    In Deutsche request for judicial notice, page 4: lines 14 -16 Deutsche states for the record, it had to buy a copy of Cutlip's deed of trust from the Santa Clara County Recorder’s Office. What is telling is that none of the documents in Deutsche requested for judicial notice shows that Deutsche has an interest in petitioner loan, Deed of trust or promissory note conspicuously missing is an assignment of any kind or manner and does not suffice to prove ownership or holder status the photocopy of the Deed of trust presented by Deutsche for judicial notice was admittedly received from the recorder’s office and is still in the name of the original lender Downey Savings not Deutsche Bank for Harborview 2007-7 Appellant contends that the photo copied instruments presented to the court for judicial notice confirm the fact that the trust was never transferred the loan and that the Deed presented was not assigned to Deutsche and insufficient to establish that Deutsche bank for Harborview was the current holder, and is not drawn, issued or endorsed to the order or bearer in blank therefore Deutsche is not the holder of the beneficiary interest in the Deed. The note is not recorded so Deutsche and couldn’t even submit a photocopy of the note.
