Son loses tussle with mum over land

PUTRAJAYA: A man lost a tussle
with his mother for the title to
ancestral land worth nearly RM1
million in Langkawi after the Court
of Appeal yesterday ruled there was
fraud in the transfer of the land.
Justice Md Raus Shariff, who sat
with justices Datuk Kang Hwee Gee
and Datuk Sulong Matjeraie, also
ordered Osman Ahmad, 52, to pay
his mother, Yah Kasim, 75, costs
amounting to RM10,000.
The court unanimously dis-
missed Osman’s appeal against the
Alor Star High Court’s order on May
10, 2007, which found that there
was fraud in the transfer.
After the judgment was deliv-
ered, Yah’s daughter, Jelina Ahmad,
42, who represented her mother in
court wept, saying that the decision
confirmed that her mother was the
real heir to the land.
On July 2, 2001, Yah filed a suit
against Osman in the High Court
seeking an order that she is the real
heir to the land on grounds that
there was fraud in the transfer of
the land title.
Yah in her statement of claim
said she and her husband, Ahmad
Sirat, had worked on the 2.8ha plot
in Mukim Kedawang, Langkawi,
and when he died in 1973 she and
Osman cultivated the land.
In 1978, she went to the Lang-
kawi land office to extract the
land title in her name and it was
approved several years later but
the title was not issued.
In 1989, she went to the land
office with Osman to get the title
but Osman took her to meet the
clerk outside the office to affix her
thumbprint.
She said when she still did not
get the land title after six years,
she went to the land office, only to
discover that the land title to which
she had affixed her thumbprint
was actually to transfer the land to
Osman.
Osman, in his statement of de-
fence, said he had a right to the title
because he had worked the land
with his father for 12 years.
