LEGAL METHOD, RESEARCH METHODOLOGY AND COMMUNICATION SKILL

ART AND SCIENCE OF ADVOCACY

ROLL NO. -: 945. NAGENDAR KUMAR RAM

INTRODUCTION-:
Most professions require long periods of apprenticeship before one can enter them, and irt is during that period that the young apprentice learns his work, the traditions of the profession and its rules of conduct. Unfortunately, a lawyer in India after getting the law degree and after one years work in the chamber of a senior lawyer, and most of the senior lawyers hardly ever take any interest in their juniors, becomes a full-fledged advocate entitled to set up on his own. It may be that we believe in the trial and error method, by which the lion cubs learn the technique of the hunt, but here the lesion is learnt at the cost of the third party, the client, and in the larger interest of administration of justice it should be deprecated.

RESEARCH METHODOLOGY-:
For the purpose of research the researcher has relied on primary sources to look for information relating to the topic and secondary sources for the position and advancement of its in India. The researcher has aimed at doctrinal as well as non-doctrinal methods of research and will try to critically analyze and provide an un-biased account on the ART AND SCIENCE OF ADVOCACY.

HYPOTHESIS-:
From the initial research it appears that the ART AND SCIENCE OF ADVOCACY is a topic of heated discussion due to its vast nature. Researcher will describe their own perception towards this topic.

TENTATIVE CHAPTERISATION-: 1) Meaning of advocate and advocacy: in this chapter, the researcher will discuss the meaning of advocate and how the advocates deals in a court. 2) The art of persuade judge: in this chapter, the researcher will deal with how the advocate persuade the judge and lead his mind to the conclusion desired by the speaker. 3) The art to persuade clients: in this chapter, the researcher will deal with how the advocate speaks and vigorously and at reasonable length, and indeed exhibit all the outward evidence and left the court receiving the congratulations of his juniors and the thanks of his client. 4) A good physical appearance: in this chapter, the researcher will discuss about how a god lawyer should dress, what should be his personality and how should he speak so that he can create a good impression in front of his client. 5) The art of cross examination: in this topic, the researcher will deal with the art of cross examination which a lawyer should have, he will also discuss that how a lawyer should argue with his opponent advocate in the sense to prove his words. 6) Conclusion: in the following chapter the researcher will conclude his entire research and
