Case 1:10-cv-02031-DLI-JMA Document 311 Filed 12/12/13 Page 1 of 1 PageID #: 9172

December 12, 2013 The Honorable Dora L. Irizarry United States District Court Eastern District of New York 225 Cadman Plaza East Brooklyn, New York 11201 Re: Securities & Exchange Commission v. Spongetech Delivery Systems et al., Civil Action No. 10-CV-2031 (DLI) (JMA)

Dear Judge Irizarry: I write to provide to the Court additional information that relates to the application that I filed in October, 2013 for release of seized funds to Michael Metter. In that application, which sought release of the remaining amount of $22,739, I listed for the Court the tax obligations and medical expenses that Mr. Metter seeks to pay with those released funds. Affirmation of Maranda Fritz, Doc. 303. I also filed a Proposed Order (Doc. 303-1). The Securities and Exchange Commission thereafter submitted a letter to the Court confirming that it consented to the request. (Doc. 304). Since then, Mr. Metter has received further notifications from the State of Connecticut Department of Revenue relating to the outstanding balance due of $7,567.12. That notice also confirms that, unless he pays that amount on or before December 15, 2012, the amount will increase. It is Mr. Metters hope that the funds can be released so that he can satisfy that obligation in a timely manner and also pay federal taxes and medical expenses. As always, thank you for your consideration in this matter and happy holidays. Respectfully submitted, /s/ Maranda E. Fritz Maranda E. Fritz cc: Paul Kisslinger, Esq.
