand competitionwereusedfortheseprojects. Someestimatessaystatetaxpayerswouldsaveupto$2billionayearifprevailingwagewas reformed. Toputthisinperspective,thestatesGeneralFundbudgetisabout$28.4billionayearandthe Senateproposedtransportationfundingpackagewouldraiseanadditional$2.3billionannually. Again,thepoliticsofprevailingwagearedifficult,butthemathonpotentialsavingsisnot. VehicleFuelSubsidies$13.9Million/Year TherearebillsnowontheHouseCalendarthatwouldhelpfundvehicleconversionstocleaner fuelsandprovidea10centpergallonsubsidytobiofuelproducerswhichtotal$13.9millionorso. Yes,theregoodpoliticalreasonsforspendingthesedollarsinthesewaysTheyhelpcreate

jobs,butthatstrueofmostgovernmentspending,directlyorindirectly.Itsnocoincidencetheyare heavilypromotedbytheinterestsinvolvedandbackedupbyreamsofeconomicstudies. Meanwhile,ofcourse,$1.9billionhasbeencutordivertedfromenvironmentalprogramsalone overthelast11yearsandjustabout20percentofthestaffpositionsattheDepartmentof EnvironmentalProtectionhavebeeneliminated. Thequestionis,inthiseraofsmallerisbetter,ismoneyusedtomakeamovielikeZack&Miri MakeAPornoorpayinginflatedprevailingwagesthebestuseofscarcestatetaxpayerdollars? Whattheseitemsclearlyillustrateisthisdontbelieveanyonethatsaystheresnomoney.If theycanspenditonmovieslikeZack&MiriMakeAPornoandtosupportmanuretechnologythat doesntcount,theycouldalsodothingsthatmightmakeareal,lastingdifference. HouseBill1684,sponsoredbyReps.GarthEverett(RLycoming),MattBaker(RBradford), TinaPickett(RBradford)andSandraMajor(RSusquehanna),seekstoclarifystatelawregardingthe minimumroyaltypaymentforlandownerssothatthedeductionofpostproductioncostsfrom unconventionalwellsmaynotresultinroyaltypaymentslessthantheguaranteedminimum. CBF:Nearly20,000MilesOfPAStreamsPolluted ThePennsylvaniaOfficeoftheChesapeakeBayFoundation thisweekputoutthesecondinaseriesoffactsheetsonwater qualityissuesfacingPennsylvaniasayingnearly20,000milesof riversandstreamsinthestatearepollutedanddonotmeet waterqualitystandards. AlthoughmuchfocushasbeenontheChesapeakeBay CleanWaterBlueprint,manymaynotrealizethereare thousandsofstreammilesandhundredsofacresoflakesall acrossPennsylvaniathatareconsideredimpairedunderthe federalCleanWaterActthateitherhaveorwillrequirewhatisknownasaTotalMaximumDailyLoad (TMDL). Whenawaterbodyiscalledimpaired,itdoesnotmeetscientificallyestablishedwaterquality criteria.Simplystated,aTMDLscientificallyanswersthequestionofhowmuchpollutionistoo much? Over7,200milesofstreamshaveTMDLsinPennsylvaniaandmorearebeingadded. AccordingtotheDepartmentofEnvironmentalProtectionsmostrecentassessment,morethan 19,600streammilesandnearly67,990acresoflakesinPennsylvaniaareimpaired.Thisrepresents roughly23percentofallstreamsandapproximately42percentofalllakesintheCommonwealth.

Thethreeprimarycausesofimpairmentare:agriculturalrunoff(5,705miles),abandonedmine drainage(5,596miles)andurban/suburbanstormwaterrunoff(4,103).Sedimentfromthesesourcesof pollutionistheleadingcarrierofpollution. TheefforttoSavetheBaystartswiththesmallstreamsofPennsylvania.Thebenefitsof betterwaterquality,whethertheybeimprovedagriculturalproductivity,reducedflooding,improved sewerandwaterinfrastructure,ordowntownrevitalizationareinvestmentsforPennsylvaniansby Pennsylvanians. Todate,theCommonwealthhasmadesoundinvestmentsinpracticestohelpreducepollution sourcestolocalriversandstreams.Thesepracticesarealsothesamepracticesthatcanbefoundin Pennsylvaniasphase1and2ChesapeakeBayplans,calledWatershedImplementationPlans,andthe associated2yearMilestonecommitments. Bygalvanizingourefforts,andourfunding,onconservationpracticesthatcounttoward meetingtheCommonwealthsobligationsundertheChesapeakeBayCleanWaterBlueprint,weare alsohelpingtoensurecleanwatertolocalcommunitiesintheBaywatershed.
