IN REMOVAL PROCEEDINGS APPEAL ON BEHALF OF RESPONDENT: APPLICATION: Remand Michael Franquinha, Esquire
This case is before us pursuant to a September 28, 2010, order of the United States Court of Appeals for the Ninth Circuit, granting the government's unopposed motion to remand. On February 9, 2011, counsel for respondent requested that we remand this case to the Immigration Judge for further proceedings, specifically to allow the government an opportunity to review new evidence relating to the respondent's death and to determine whether these proceedings should be terminated. The Department of Homeland Security ("OHS") has not opposed this request. Accordingly, we will remand this record for further proceedings.
ORDER: The record is remanded for further proceedings consistent with the foregoing decision and for the entry of a new decision by the Immigration Judge.
