APPLICATION: Remand
In a decision dated August 16, 2010, the Board dismissed the respondent's appeal from the
Immigration Judge's May 4, 20 I 0, decision finding the respondent removable, as charged, based on his conviction of an aggravated felony. On January 16, 2013, the United States Court of
Appeals for the Fifth Circuit granted the respondent's petition for review and vacated the removal order. On July 23, 2013, the Department of Homeland Security (DHS) filed a motion with the Board seeking a remand of these proceedings to the Immigration Court. The DHS filing submits that this case was recently remanded to the Board by the Fifth Circuit. However, the
only Fifth Circuit order before us does not reflect a remand of these proceedings to the Board. As there are no proceedings currently pending, the DHS's motion to remand will be denied.
