BACKGROUND

On September 8 1998 the City Council approved General Plan Zone


Amendment Change
98 02A B redesignating a 18 29 acre site located south of Hilleary Place between Midland
Road and Community Road from Town Center TC to Commercial General CG In
association with the redesignation the Council directed staff to prepare a specific plan for
the rezoned parcels to limit the types of uses that would be allowed under the new land
use designation

California Government Code Section 65450 et seq enables local governments to adopt

specific plans for the systemati implementation of their general plans This plan has been
and is consistent with the general plan and the

provides locations for major retail and service businesses A major concern regarding the
Commercial General zoning classification of these parcels has to do with the potential
problems concerning increased traffic volumes and flow noise and the appropriateness
of new uses with existing development For this reason the City Council directed staff to
prepare a specific plan that will limit the types of commercial land uses that could be
accommodated on the property to those that will be compatible with nearby commercial
and residential uses and with existing development

I INTRODUCTION

the parcels occupy 18 29 acres and are identified by Assessor Parcel Numbers 317 130
66 67 68 42 They property falls within Section 13 Township 14S Range 2W of the

USGS Poway Quadrangle

III AUTHORITY AND SCOPE

Section 65450 et seq for the Califomia Government Code enables local governments to

adopt specific plans for the systematic implementation of their General Plans This plan
has been prepared in conformance with State requirements

The Government Code requires that specific plans be consistent with the agency s General
Plan It is the intent of this specific plan to define appropriate land uses and development
standards necessary to ensure that any proposed development of the subject property is
compatible with and sensitive to surrounding land uses This specific plan has been
prepared to be fully consistent with the General Plan and its constituent elements

IV RELATIONSHIP TO THE POWAY GENERAL PLAN AND MUNICIPAL CODE

This specific plan is a short and long range planning tool that will be utilized for the
systematic implementation of the Poway General Plan Accordingly this planning
document is consistent with the General Plan As noted in the State General Plan
Guidelines this plan is a combination policy statement and
regulatory tool It provides

adjoining parcels that total 18 29 acres Located on a 1 36 acre parcel at the southwest
corner of Community Road and Hilleary Place is the Poway Retail Plaza The former

44 acre parcel adjoins this parcel to the east


Payless Shoes building located on a 0
Plowboy Produce is situated on a 0 65 acre site on the southwest corner of Midland Road
and Hilleary Place WalMart situated on a 15 84 acre parcel abuts the other properties

through a common parking lot and connects directly with Community Road Midland
and Hilleary Place

The subject parcels and adjoining roadways have been completely improved and contain
concrete curb gutter and sidewalk Landscaping and street trees have also been

In May 1996 theCity Council adopted the Poway Road Specific Plan which established
the boundaries zoning and design standards for all commercially designated lanp located

along Poway Road On September 8 1998 the City Council approved a redesignation of
land use and zoning for a four parcel eighteen acre site from Town Center to General
Commercial The subject property is located south of Hilleary Place between Community
Road and Midland Road and includes the Poway Retail Plaza WalMart the former
Payless Shoe building and Plowboy Produce In association with the redesignation the
City Council directed staff to prepare a specific plan to limit the types of uses that could be
considered under the new designation

FINDINGS

The subject parcels are presently covered by the Poway Road Specific Plan To avoid
implementation conflicts between the existing specific plan and the proposed new specific
plan Staff is recommending the removal of the subject parcels from the Poway Road
Specific Plan

The Town Center zone in the Poway Road Specific Plan indicates that this zone is
intended to serve as the focal point for government and entertainment uses The Poway
Road Specific Plan proposes design concepts aimed at enhancing the pedestrian and

architecture character of the district and to promote citizen interaction The properties north
of the Town and Country Shopping Center however are removed from the core of the
Town Center area by the design of that center Their ability to become part of the Town
Center activity area and to benefit from the proposed pedestrian and streetscape

improvements are limited In addition all the subject parcels are presently developed and
not likely to redevelop in the near future Based on this justification staff is proposing to

BACKGROUND

Dr LaPorte has been operating the Town and Country Veterinary Hospital from a suite
located at 14034 Poway Road for a number of years The business provides medical care

surgery and hospitalization for small animals

In an effort to find a more centralized location for his practice Dr LaPorte selected a suite
in the Retail Plaza This center located within the Town Center which
Poway was zone

precluded veterinary businesses Dr LaPorte applied for a General Plan amendment zone
change to a land use that would permit veterinary practices On September 8 1998 the
City Council adopted a resolution approving General Plan AmendmentZone Change 98
02A B and held first reading of an ordinance rezoning the property from Town Center to
Commercial General This redesignation affected an 18 29 acre site consisting of four
developed parcels including the Poway Retail Plaza located south of Hilleary Place
between Community Road and Midland Road Under the new Commercial General zoning
designation veterinary and animal hospitals are permitted subject to the approval of a
conditional use permit At the September 8 hearing the Council directed staff to prepare
a specific plan for the site and agreed to consider a CUP for the use at the same hearing

as the specific plan

FINDINGS

The veterinary clinic will be located in 1 995 square foot office suite at 13445 Community
a

Road in the Poway Retail Plaza There are several restaurants immediately surrounding
the proposed office location Concerns had been raised regarding the appropriateness
of the proximity of the veterinary business in relationship to the restaurants The County
Health Department was consulted and indicated that they do not have any criteria that

regulates the location of these types of businesses It was further pointed out by the
LaPorte s that there are at least four other locations in the City of Poway where veterinary

located to within suite of a restaurant The proximity of


businesses are adjacent or one

these uses is no longer a concern to staff

As with most human and animal medical facilities the use and disposal of biomedical and
other forms of hazardous materials is of concem to the City and surrounding businesses
The State strictly regulates how these materials are managed Disposal of these waste
products will be handled by a contracted company that will pick up the materials during
business hours There will be 1 10 outside storage of these materials or any other business

related materials

As with any animal clinic noise odor and the attraction of flies and fleas is a concern to
neighboring businesses Conditions have been placed in the resolution of approval that
that will keep these potential nuisances to

8 Any signs proposed for the subject business must comply with City of poway sign
standards

9 All landscaped areas shall be maintained in a healthy and thriving condition free
from weeds trash and debris

10 This approval shall become null and void if building permits are not issued for this

project within two years from the date of project approval
